Confessed trigger man testifies in Denise Williams murder trial

TALLAHASSEE, Fla. (WCTV) -- Denise Williams’ murder trial is now underway in a Leon County courtroom. To watch the proceedings, click here.

5:00 p.m.
Testimony has wrapped up for the day. Brian Winchester - who has confessed to shooting and killing Mike Williams - spent more than two hours on the witness stand. Defense attorneys will have a chance to cross examine Winchester Wednesday morning. Testimony is scheduled to resume at 9 a..m.

3:50 p.m.
Brian Winchester testified that Mike Williams was increasingly suspicious of his wife and says Mike even confided in him about it, unaware that he was the one having an affair with Denise.

“Denise really didn’t have to do a whole lot other than come up with an alibi for herself and make sure that Mike went,” Winchester said of the plan to kill him.

Brian Winchester began his testimony brimming with emotion, his voice cracking and choking back tears, before regaining his composure and detailing for the jury his account of his long affair with Denise Williams and plans to kill him so they could be together and collect his life insurance money.

*Trial continues (Day 3) (@ 9am ET) – FL – Jerry Michael “Mike” Williams (31) (Dec. 16, 2000, Tallahassee; found Dec. 9, 2017) – *Denise Merrell Williams Winchester (48/29 @ time of crime) arrested & charged (5/7/18) with 1st degree murder, conspiracy to commit 1st degree murder & accessory after the fact. Plead not guilty. No bond (denied 6/19/18).
Also charged (8/10/18) with 3 counts of insurance fraud. Plead not guilty. Bond set at $50K for each count. Leon County-can’t access. Trial starts 12/10/18 is just for Murder charges.
Her ex-husband Brian Winchester (45) was indicted (8/9/16) for kidnapping, domestic assault & armed burglary of Denise. Plead no contest (10/16/17) to plea agreement where assault charges were dropped. Sentenced 20 years in prison. They were married in Dec. 2005 & separated in 2012, divorced in 2016. 6/1/18: Brian took a plea deal with immunity & confessed to killing “Mike”.
8/10/18 Update: Williams obtained three life insurance policies totaling $1.75 million from two insurance companies following the death of her husband, Mike Williams. Court documents state Mike Williams applied for life insurance coverage worth $250,000 in February 1995 due to his recent marriage to Denise. Brian Winchester is listed as the agent for the policy. In March 2000, Mike applied for additional life insurance from a different company, with a policy amount totaling $500,000. In April 2000, Mike completed another life insurance application worth $1 million, with Winchester listed as the agent.
12/5/18 Update: People who gave their opinions on national television about the guilt of Denise Williams & their thoughts about the murder of her husband Mike Williams nearly 18 years ago won’t be able to make those statements in trial. Additional pretrial matters resolved Wednesday included a formal agreement by Assistant State Attorney Jon Fuchs not to seek the death penalty if Williams is convicted. Fuchs had said he was not intending to pursue capital punishment. Leon Circuit Judge James Hankinson took under advisement a motion that four people, including a jail mate and members of Winchester’s family, not be able to testify in an attempt to discredit Denise Williams regarding the kidnapping case. The judge likely will make any rulings in real time during the trial. Jury selection begins Monday, 12/10. Jury selection expected to last 2 days. Opening statements are expected to begin Wednesday.
12/10/18 Day 1: A jury of 6 men & 5 women was seated on Monday after 100 potential jurors were questioned by attorneys and Leon Circuit Judge James E. Hankinson. 2 alternates, both women, were also selected. The trial is expected to last 5 days.
12/11/18 Day 2: The judge admonished the jury after he says one of the jurors made a post about the case. He called the comment “innocuous” and said he would not take action, but warned them to stay off social media. Opening Statements. State Witnesses: Greg Morris, FWC officer who responded to missing duck hunter. Scott Dungey testified on tape (good friend of Mike's). Brian Winchester. Trial continues to 12/12.

Interesting legal aspect of this trial -
Before a witness leaves the witness box, the judge looks at the jury and asks "does any juror have a question of this witness?"

RULE 3.371. JUROR QUESTIONS OF WITNESSES
(a) Judicial Discretion. At the discretion of the presiding trial judge, jurors may be allowed to submit questions of witnesses during the trial.
(b) Procedure. The trial judge shall utilize the following procedure if a juror indicates that the juror wishes to ask a question:
(1) the questions must be submitted in writing;
(2) the trial judge shall review the question outside the presence of the jury;
(3) counsel shall have an opportunity to object to the question outside the presence of the jury;
(4) counsel shall be allowed to ask follow up questions; and
(5) the jury must be advised that if a question submitted by a juror is not allowed for any reason, the juror must not discuss it with the other jurors and must not hold it against either party.

Does the jury have questions for the witness?

Arizona, Florida and Indiana are the only states that specifically endorse juror questions, but most states either give the judge discretion in allowing juror questions or lack a legal prohibition against such questions. Other states, including Georgia, Mississippi and Nebraska, forbid jurors from asking questions, citing a series of concerns.

A small number of states have changed their laws and court rules to allow jurors to ask witnesses questions, either orally or in writing through the judge. Written questions submitted in advanced allow attorneys for both sides to make objections based either on the ground they would violate the rules governing the admission of evidence or would result in prejudice against their clients.

The states that expressly encourage judges to allow jurors to question witnesses are Arizona, Arkansas, Florida, Indiana, Iowa, Kentucky, Nevada and North Carolina. Out of these jurisdictions, Arizona, Florida, and Kentucky require that judges allow jurors to ask written questions. The respective highest state courts of Indiana and Kentucky have ruled jurors have a right to ask questions of witnesses.

Other jurisdictions give a more restricted endorsement of this practice. In Pennsylvania and Michigan, the respective state supreme courts have said it is permissible at the discretion of the trial judge. Texas does not permit jurors to question witnesses in criminal trials and Georgia law requires all questions to be written and submitted to the judge. Only Mississippi law expressly forbids jurors from questioning witnesses.

Denise may be guilty, but I think she'll be acquitted. Perhaps a mistrial.
Brian's testimony reeks of 'jilted lover' and 'revenge'. He isn't simply seeking justice.

What happens if she is found guilty?

If she is found guilty on the murder charge, she would face a mandatory life in prison sentence.

If she is found guilty of either conspiracy or accessory after the fact, the judge could sentence her up to life in prison.

It’s not certain where she would be incarcerated. Brian Winchester, who was sentenced to 20 years in prison for her armed kidnapping last year, was sent to the nearby Wakulla Correctional Institution where his family can easily visit.

What if she is acquitted?
She still faces separate charges of insurance fraud, but she would be able to post bail pending resolution of that case, which would fall apart if she is acquitted.

In addition, no one would be convicted of Mike William’s murder.

Cheryl Williams and Nick Williams also testified for the state on 12/12/18. There were several other witnesses who testified Wednesday 12/12 including LEOs and insurance agents.

Kathy Winchester (Kathy Thomas) did not testify on 12/12/18. She is expected to testify today 12/13/18:

Prosecutors will wrap up their case today with a final witness.

Winchester's first wife, Kathy Thomas is detailing the PCB trip in which lurid photos of her, Denise and Brian were taken.

Kathy Thomas "Whenever it was just me with Brian and Denise it was uncomfortable, I felt like the third wheel, I felt like I was on a date with the two of them."

Denise's party name- Meridian

Kathy Thomas said she found a receipt for a necklace with a "Meridian" pendant on it

Thomas: "Denise asked me to tell Marcus to get a message to Brian that ‘I’m not talking’" before she started working as a confidential informant for FDLE

"I know that you know something" she says to Denise, who promptly changes the subject.

Important to note that in the call that was played, Kathy Thomas brings up an earlier conversation in which Denise told her to get a message Winchester that she wasn't talking to FDLE. That direct conversation was not, however, on the recording
