There’s a military strategy, largely considered a dirty tactic, where the likely losing party attempts to win by wearing down their opponent until collapse.
This approach — “attrition warfare” — is generally considered a last resort, as it doesn’t deliver a decisive blow and, according to one description, only leaves the door open for “losers to believe they can win the next time.”
That’s what accused murderer Charlie Adelson and his lawyer Daniel Rashbaum seem to be hoping for as they head toward his fall trial in the hired killing of Charlie’s former brother-in-law, FSU law professor Dan Markel: exhaust the system, “win” a mistrial, and get another chance at acquittal down the road.
In today’s (Aug. 25) case management hearing, Rashbaum told Judge Robert Wheeler that his team anticipates a more extended trial than the scheduled two weeks.
“Our case could be lengthy and could go a week, five to six days of testimony,” Rashbaum said, noting that this would bring the trial out several days from its current Nov. 9 closing. Jury selection will begin on Monday, Oct. 23, with opening statements and the state’s case likely to begin that Friday or the following Monday.''
An attempt to bore the Jury, to lead them into paths of confusion, simply will not work. We have two convictions and we'll get the 3rd one, Charlie's.

"Markel had become quite inconvenient to Wendi and her parents. In the year before his murder, Markel uncovered what he believed to be financial misdoings by Wendi that could have led to devastating professional consequences for her and had initiated a legal process to limit unsupervised access by Donna to his boys following her unyielding disparagement of him to them. The motive in this murder is clear, matched by extraordinary evidence that Charlie took action to fulfill his mother’s and sister’s wishes."

Attorneys firmed up deadlines for Adelson’s upcoming trial which is scheduled to start with jury selection on Monday, October 23rd.

Jury selection could last three to five days, attorneys estimate, and testimony could begin as early as Thursday, October 26th.
The trial is expected to wrap up by November 9th, but Adelson’s attorney told the judge the length of his case would depend on the witnesses and evidence presented by the state.

Any pre-trial motions and lists of experts, exhibits and witnesses are due to the court by September 22nd.

Charlie looks very comfortable to me, IMO. I wonder how this is for him, how he is feeling about his family and the whole situation. I’m a bit shocked that he would hedge his bets on an acquittal, mistrial, etc… and not say anything… but I guess that’s his whole family and life that he knows. I’m still shocked that KM didn’t reveal anything and stayed in jail for years awaiting trial!

Haven't been on here in awhile. I will be attending the trial. Hoping we get another arrest before, still holding hope for Donna which is likely the only pressure they can put on Charlie for a deal. I found it interesting that Rashbaum said they would need 5-6 days for their case. That hints, to me, that Charlie will be testifying. I mean how else can they explain away his own words? Plus, it's the Maestro.

Vinnie Politan did a new show on this yesterday I think. I'm thrilled that Ruth Markel will be doing a presentation on her book at Dan's synagogue the night before the trials begin. I will be there. Her book is heartbreaking and a beautiful look in to Dan as he was in life.

WIll also be so interesting to see if anything comes of Katie's proffer. We might get a better glimpse in to that at the pre-trial conference.

Oh and I also heard on a podcast that Charlie has been on and off suicide watch--including up to 50 checks per day. That made me wonder if that might be a serious option for him to "save" his entire family.

Have you been listening to Carl Steinbeck on the STS podcast? He's a retired JAG attorney and has been detailing all the ways he thinks point to Wendi's guilt and he seems very confident she will be tried and convicted one day. And yes, I agree with you here.

Yes I believe that's a "pre-trial conference" which some said will reveal more about the strategies of both sides.

I just googled Carl Steinbeck <modsnip - not an approved source>--- I am waiting for the day there is justice in this case. It is taking so long though, it is difficult to be patient. And you know during all these years Wendi has bad mouthed Dan Markel to their children-- it is just so ugly.

Yes, next on the docket is a pre-trial hearing on 10/20 @ 9am. The clerk's notes from the 8/25 hearing indicate that pre-trial motions and witness & exhibit lists are due 9/22. Also, an additional CMC may be scheduled between now and the 10/20 hearing if necessary.
