Thank goodness the video shows EVERYTHING. It shows that the attack was brutal, and that D was in a very dangerously vulnerable position.
The video clearly shows a gun nut accosting a mother and child while they waited in the car.

Then it shows a dad coming to the rescue to save his family from an unknown lunatic that could be there to cause harm since he was very irate against mother and child.

That's what it shows. A man trying to save his family from a possible threat. Jmo

Not in the video I saw. I saw a man talking to someone in the car, the man wasn't acting violent or aggressive. Like I said before thank goodness it's on video.

I think that it can be reasonably assumed that MM did not feel threatened, but he may have felt his family was being threatened. And I would question the use of coward here, MD felt very safe screaming (not talking) to a woman and children with his hand on his waistband where his gun was. And I prefer neither of your examples of terminology. I prefer shoved. Which is what happened.
Luckily the video shows the truth and there is no evidence of D being angry, screaming, or threatening. The woman's police report states that she wasn't threatened or harassed. The only angry violent person was MM, and that is also clearly shown on the video.

So using the profanity f******g is just part of normal day to day speech?

What does that have to do with a man being attacked and having to defend himself? The video has no audio, so there is no proof of profanity, insults, or threats. Actually the woman said there were no threats. That said, there is no law allowing you to attack people for using profanity. Freedom of Speech.

Freedom of speech means that the government cannot restrict your speech against them. In other instances you suffer the consequences for saying whatever you like. Witnesses said that he used profanity. I would feel threatened if a total strange yelled at me with a profanity. I am not sure why you would not.

It also seems to me that if you want to protect yourself, you need to use a gun to do it, pushing someone away from your family is not protecting them. Only shooting will do, except if you are ...........

They are supposedly passing it up the chain since they really don't want to book the guy for anything at all. So it may take a while.

They didn't even polygraph the guy to see if he was actually looking to provoke a confrontation.

Better yet. They didn't even write the guy a ticket for not making it known that he had a firearm and planned to use it.

Because he definitely had time to say keep backing up before I shoot you.

Or he could have fired a warning shot.

Btw. A psych evaluation should be mandatory after every syg killing.

Because we all know that there are plenty of registered gun owners that are nut cases that should have not been able to own a gun in the 1st place . Jmo

So for example. A schizophrenic person really shouldn't be able to have a permit to carry arms.

But the local LE didn't even investigate basic things to see if the guy was mentally fit for that right after the shooting.

Especially since the video wouldn't tell you if this gun carrier has been suffering from mental illness for years.

So the syg law is very loose and LE should have requested some testing before just simply clearing the guy. Jmo

No, you cannot physically assault and injure someone for cursing. If you do, YOU will suffer the consequences of either a day in court or from someone with a CCW. The woman said she wasn't threatened, it's in the police report. No law was broken until MM brutally slammed D to the concrete.

That would be a violation of the right to privacy. Why would the person defending themselves be "mentally ill" and the person brutally attacking them not?

Polygraphs are not evidence, and you can't be forced to take one. When would he have told MM he had a gun? MM came up and slammed him from behind. Kind of hard to communicate in those circumstances. Show me on the video exactly what time is there to tell MM he had a gun.

Not every person who criminally attacks another person dies in the process. In fact, the victim is more likely to die than the attacker.

The thing is, speech is not against the law, assault is. I'm sure profanity is not a justification for assault.

It's a fantasy many people have. Did you ever see A Christmas Story? There are grown men who see themselves as Ralphie, using their Red Rider BB rifles to save everyone from the bad guys.
