The person who is most injured here is a child who witnessed his father, who has a criminal record including domestic violence (probably against his mother) in addition to other criminal behavior including but not limited to assault, push an older man to the ground, and then get shot. M was shot in the chest, therefore it is IMPOSSIBLE for him to not be still facing the person he physically assaulted first.
The young child who had to witness this event will be scared for life no doubt.
I will also say, others on this thread have thrown in there how they're in their 40s as well and can fight back, well you don't know the physical health of the person who was asking the woman why she parked in a handicapped spot. She did not have a handicapped placard and she didn't belong parking there for "even a minute" it's illegal to park there.
You have no way to determine how the interaction was between the shooter and the driver, there is NO audio on the video, so it's a "he said, she said."

What is most telling, Rayner said, is that, according to Jacobs, who put pressure on the wound after the shooting, McGlockton was shot in the left side of the abdomen. That’s contrary to a widely reported detail from the Sheriff’s Office that the bullet struck him in the chest.

"If he was advancing and getting ready to do more harm to Mr. Drejka, why was he shot on his side when he was getting ready to turn around?" Rayner said.

The Medical Examiner’s Office has not released an autopsy to the family, she later added. A Sheriff’s Office spokesman declined to comment on the family’s allegation, referring a reporter back to a news conference in which Gualtieri said the man was hit in the chest.

IMO.... if MM had used words to defend his girlfriend instead of his hands....the outcome would have still been him getting shot. D had a prior history of harassing customers in the parking lot and threatening at least one person with his gun.

The entire story isn't out yet. However, you can just see the man in the video and tell he is no match for MM. He harassed nobody. Can you link the law that forbids you from telling an insensitive person to not park in a handicapped slot? I can show you a law where you cannot assault another human being.

The video shows McGlockton backing away when Drejka draws his gun. Even assuming that McGlockton was not done with Drejka after the shove, Gualtieri conceded that Drejka “probably could have” fended McGlockton off simply by brandishing the pistol. The implication is that Drejka did not reasonably believe shooting McGlockton was necessary, which means there was probable cause to arrest him.

Markeis engaged in unlawful conduct himself. Markeis should not have gone up and slammed this guy to the ground. Markeis wouldn’t be dead if Markeis didn’t slam this guy to the ground. So Markeis has got skin in this game, too. And the reason why it makes it justified, and within the framework of ‘Stand Your Ground’, is because of what Markeis did.

It’s sad. It’s really sad. And again, we can have a discussion about what we would’ve done, or what the law would be, or what we would’ve done prior to ‘Stand Your Ground’ or prior to even the change that puts the burden on the state, and makes it a clear and convincing evidence standard. We can have those hypothetical conversations all day long. But I don’t live in a hypothetical world. I live in a world of, what’s the law, what are the facts, and how are we gonna apply it as directed.

I'll start by saying this before we go through the facts of this. I'm a big believer in this adage that just because you can, doesn't mean you should. This case may be an example of that. Nonetheless, we don't build it, we just sail it. What I mean by that is: I don't make the law, I enforce the law.

And I have to apply the facts of every situation to the law, as the legislature has passed it, and as the governor has signed bills enacting it. And the law in the state of Florida today is that people have a right to stand their ground, and have a right to defend themselves, when they believe that they are in harm. So we’ll talk more about that. But that’s against the backdrop that this situation has to be evaluated, and has to be considered.

So, at about 3:30 yesterday afternoon [July 19, 2018], Pinellas County Sheriff’s Office responded to the Circle A convenience store at 1201 Sunset Point Road in Clearwater. What we know from the investigation is that Markeis McGlockton, who’s a 28-year-old African-American male, had arrived at the store with his girlfriend Britany Jacobs. Britany parked their car in a handicapped spot by the store. Markeis and his son, who’s 5 years old, went into the store.

Another person by the name of Michael Drejka, who’s 47 years old, white male, arrived at the store. He lives in the area, and was a frequent customer of the store. And somebody who others have said complained about people parking in the handicap spots. And he had an issue with people who illegally parked in handicapped spots at that store. So apparently, Drejka gets out of his car, and is checking around Jacob's car, and looking for handicapped decals or permits or anything that would authorize them to park where they did.

When he didn’t see that, he confronted Jacobs, and by all accounts, they got into a pretty significant yelling match. And there was no physical violence, there was no threats, but it was a disturbance. They were yelling at each other, and he was complaining about her parking in the handicapped spot.

So Drejka got out of his car and started harassing Jacobs. Wow! I would come to my wife's defense if some lunatic did that. wow! Completely ridiculous that Markeis lost his life over this and Drejka isnt in jail. They are stretching the definition of SYG law <modsnip>.

I can see it in the video. Just look at it. He can't have a taste for harassment or threatening because HE QUALIFIED FOR CCW . If he had threatened or harassed anyone, that permit would have been yanked. You have to be squeaky clean to get a CCW permit. You have to remain squeaky clean to keep it. People don't have the right to physically assault anyone even if they are telling them some unpleasant truths about themselves. By that yardstick, if a woman upsets a man, he has every right to beat her up and she can't defend herself. It doesn't work that way.
