11/7/24 Docket update: Gardner: Cross notice of taking deposition. 11/7/24 Docket update: Saldana: Eight notice of taking deposition by Zoom. Next pretrial hearing for both on 12/12/24 @ 9am.
12/12/24 Update: Mario Fernandez, Shanna Gardner’s husband, wrote 3 checks to Henry Tenon totaling $10K in the weeks after what prosecutors are calling a murder for hire to kill Gardner's ex-husband, Jared Bridegan. See post #675, page 34, thread #2. A new round of documents released Monday in what police have described as a murder-for-hire plot to kill Jared Bridegan center around the bank accounts of Henry Tenon, Mario Fernandez and Shanna Gardner, as well as the trust fund agreement for Gardner. Tenon has pleaded guilty to second-degree murder and admitted to being the man who pulled the trigger in the fatal ambush in February of 2022. State Attorney Melissa Nelson has previously said he will testify in the upcoming trial for Fernandez and Gardner. Gardner and her second husband, Mario Fernandez, are facing first-degree murder charges in the death of Gardner's ex-husband, Bridegan. He was shot to death after dropping off the twins he shared with Gardner to her Jacksonville Beach home. Police say a tire was placed in a narrow, dimly-lit section of road and he was shot to death when he exited his vehicle to move it. His 2-year-old daughter from his second marriage was in the car, but not struck by the bullets. In a May bond hearing, the lead detective on the case, Chris Johns, testified Tenon was asked by Fernandez to be a part of the killing. Tenon was a tenant at a rental property Fernandez owned. Det. Johns testified that Tenon told them he would be paid $150,000 under the guise of an investment in a pallet business and he would get it in installments. New documents released Monday show three checks deposited into Tenon's bank account from First Choice Home Rentals (a company owned by Mario Fernandez and Shanna Gardner) and signed by Mario Fernandez: $2,000 with the memo line- Ladscaping and clearing"; $3,000 with the memo line "Keeping up with the roof" & $5,000 with the memo line "Kickstarter Good Luck!!" Another document released was the business application for First Choice Home Rentals LLC, listing Owner #1 as Mario Fernandez and Owner #2 as Shanna Gardner with a 60%-40% split, respectively. The financial documents show a transfer from the Shanna Gardner Irrevocable Trust for $5,000 on March 15, 2021, and $5,000 on April 26, 2021, nearly a year before Bridegan was killed. The fourth document released was an Application for Deposit Trust Account for the Shanna Gardner Irrevocable Trust. The bank statement lists Mario Fernandez as a joint owner and shows a transfer of $10,000 to a checking account on Feb 4, 2021. There is also a $75,000 check deposited from Gardner's parents, Shelli and Sterling Gardner, on Dec. 21, 2021. The final document released was the financial record of Shanna Gardner's Irrevocable Trust showing large amounts of money being deposited and withdrawn as well as expenses. Mario Fernandez is listed as a joint owner and trustee in the documentation. Since the pair’s last appearance in court in late October, Gardner’s attorneys have filed six motions seeking to block the death penalty in her case. Court documents do not show any motions filed for Fernandez related to the death penalty. Gardner’s defense is trying to prevent the state from using the word “recommendation” to describe a jury’s role in the case if it reaches the penalty phase. Attorneys argue it misleads jurors. The defense also says the case should not be held to the new state law that says a jury needs an 8-4 vote to recommend the death penalty. Instead, it says the case should be under the old state law requiring a unanimous decision since Bridegan’s murder happened in 2022 before the new state law was passed. Gardner & Fernandez will be back in court on 1/6/25 @ 9am. Jury selection in the murder-for-hire case is tentatively scheduled for 10/20/25. State's Discovery Exhibit regarding Depositions filed-for more info see post #690, page 35, thread #2.
