on Stand Your Ground Immunity

She still receives new trial, but ct said, she cannot raise SYG at new trial. Jury will not hear evidence on it. MOO.

"A motion for a second "stand your ground" hearing for Marissa Alexander has been denied, in a ruling made Friday by Judge James Daniel...."
"Daniel said the so-called new evidence brought forth by Alexander's defense lawyers isn't really new and that the material facts of the case haven't changed since the first stand your ground hearing.Daniel said while the stand your ground law has been changed by the Legislature with the "warning shot" amendment -- which grants immunity to people with clean criminal records who fire a warning shot or threaten to use deadly force in self-defense -- it cannot be applied retroactively."

Facing a possible 60 years in prison for firing a gun at her estranged husband and his two sons, Marissa Alexander agreed to a plea deal that effectively ends the four-year old criminal case against her.

According to the terms of the plea, Alexander was ordered to serve three years in prison after pleading guilty to all three counts against her. Alexander will get credit for the 1,030 days she's already spent in jail...

Because the second count against Alexander is considered an 'open plea,' she could still be sentenced to five years in prison at the hearing on Jan. 27.
