Sheriff: Possible human remains found on property where missing St. Cloud mother last seen

OSCEOLA COUNTY, Fla. - The Osceola Sheriff's Office said Sunday that the human remains found Friday have been identified as Nicole Montalvo.

On Sunday, Osceola and Orange County deputies began to search a second location for a missing St. Cloud woman.

Deputies said the new location is an overgrown lot on Henry J Avenue. It is about a block away from the property where Nicole Montalvo was last seen.

Osceola deputies said Friday evening that an estranged husband of Montalvo and his father have been named persons of interest in her disappearance.

Deputies said Montalvo's estranged husband, Christopher Otero-Rivera, and his father, Angel Luis Rivera, have been arrested on charges unrelated to Montalvo's disappearance.

Maj. Jacob Ruiz, of the Osceola County Sheriff's Office, said Otero-Rivera was arrested for violation of probation and violation of domestic injunction, and his father, Rivera, was arrested on violations of condition of a registered felon.

They were both transported to the Osceola County Jail.

Otero-Rivera went before a judge Saturday morning but was told to come back Sunday because a warrant for his arrest was not available.

On Sunday, the judge issued a $25,000 bail for violation of domestic injunction and no bail for violation of probation. Rivera did not appear before a judge because he is in a hospital for chest pains and shortness of breath.

Osceola County Sheriff Russ Gibson said Friday afternoon that possible human remains had been found on a five-acre property where Montalvo was last seen.

The remains were discovered along Hixon Avenue near Deer Run and Canoe Creek roads, not far from St. Cloud, Gibson said.

Investigators said they are unsure if the remains are those of a man or a woman.

They said the medical examiner's office will conduct an autopsy on the possible remains.

Human remains found Friday at a St. Cloud property were identified Sunday as missing woman Nicole Montalvo, according to Osceola County Sheriff Russ Gibson.

The 35-year-old mother was supposed to pick up her son from school Tuesday but never showed up, the sheriff’s office said.

Investigators found Montalvo’s body at a property, in the 3900 block of Hixon Avenue, owned by the parents of her estranged husband Christopher Otero-Rivera, where she was last seen.

Otero-Rivera and his father Angel Luis Rivera were arrested Friday on unrelated charges but were each charged Sunday evening with premeditated murder, according to Osceola County Jail records.

Montalvo and Otero-Rivera were in the process of separating at the time of her disappearance, the sheriff’s office said.

In October 2018, she accused him of beating and kidnapping her, as well as stealing her cash and credit cards, court records show.

Otero-Rivera took a plea deal where he did not contest the charges of battery, tampering with a witness and unlawful possession of stolen cards. He was sentenced to probation and nearly a year in Osceola County Jail with credit for time served. He was also not supposed to have contact with Montalvo except through a parent communication app.

ST. CLOUD, Fla. — The human remains recovered from the yard of a St. Cloud home are of Nicole Montalvo, who had stopped by there Monday night to drop off her son and hadn't been seen since, the Osceola County Sheriff said Sunday.

The investigation into the disappearance of Montalvo now has turned from a missing person's case to a murder investigation, Sheriff Russ Gibson said during a brief news conference.

Montalvo's estranged husband, Christopher Otero-Rivera, and his father, Angel Rivera, were arrested Friday night on charges unrelated to the Montalvo case. At the time, Sheriff's officials called them persons of interest.

By Sunday afternoon, a charge of premeditated murder had been brought against both Otero-Rivera and Rivera.

During a second brief news conference later that night, Gibson said a warrant search at a second home on Henry J Avenue turned up more human remains. That home was also owned by the Rivera family, Gibson said. Based on that and other evidence, detectives established probable cause to charge Otero-Rivera and Rivera with first-degree murder.

The arrest of Christopher Otera Rivera comes hours after possible human remains were found Friday during a search for the missing mother at a home near St. Cloud, Osceola County Sheriff Russ Gibson said.

It's not known, however, if the remains are those of Nicole Montalvo, the 33-year-old St. Cloud mother who was reported missing after failing to pick up her 8-year-old son from school earlier this week.

"We uncovered what looks like the possible remains of a human being," said Gibson, who added that it's not been determined if the body is that of a male or female.

At sunrise, more than a dozen investigators with the Osceola County Sheriff's Office arrived at the Hixon Avenue home of Montalvo's estranged husband and his parents.

Gibson said the discovery was made in the rear of the property. Detectives were focusing on an area behind a garage and near a tree line on the 5-acre property.

Investigators brought in generator-powered lights overnight Thursday to help in their search for Montalvo, who was last seen Monday afternoon when she dropped off her son at the home.

Ruiz said Montalvo's cellphone has been turned off and her car was found abandoned 8 miles away on Big Sky Boulevard.

"She disappeared out of the blue here on Monday night. (There's) no trace of any communication with anybody," Ruiz said. "She didn’t go to (Harmony School) the next day to pick up her son. That’s completely out of character for her."

Montalvo's father, Ed Montalvo, posted a message Thursday night on Facebook, saying, "I would at this time like to thank everyone for their support and prayers. We still are of the mindset that she will be found safe. Again thank you!!"

Deputies said Thursday that Nicole Montalvo was last seen around 5 p.m. Monday when she dropped off her 8-year-old son with his father and grandparents at their home on Hixon Avenue in St. Cloud.

Montalvo was supposed to pick up her son at Harmony School on Tuesday, but she never showed up, according to deputies.

Officials said Montalvo's cellphone has been turned off and she hasn't had a "trace of communication with anybody" since Monday, according to Osceola County sheriff's Maj. Jacob Ruiz.

Ruiz said Montalvo's disappearance is 100% out of character for her, and investigators are concerned about her well-being.

Ruiz said investigators are talking to anyone who had a relationship with her, including her estranged husband, who lives at the property where she was last seen. Ruiz said they have a history of domestic violence.

Montalvo's estranged husband is not cooperating with the investigators, but he is not in custody, according to Ruiz.

Investigators are asking to speak with anyone who had contact with Montalvo in the last week.

Ruiz also said that a rumor about a body being found on Hixon Avenue is not true. He said decomposed remains were found Wednesday on U.S. 192 near a homeless camp, but the case is not believed to be connected to Montalvo's disappearance.

A large law enforcement presence was searching around the 3921 Hixon Ave. home all day Thursday. Crime scene investigators were seen walking behind a detached garage on the property with shovels.

Piles of dirt could be seen near the home where Montalvo was last seen dropping off her son Monday.

Neighbor Gary Paul lives near the Hixon Avenue home and said he has seen people digging using a bulldozer on the property. He mentioned that when detectives were casing the area.

"They do quite a bite of garbage burning, which isn't too unusual in this area, but like I said, the bulldozer was something that was definitely out of place," Paul said. "I've seen plenty of backhoes, but a bulldozer?"

Remains believed to be those of a human were found on Friday in the search for Nicole Montalvo. Montalvo was reported missing on Wednesday but was last seen on Monday when she dropped off her son with the child's father, Christopher Otero-Rivera, around 5 p.m. Deputies on Friday were searching the property of a St. Cloud home on Hixon Ave. belonging to Otero-Rivera's parents.

Otero-Rivera and his father, Angel Luis Rivera, were both arrested on Friday afternoon on unrelated charges as authorities are now saying they are an integral part of the investigation into Montalvo's disappearance.

"Christopher Otero-Rivera has been arrested for violation of probation and the father, Angel Luis Rivera, has been arrested on charges related to being a registered felon," explained Major Jacob Ruiz with the Osceola County Sheriff's Office. "They are persons of interest, based on the discovery at the scene."

Estranged Husband of Missing Mom Named Person of Interest in Disappearance

The estranged husband of missing Osceola woman Nicole Montalvo has been named a person of interest in her disappearance, according to the Osceola County Sheriff's Offce.

The search continues Saturday morning. K-9 teams were brought out to the area. Deputies say the search will take some time.

“We need to continue searching," said Major Jacob Ruiz with Osceola County Sheriff's Office. "It's a 5-acre lot, it's a big property with a lot of different buildings and vehicles, some wooded area, lake, so it's an extensive search that's gonna take some time.”

According to an Osceola County Sheriff's Office affidavit dated October 4, 2018, Otero-Rivera and a woman were accused of attacking Montalvo.

Multiple felony charges were filed, but according to court documents, the state declined to prosecute the more serious charges of kidnapping with intent to inflict bodily harm and robbery during a plea deal. The judge withheld adjudication on Otero-Rivera for the charges of tampering with a witness to hinder communication to law enforcement, unlawful possession of a stolen debit card, and battery.

“Our detectives will be in contact and interviewing anybody that we believe has any connection with the disappearance of Nicole, what we are finding here at the scene, and anything involving that, and we can't lose sight that this is missing person investigation,” said Major Jacob Ruiz with the Osceola County Sheriff’s Office.

ST. CLOUD, Fla. — A Florida mom who vanished after dropping off her 8-year-old son with his dad and grandparents has been found dead.

Nicole Montalvo was supposed to pick up her child from Harmony Community School on Oct. 22 in St. Cloud. But, she never showed up, and her cell phone was turned off.

On Sunday, Osceola County Sheriff Russ Gibson confirmed human remains found last week on Hixon Avenue belong to Montalvo.

Montalvo's brother, Steven Montalvo, posted a message on Facebook, saying, "Our family is in constant contact with the authorities and working closely with them to try (to) find her and ensure her safety. This is our only concern at this stage."

Detectives with the Osceola County Sheriff’s Office were investigating the disappearance of Montalvo, who was last seen on Oct. 21 dropping off her son with his grandparents and father at an address on Hixon Avenue in St. Cloud. She was supposed to pick her son up from Harmony School on Oct. 22, but never arrived and her cell phone was turned off.

Records said Montalvo called deputies last year to report that her estranged husband and another person took her to a secluded area, where he slapped her across the face several times because he didn't like her texting a friend and taking his son.

The documents said he threw her to the ground and attempted to break her neck, saying she would be killed if she called 911.

Earlier this month, Montalvo sent a handwritten letter to a judge asking that a protection order she had against her husband be dropped because it would be best for her son.
