Marshall's son, Matthew Marshall, was arrested Monday on a fraud charged for skipping out on his tab at BackStreets Sports Bar in Cape Coral where he tried to use a credit card with the name James Marshall on it. The card was declined. He walked out of the establishment without paying.

Police would not confirm that Matthew Marshall was the person of interest in the elder Marshall's homicide investigation.

Matthew Marshall, also of Cape Coral, remains in custody at the Lee County Jail on a $3,500 bond for swindling the bar.

Cape Coral police haven't named a suspect in the murder of 58-year-old James Marshall, but his son is still in the Lee County Jail for using his father's credit card one day after he was reported missing.

But that’s not the only bizarre thing about Matthew Marshall.

The 33-year-old has had some previous run-ins with the law, and a Facebook page with his name reveals a dark side.

On Tuesday, Marshall told the judge that he rejected a public defender and is waiting to hire a private attorney.

"I'm going to get my discovery and then decide what lawyer to retain," Marshall told Fuller.

Marshall appeared agitated as he scanned the courtroom, interrupted prosecutors and was surly with the judge.

Billy Broccio, best friend of 58-year-old James Marshall, was in court but declined to comment. Marshall's next hearing is scheduled for July 20.

Dismembered Cape Coral father feared his son

The final months of James Marshall’s life were tumultuous.

His son threatened to slit his throat.

The situation became so severe the 58-year-old began sleeping in his room with a chair wedged against his bedroom door . He was so concerned he established a safe word — "Rocky" — to send it to his friend in case he needed police help.

Marshall never got the chance to use it.

The murder of a Cape Coral man turned into a family spectacle as the trial began Monday.

James Marshall was killed in February and his son Matthew Marshall is accused of dismembering him and then dumping the body into a canal.

Matthew, who faces second degree murder charges, is representing himself in the trial. Things escalated when his own brother broke down on the stand when he had to identify his father’s remains.

The Cape Coral man accused of savagely killing his own father has been found guilty.

The jury reached a verdict Thursday evening after more than three hours of deliberations.

Investigators say Matthew Marshall -- who represented himself during his trial -- dismembered his father Rick Marshall and then hid his body parts near his condo earlier this year.

Marshall was also found guilty of abusing a dead body, tampering with evidence, and credit card fraud. The latter charge stemming from Marshall using his father's credit card the day he was murdered

A Cape Coral man will spend the rest of his life behind bars after he killed and dismembered his father in February and dumped the body parts in the woods behind their condo and in a canal.

Lee Circuit Judge J. Frank Porter sentenced Matthew Marshall, 34, to life in prison for second-degree murder, abiding by the wishes of most of the victim’s friends and family members who testified Monday. Porter said it was “without any doubt the most gruesome and brutal murder of my career” and said Marshall is a danger to the community and to his family.

“It is my intent that you never see the sun rise, the sun set or take a breath outside the walls of the Department of Corrections the rest of your natural life,” Porter told Marshall, who sat slouched in his chair wearing a brown jail jumpsuit, his hands and arms shackled behind his back.

Marshall, who represented himself during his trial, rambled about his Fifth, Sixth and 14th Amendment rights during a statement to the court. He complained that he was not let out of jail to prepare for his trial, he was not allowed to see his father’s cremated body and that the jury was biased against him.
