"Montalvo's estranged husband Cristopher Otera Rivera was arrested on a probation violation.
His father was also arrested. Angel Luis Rivera was arrested on violation of another felony charge". [BBM]

So, if i'm reading correctly, they've been arrested for previous arrests, charges but not for Nicole correct? From prior experiences this is just the beginning, buys time so they can make their cases. IMO

Yes unrelated to her being missing and they haven’t announced the ID of the remains yet but even with rapid dna I think tomorrow -considering they were so bad they couldn’t tell if it was male or female

The Sheriff's Office said it has been talking to Montalvo's husband, but said he is being uncooperative. According to court documents from a year ago, Montalvo called deputies reporting her estranged husband and another person took her to a secluded area, where Montalvo said he slapped her across the face several times because he didn't like her texting a friend and taking his son.
The document also said he threw her to the ground and attempted to break her neck, and said if she called police she would be killed.
Earlier this month, Montalvo sent a handwritten letter to a judge asking for the order of protection she had against him be dropped because it would be best for her son.

Things to note - MSM should be taught about this:

With this sort of violent attack - which was attempted murder -- three things should happen if we are ever going to see LESS of these killings:

1) Abuser/attacker should lose right to visitation immediately, and until they are proven to be no threat to the victim and/or children

2) The judge should NOT be allowed to drop an order of protection at the request of the victim - because that request is often forced by the abuser - unless the victim is proven to be out of danger (in some states, they already cannot drop it at the request of the victim until the OoP time is up, or the abuser has had counseling, drug screenings, etc.)

3) MSM needs to be trained to not make the following misleading, abuser-avoidant statements: "Court records show a turbulent history between the couple," "there is a history of domestic abuse between the couple."

MSM NEEDS TO BE HONEST AND STATE THAT THE ABUSER IS AN ABUSER. Period. Not "the couple had problems..."

This isn't clickbait, it's people's lives at stake.

Yes and I also think there needs to be some type of oversight for child exchanges when there is a history of violence - I’m sure she felt comfortable since his parents owned the property - but if she could have met somewhere like the police station to exchange custody- would that have saved her? Many police stations have set up safe exchange places for online sales /pick up - are kids not as important ? This just makes me so angry

Agreed. Some (not sure how many) states have guarded supervised visitation centers - to keep both the victim/parent safe, and the kids safe.

It seems to me that if an abuser tries to kill the other parent, that abuser should lose rights to visitation entirely - at least until they've had counseling AND anger management courses, as well as substance abuse checks and weapon removal. That would cut down on abuse, in general, and why not err on the side of caution?
If not, then visitation automatically should be supervised, at the cost of the errant parent (they usually have to pay the center and the supervisor, and sometimes travel if the supervisor is outside a center).

If a parent is trying to kill the other parent, how are the kids safe to be alone with that parent?

I was looking through the FB posts of COR and saw references to NY and someone asking if he was going back. Has anyone found any information about how long this family has been in FL and if they did in fact come from NY? I have been trying to find the arrest affadavits for father and son and cannot find them. Do the press have to file FOIA docs to get the arrest info or do FL officials release the docs in due course?

The property was purchased in 2000 they’ve been here a long time as it hasn’t changed hands (source is Osceola county comptroller- property appraiser ties into the deeds by way of address) i think the clerk of court does not routinely post the search/arrest warrants I’ve asked what the status is but it’s not released yet - I hope it will be but I think they will wait until the remains are identified - I’m wondering if the father ran the backhoe ? And why can’t they distinguish male or female ? What was done to her because I do think it’s her else is this some kind of killing field ? They’ve been there a long time

Ugh another sad DV case. These cases make me so angry because when you look back and see all the steps that maybe could have helped prevent this, it infuriates me. I can't even believe the judge allowed the child exchanges to happen at their houses with his history of violence. There seems to be a significant amount of cases like this is the media.

I will say LE swooped in on this quickly, and thank goodness for that. At least her family can get some closure, unlike some other cases where the body was never found.

I am a nonviolent person. I am against the DP on a theoretical basis. I don't believe in mass incarceration. But nothing, NOTHING, the US prison system could throw at this guy, including the DP, would be enough to punish him for what he [allegedly] did. He deserves so much worse. That goes for all domestic abuse murderers. Just pure evil. Remove them from the gene pool.

JMO IMO.

Ugh, exactly what went through my mind. If they can't even tell the sex (in this shortish amount of time) - it's gruesome. Or, they just found the 'tip of the graveyard' and haven't found HER yet... but know they will.

There have been other cases where they went to find someone in a farm/field, and found several bodies... in one case they actually found a young woman ALIVE in a metal bin of some sort, though they had found many other bones/bodies in the same area. The difference is, unfortunately, that was a stranger abuse kidnapping case. The results are much worse with a DV/marital case, unfortunately. :(

If a parent is trying to kill the other parent, how are the kids safe to be alone with that parent?

I'm kind of thinking if an abuser tries to kill the other parent, the abuser should be serving a long sentence for attempted murder. I agree - how are the kids safe to be alone with that parent? Makes zero sense to me.

@oviedo, I've not seen a case recently where it wasn't possible to determine male/female. But didn't they have this issue in the Las Vegas case where the remains were burned and so it took a lot of forensic work to determine who the bones were? I didn't follow that case closely but do recall reading something about the impact of burning on bones. Did you follow that case? MOO

Even with Mackenzie lueck the burning didn’t destroy the body when they found her in the desert - after what was done to Kelsey Berreth and Jennifer farber (Dulos) I’m not putting anything past them at this point - JMO

Interesting WFTV- sheriff is asking for surveillance from the area where her car was found and the sheriff will not release any details about the felony charge for the dad or the probation violation (I think) for the son - they too are reporting the search is continuing on the 5 acre property
