I'm beyond angry at the state of FL giving him a plea deal for last year's kidnapping and attempt on her life. Those words "declined to prosecute" sting my ears. I can not imagine the living he__ Nicole and her family have been through the past year.

However, I do agree Osceola SO handled this with extreme speed and thoroughness. Unfortunately, those actions were too late to save her and probably would have been too late within the first few hours of her missing. :( MOO

As a semi insider to this case, the victim was just as surprised of his "house arrest" as anyone. Lived in fear, worse case scenario all around. RIP, Her friend that im in contact with actually is the organizer of the vigil tonight. So proud of her, while being distraught, to do this and share the info she shared with me to LE. I hope this serves as a deterrent for light sentences or access/availability of victims and their assailants..

While I understand the anger towards the prosecutor and the way the charges were dropped, people seem to forget that the law works with what evidence they have. There must be a reason why the charges didn't go through. Maybe she refused to testify, maybe there was conflicting stories. Also please remember that charges can be made up by the other person. Not saying that is what happened here. Just trying to show the other side. The prosecutors can only do so much with whatever evidence they have. It's not whether the person did the crime, it's what can be proven beyond a shadow of a doubt. At times deals are made, in order to "punish" the offender, opposed to them walking free.

It is always wise to argue both sides of an argument to see the truth, In this case however a little bit of both might have been at work. The pressure of trying to please an only child by waiving some right might have been a factor. But also the leniency after a brutal, (ive seen the hospital photo's), attack coupled with ankle moniterization that was non effective, and the victim's clear and expressed fear of him getting out, gave this Convicted felon access to his prior victim and we are all living with the results

I had a hard time understanding the logic when I first started on WS, why don't people report, why don't they follow up etc. After 1000's of cases i've come to the conclusion that most of us are guilty of. Trying to balance a normal life in real time. Trying to balance youre loved ones happiness with your own. And you compromise and take risks to please and not rock the boat. Us as advocates, Websleuthers, Americans, looking at this as a third party need to fill the gap and speak common sense to these loopholes. Im all for evidence, im all shadow of the doubt reasoning. However, specifically in this case there needs to be a statute that prohibits criminals found guilty of violent crime from being near the victim regardless. We do this for sex offenders to a degree, there might be deals but this needs to be non negotiable if convicted in a court of law. Regardless of custody, regardless of time served.. just speaking for me ofcourse.. thanks for your input Ms. X

The Osceola County Sheriff's Office has updated the charges for both Otero-Rivera and Rivera. They are now both charged with premeditated murder.

LOVE this Sheriff - he is NO NONSENSE!

Henry j drive may also be 3921 Hixon - it’s owned by another family member as reported earlier - so if there are more remains are they hers or someone else ??? We know his parents both lived at the first place - wonder who else is unaccounted for ?

ETA Henry J is a different location and is not the same as the Hixon address where the remains were found - but odd that remains are found on henry too

The son is still unaccounted for, as far as I'm concerned, as they've said nothing about him.

I'm hoping a reporter will ask the prosecutor these questions - from MSM articles, LE provided ample evidence IMO - so let's hear what the prosecutor has to say now. I'm betting there will be silence... JMO

Has the name of the Prosecutor been found? I've been searching for the case records and have been unsuccessful.

I did read that the STBX was not to have been communicating with victim except via an online parenting app but that he clearly violated this order.

I have been trying to find out more about who within LE/Court System is responsible for monitoring compliance as non compliance with such a basic issue IMO should have been an immediate red flag. I have also been looking for information about monitoring bracelets for the at home arrest and could find nothing.

I very much hope the Press takes a look at these and other issues as the system and victims of DV place reliance on compliance with these various tools but they are rendered useless IMO without a means of monitoring and immediate punishment for non compliance.

Listening to the Sheriff speak about the latest findings at the second property I have to say that IMO his commitment to justice here for the victim is impressive.

Sadly so many missing cases I have seen actually speak about the goal of getting justice for the victim. The victim and their rights seem to somehow get lost in the narrative of the case.

This Sheriff isn't afraid of talking about justice for Nicole and I very much appreciate that as do Nicole's son, family and friends.

Then, she said Otero-Rivera climbed on top of her while Rocker tried to stuff a piece of cloth in her mouth.

She also indicated that Otero-Rivera had in the past been hospitalized under Florida’s Baker Act, which allows the involuntary commitment of people believed to be a danger to themselves or others."

Not surprisingly Toni Rocker was scooped up on 10/24 by LE (believe it was day prior to dad/son perps being scooped up). I am struggling to understand the bond amts in some of these alleged crimes. But it appears Toni Rocker is being held on $0 bond/or perhaps No Bond? IDK. Not sure how to read their bond info.

Do we know what business (legit or otherwise) these 2 were involved in?

I am not finding a business under COR's name however there are a couple of businesses under ALR's name. The fact that ALR's name is considered a common name, I want to research more and confirm whether the businesses I found do in fact belong to him. It is in the Orlando area, so chances are high.
