I know. It's just really sad. Maybe it's also possible they couldn't prove either way if the baby was stillborn.
If decomposition isn't too advanced, they can tell from the lungs, I believe, if the child took breath. But sometimes other things come out. I know there was a very sad case last year where an undocumented woman disposed of a stillborn baby in a dumpster out of fear of her and her children being deported if she took his body to a hospital. She came forward almost immediately when they released surveillance. The police initially said it was being investigated as a homicide, but it did a complete 180 to natural once the medical examiner had a look. I think the child either didn't have a brain or had an extreme abnormality in the brain incompatible with life. So she was only charged with a relatively minor offence, and she seemed to be genuinely distressed at the child's loss and grieving. So perhaps there was something equally evident to the medical examiner in this case that the child could never have lived, and that's why the charges are what they are for the parents.

I agree, however, that babies, whatever their viability, don't belong in the garbage.

Oh, interesting and sad. There are some unidentified babes found in the forest or in water, wrapped in blankets and sometimes with figurines, etc. So I would expect to see something more like that. JMO.

(snipped by me) i was just studying forensic pathology and it actually said that sometimes, its very hard to tell! if true that LE tried 'lifesaving measures' i.e. CPR or using a mask valve bag, that can 'artificially' aerate the babys lungs and thus that finding is now non-conclusive. that could be a possibility in this case as well
