FL - FSU Law Professor Dan Markel Murdered by Hitmen *4 Guilty* #25

DA's motion for a bond hearing attached. Looks like the three-hour hearing will be on Wednesday, February 26 at 9 AM EST.

Among a lot of other health-related information here, she offers reasons why she is not a flight risk and requests to be bond-released into the Tallahassee area, to be joined by her husband HA. And you can get a glimpse of her daily routine, including a 3:30 AM wake-up for breakfast.

Her audio played in the courtroom as she called in from the jail to testify about two women who told Adelson they were in the Leon County Jail with Katherine Magbanua, one of Adelson's alleged co-conspirators.

Donna said an inmate source heard Magbanua admit to setting the family up.

"She said 'Wait til I come back. I am going to take care of that family. Wait til they see what they're going to get and I'm going to get a reduced sentence,'" Adelson testified.

Her testimony on what was said sounds so fake. Somehow it sounds exactly like what a sheltered 70 year old woman would invent as a jailhouse confession.IMO.

1/27/25 Docket update: Defendant’s Motion for In Camera examination of defense investigator-Granted. Defendant's Motion for Change of Venue-Not have been decided yet. Order Denying (requests to unseal proceedings)-Granted. Instructions from Judge. Set motions hearing on 1/29/25 @! 11:30am on motion to perpetuate testimony. Defendant does not need to be transported. Conclusion: This hearing seems importantly consequential. It has the potential of affecting the tone & the substance of Adelson’s proceedings going forward.
1/29/25 Update: Adelson gave impromptu testimony about two fellow inmates who claim to have spoken with a conspirator in the Dan Markel murder-for-hire plot & gotten information that could help her defense. Adelson, who is being held in the Leon County Detention Facility, appeared via Zoom for a brief hearing Wednesday at the Leon County Courthouse. Leon Circuit Judge Stephen Everett scheduled the hearing to discuss a motion by Adelson’s lawyers seeking to compel the two inmates — both potential defense witnesses — to sit for depositions because they may be unable to testify at trial. The women both claim to have had previous jailhouse conversations with Katie Magbanua, who was convicted in 2022 in the Markel plot & sentenced to life in prison. They shared the statements with Adelson & a new private investigator for the defense who spoke with them last week. Zelman said his co-counsel, Jackie Fulford, was prepared to briefly question Adelson under direct examination so she could discuss the witnesses’ statements. Everett allowed the questioning to proceed. Assistant State attorney Georgia Cappleman asked Everett to deny the defense motion, saying almost all witnesses in criminal cases “may not be available” to testify at trial. Everett agreed, ruling against the defense. Judge Everett went on to say that the defense should subpoena the witnesses to secure their testimony at trial, which is set for early June. He said he would readdress the motion if at some point “we are no longer dealing with something that is completely speculative.” Early in the hearing, Everett complained that the defense motion, which was not available on the court's website, did not include much of the information that was presented. Zelman said he didn't want to put "everything" in the motion because it "gets played over & over" in the media and on podcasts. "Forget about the media," Everett said. "I'm going to the sufficiency of the pleading itself." Next case management hearing on 2/11/25 @ 2:30pm.
2/6/25 Update: Adelson was moved to protective custody at the Leon County Detention Facility as a precaution after reporting that she was allegedly assaulted & extorted by another inmate in December, according to a Leon County Sheriff’s Office spokesperson. On Monday, [2/3/25] Adelson reported that another inmate grabbed her arm & tried to extort her in December, LCSO spokesperson Shonda Knight said Thursday morning. Adelson would not provide any additional information about the inmate or the alleged assault, per Knight. She was then moved to protective custody as a precaution, according to Knight. At this time, the alleged assault & extortion are being investigated by LCSO, according to Knight.

This upcoming hearing sounds similar to the one that DA had after she was first booked in the Leon County Jail, where the jail warden was brought in to address DA complaints of mistreatment. It was awkward because the warden is from a different organization (Leon County Sheriff) than the judge. The judge does have some authority to ensure that inmates are treated fairly but can't instruct the warden how to do his job. I would think that the warden will be brought in again, along with a doctor from the jail healthcare staff to respond to DA's list of issues.

DA and her team really went all-out for a dream bond-release scenario. Would get to live with HA and would be free to roam (with location monitoring) in Leon County from 7 AM to 7 PM. DA did mention suicide as an option after CA trial and you have to wonder if she would ever voluntarily present herself to be jailed again, if free on bond.

Found an article for yesterday's hearing.

............
Leon Circuit Judge Stephen Everett set a court date for Feb. 27, setting aside three hours to hear the defense motions and hold an Arthur hearing.

edited to add - I just need the "time" of hearing... TIA if someone can provide that! :)

According to court records, the next hearing will be held February 26, for three hours. It's a mini trial, called an Arthur hearing. Legal expert Don Pumphrey says it's a common practice.

The judge kept the discovery deadline for April 30th. The trial begins in June.

Seems like the defense atty was leading us on when he said the name of EB's father could be revealed during the trial. JMO

Okay - I have 2 different dates here - one article says 2/26 the other 2/27 - ?? HELP!

@PayrollNerd - when you have time - I would like to know if Adelson's next hearing is on 2/26 or 2/27 - as two articles have these 2 different dates. I had 2/27, but I believe I got that from the first article that mentioned. TIA! :)

The main issue discussed was a bond hearing that was scheduled for the February 26th. Adelson's attorneys filed a motion on Friday, arguing she's not a danger or flight risk
