I think MD counts on this as far as how he sees his rights. He knows all he has to do is say he was threatened, and BINGO, it's kill at will. No prob.

But the homeless guy had warrants on him. And he returned to the scene even though it meant he was going to jail. You are making assumptions about Tommy Storns and the reason for fleeing. They fled to avoid being killed. And returned almost immediately. There wasn't enough time for anyone to make a decision about dumping a (fictitious) gun, much less actually dump it. IMO, this was all covered thoroughly with eye witness testimony.

This. The Leblanc's had a front row seat and were watching them the whole time. When Chris wasn't watching the sister was and vice versa. They did not see a shotgun come out, they did not see them leave the immediate area of the car, and they didn't see one on the ground after. I believe ATM they were afraid of these teens and were hyper aware of what they were doing. Chris even made the remark that it looked like they were stashing something so he would be very focused and hyper aware of a gun coming out of the car if he thought that's what they could be doing. It didn't happen. There was no gun.
