Jorge Barahona Makes Rare Appearance in Miami Courtroom

The man at the center of a child abuse case that drew widespread headlines made a rare appearance Thursday. For the first time in five years, Jorge Barahona stepped inside a courtroom.

Barahona, 48, listened to his lawyer and the prosecutor discuss combining the case against him in Palm Beach County with the charges against him in Miami-Dade County.

[...]

Authorities in Palm Beach County charged Barahona with attempted murder, Miami-Dade prosecutors charged him with the murder of Nubia and child abuse.

Barahona's next court date is scheduled for August. Meanwhile, Carmen Barahona faces a murder charge in Miami-Dade.

Right, now, once again, no trial date has been set at this time.

How many years has it been since Nubia was murdered? Since 2011. Over 5 years. Why is this taking so long? Does the state want Barahona to take a plea? This is insanity, that this is strung out so long...

I still remember this horrific case. I probably will til the day I die. WHY has this not going to trial already for heaven's sake???

  • #464
I believe that it is a cover up. The state of Florida wants to keep their CPS files top secret. They want Barahona to take a plea, in exchange for death penalty. He won't take a plea deal offerred. Look, he got his wish for trial in Miami, moved from West Palm Beach.

With case moved to Miami, why Barahona in West Palm court a puzzle

Friday, July 15, 2016

Like the attorneys in the courtroom, Palm Beach County Circuit Judge Samantha Schosberg Feuer wasn’t sure why the Miami man accused of brutally killing his 10-year-old adopted daughter and abusing her twin brother to near-death in 2011 was back in the courtroom Friday morning.

It wasn’t just that two months ago she agreed that Jorge Barahona’s child abuse charges should be consolidated with his first-degree murder charges down Miami, meaning he would be tried in Miami-Dade County Circuit Court. She also was surprised to see the 49-year-old man in her courtroom because it had been difficult enough to get him transported from Miami when his case actually was set in West Palm Beach.

[...]

But on May 9 Feuer ordered the charges to be tried with the murder charge in Miami, and Friday’s status check hearing should have been canceled. Feuer said it must have been a clerk’s error that the hearing remained scheduled.

Barahona’s next court hearing is Aug. 4, according to Miami-Dade County clerk records. It’s unclear if a trial date has been set. Barahona’s wife, Carmen, is also facing murder and child abuse charges in Miami.

And on it goes...hearing after hearing...no trial date set. This is a slam dunk case. There is more going on here...like, the State of Florida wants this case buried forever.

I agree that justice for Nubia and her brother is long overdue, but this is a death penalty case with 20 charges. The state is hardly trying to bury this case. If you check the docket you will see all the movement on this case with depositions and motions (https://www2.miami-dadeclerk.com/cjis/mobile/CaseSearch.aspx). The fact that the 1st degree murder Miami case was going to be tried separately from the West Palm attempted murder case was definitely delaying things, but now that they're consolidated I would expect this to go to trial soon. I hope so anyway.

I think the death penalty is a ploy, to get Barahona to settle. They will take the death penalty off, for life or prison, with parole in 20.

This crime happened in 2011! A trial now, after all this time has passed is almost crazy. Who can remember where they were, what they did that many years ago?

Next, Barahona will file he should be free due to the fact he was denied a speedy trial!

Nothing is happening with this case! The state of Florida wants it buried. No justice for Nubia!

The ongoing death-penalty case against the Barahonas has yet to be scheduled for trial, but prosecutors believe the couple starved and tortured the twins for months or more — a charge bolstered by a new and disturbing statement from the couple’s own granddaughter, who told investigators that she was so terrified of her own family that she waited for years to tell her story.

That girl, identified as A.P. in the statement obtained by the Miami Herald, chronicled a tormented existence for the twins, who were among four adopted children living in the household, two boys and two girls.

The girl, who was about 6 years old at the time and a regular visitor to the Barahonas’ West Miami-Dade home, described a persistent pattern of psychological and physical abuse...

And again, why is this case taking so long to go to trial?! The daughter who knew about the abuse, should have been charged as well. A six year old was the one who had enough ethics to come forward. Shame on her Mother for exposing her child to this dysfunction. And telling her to keep secrets.

Six years. Six years since this little girl was beaten to death and thrown in the back of the truck like garbage and her brother was burned with acid and nearly died. Six years that the two adults in their lives that should have been taking car of them instead of abusing and torturing them have been sitting in jail - eating three meals a day, getting free medical and dental care and probably taking extended learning classes. Six years that we, as taxpayers, have been paying for the HUMANE living conditions of two people that treated their children anything but humanely. Six years while lawyers have futzed around and whined that they "need more time" to prepare their case. Really Florida? Really? This is how you treat the children in your care? They didn't get a fair shot from any of the people that were supposed to help, but everyone is breaking their own back bending over to make sure the monsters get a fair shake. I'd be so ashamed.

Florida Senate OKs $3.75M For Barahona Boy Found Doused In Chemicals

Florida lawmakers have approved a plan to pay $3.75 million to a boy involved in a case that rocked the state’s child-welfare system in 2011.

The money is part of a $5 million settlement in the death of 10-year-old Nubia Barahona and the injuries suffered by her twin brother, Victor.

[...]

The Department of Children and Families was alleged to have failed to prevent abuse of the children and agreed to a settlement that called for paying $5 million. It paid $1.25 million but needed legislative approval of “claim” bill to pay the remaining $3.75 million. The Senate unanimously passed the bill Tuesday to pay Victory the rest of the settlement.

I bet that the kid hardly sees any of it. Meanwhile, his abuser has yet to had a trial, or sentence in his abuse, or murder of his sister.

  • #476
I'd seen this case in the headlines over the years but never followed it here - until today. Truly evil, these two "parents". I'm stunned a trial still hasn't happened but I'm also undecided on how I feel about the grand daughter and Victor both possibly testifying? I mean... they've had 6 years of recovery and hopefully intense therapy, but they're still so young and I can't imagine what it might be like for them to have to see these people again. :(

Florida’s payout for abuse of Barahona children: $5 million

May 5, 2017

[...]

In a bill headed for Gov. Rick Scott’s desk, the Florida Legislature agreed to pay now 16-year-old Victor Barahona and his younger brother and sister $3.75 million for enduring unimaginable horrors while living with their adoptive parents Jorge and Carmen Barahona in a deceptively well-kept house in western Miami-Dade County.

Having already paid $1.25 million to the children, the bill that Scott is expected to sign means state taxpayers will pay $5 million in reparations for what has been called one of the worst cases of child abuse in Florida history.

[...]

Both Carmen and Jorge Barahona face the death penalty in Miami-Dade County in connection with Nubia’s death. Each also faces multiple charges of child abuse.

While Jorge Barahona, 49, was initially accused of attempted murder in Palm Beach County Circuit Court for dousing Victor with deadly chemicals he used in his pest control business, the case last year was moved to Miami-Dade County. The charge was added to the 19 he already faced there.

Attorneys for both Carmen, 66, and Jorge are to appear in court on June 1 to give a judge an update on the status of their cases. No trial date has been set. It is unclear whether the two will be tried together.

[...]

A spokeswoman for the Miami-Dade State Attorney’s Office offered no specific reason as to why the cases haven’t gone to trial. However, she said, such delays aren’t unusual when the death penalty is in play. For instance, court records show Jorge Barahona’s attorney has been given permission to travel to his client’s native Nicaragua to gather information that would be used in the death penalty phase of the trial. Other atypical motions pepper both files.

Gov. Rick Scott signs bill giving $3.75 million to Barahona children

May 24, 2017

Putting a hopeful coda on a horrific story that ended in 2011 with the discovery of the decomposing body of a 10-year-old girl in a truck along I-95 near Palm Beach Lakes Boulevard, Gov. Rick Scott on Tuesday signed a bill giving Victor Barahona and his adopted siblings $3.75 million to rebuild their lives.

[...]

The largest share of the money goes to now 16-year-old Victor. He had been doused with acid and was near death when he was discovered on Valentine’s Day 2011 near Nubia’s body in Jorge Barahona’s pest control truck. Like his other surviving siblings, Victor has been adopted by other parents, according to attorneys who represented them in lawsuits that prompted the state’s action.

I am not buying the excuses for the delays in this case, "It is a "DEATH PENALTY". There have been plenty of other death penalty cases, that did not drag on for years.

The crime occurred in February 2011.

The Boston Bomber killed people in 2013, and his trial date was 2015.

Dylan Roof, killed 9 people in 2015,his trial was in 2017. Death penalty case.

This is beyond outrageous. Either a little girl's life is meaningless, or the State of Florida wants this case buried.

If nothing else, at least try Barahona in trial for attempted murder of Victor.
