Medical examiner testifies in Derek Medina murder trial that victim likely on knees

MIAMI - A medical examiner testified Wednesday that a woman was possibly cowering on her knees and not throwing punches when she was fatally shot by her husband, who later posted a photo of her body on Facebook and claims self-defense.

Miami-Dade County's chief deputy medical examiner, Dr. Emma Lew, told a jury that, based on the wounds, Jennifer Alfonso, 27, also probably wasn't fighting with Derek Medina, 33, before she died. Medina told police in a statement that Alfonso threatened him with a knife and was beating and shoving him in their kitchen.

Alfonso had several defensive bullet wounds on her left forearm and all of the eight shots struck her upper torso or jaw area, Lew testified. She said the angles of the bullet pathways all indicate they were fired from above her.

Before the jury arrived, the defense filed a motion asking the court to force the victim's now-12-year-old daughter to testify.

Medina faces life in prison if convicted.

Facebook killer’s defense experts take the stand

Trying to bolster their case for self-defense, lawyers for Facebook killer Derek Medina presented a battery of experts on Thursday, including a forensic pathologist who testified in the O.J. Simpson murder trial.

Dr. Michael Baden insisted that Medina’s slain wife, Jennifer Alfonso, was not kneeling when Medina shot her to death inside the kitchen of their South Miami townhome.

“She was standing and bent forward,” Baden told jurors on Thursday. “The right arm could be up, down, holding something, not holding something — I can’t tell.”

On Thursday, prosecutors hit back during cross-examination, noting Baden had not personally examined Alfonso’s body. They also questioned Baden’s claim that Medina was being attacked with a knife.

“The defendant had no lacerations on his hands, correct?” asked prosecutor J. Scott Dunn.

“That’s correct,” said Baden, a retired forensic pathologist who also consulted on the high-profile police shooting of teenager Michael Brown in Ferguson, Missouri.

The defense also presented Benjamin Tisa, a former FBI agent and use of force expert.

Tisa, who has trained police officers for almost 40 years, said a knife “would be an assaultive action that would require a defensive action.”

But he admitted that Medina’s gun — which he brandished before she drew the knife — could be interpreted as a threat as well.

(IMO the photo used in this article appears to be from when the defense was arguing for a witness to be permitted to testify regarding a bottle of pills found in the kitchen cabinet. DM was coming unglued at that point and shouting at his attorney while his attorney was making his argument to the court.)
