2/23/16: For 3rd time found incompetent to stand trial. Return for status hearing on 10/18/16.
1/11/17: Found competent to stand trial. Competency hearing on 3/27/17.
3/27/17: Will remain in state hospital until trial. Trial scheduled for Feb., 2018.

9/24/18: Defense going with not guilty by reason of insanity. They are scheduled to question Ryan Wagoner, a forensic psychiatrist and University of South Florida assistant professor (for defense) under oath on Oct. 8. The next step is a hearing, set for Dec. 17 and Dec. 19, to argue over whether psychiatrist Emily Lazarou’s testimony should be allowed. New trial date is 3/18/19.

Coincidentally, I think I remember just coming across Emily’s name researching while Family Annihilators in the Watt’s case:

“That same year, she testified that Edward Covington — a man accused of killing his girlfriend, her two children and their dog in Lutz in a brutal crime that shocked even Hillsborough County’s veteran sheriff — was a psychopath but not legally insane.“

“Lazarou’s full report on Jonchuck is not available in the court file. But the defense, in its motion to exclude the psychiatrist, quoted from her analysis.
"I do not believe that Mr. Jonchuck meets the insanity criteria," she wrote, according to the motion. Lazarou said Jonchuck was "malingering," or exaggerating his ailment to beat the case.
"I believe that John knew exactly what he was doing," she wrote. "I believe that it was premeditated and the purpose of this senseless, horrific crime was to punish those he perceived to have loved Phoebe over him."
Court records show she has been paid more than $22,000 for her work on the case. The defense said she evaluated Jonchuck over two days in October 2017 and May of this year. She did not return a call or email requesting comment.”

John Jonchuck will go to trial soon, but first lawyers will fight over an expert witness

Judge rules expert witnesses should be questioned again in John Jonchuck case
Attorneys will re-depose their sanity experts.

"CLEARWATER, Fla. -- A judge on Tuesday ruled the state will get a second chance to obtain the testimony of expert witnesses in the case against the man accused of throwing his 5-year-old daughter off the Dick Misener Bridge in front of a St. Petersburg police officer.

Prosecutors will be allowed to re-question defense experts, and the defense team will get to re-question state experts regarding John Jonchuck's sanity.

The change comes after his defense lawyers provided prosecutors with previously-unreleased emails Jonchuck allegedly sent to family attorney Genevieve Torres before the homicide. The judge rules those emails could theoretically change how the experts view the case. So, they will be deposed again.

Jonchuck was not there.

In September, a new trial date was set for him. The trial is scheduled to begin on March 18, 2019....

In September, Jonchuck's defense team filed a last-minute motion to exclude a crucial expert witness for the state, who is expected to testify that Jonchuck wasn't insane.

Additional hearings are scheduled for Dec. 17 and Dec. 19 for the motion to exclude the expert witness's testimony."

This creature threw his five year old daughter off of a bridge. Alive.

I am not a proponent of capital punishment. However, this crime deserves the death penalty. IMHO he does not deserve to breathe the air of 'freedom' any longer.

RIP little one. I pray your terror was as short as can be.

Will prosecutors lose a key witness in the John Jonchuck case? Defense attorneys say they should.

The lawyers will not debate whether John Jonchuck dropped his 5-year-old daughter off a bridge.

When the 29-year-old goes to trial on a first-degree murder charge more than four years after Phoebe’s death, his defense team will argue he cannot be convicted because he was insane when he killed her.

The case will hinge on the testimony of five doctors, who will offer conflicting opinions about what went through Jonchuck’s mind when he let go of his child. Jurors, most likely with no advanced medical training, will choose who they believe more.

Public defenders and prosecutors will spar over Lazarou during a two-day hearing later this month. She is one of two doctors the prosecution plans to lean on to argue Jonchuck was not insane when he killed Phoebe, compared to three in opposition for the defense.

Defense lawyers who have encountered Lazarou say she is flippant and confrontational. She once called a defendant an “Asian Beavis and Butt-Head” and said another was not schizophrenic in part because he wore Gucci shoes.

Throughout her evaluation, Wagoner said, Lazarou spoke more than Jonchuck, correcting him and at times talking to him like he was her patient.

Wagoner told the lawyers he was so bothered by Lazarou’s second interview that he counted the lines she spoke in the transcript compared to Jonchuck. He found that she had talked three quarters of the time.

“Anyone who speaks for 75 (percent) of the interview is typically not conducting an interview where they want information,” Wagoner told prosecutors.

John Jonchuck says 'voices' drove him to drop daughter from bridge

In the years since authorities say John Jonchuck dropped his 5-year-old daughter into Tampa Bay from the top of a bridge, his perspective — of the night his daughter died and of the aftermath, as doctors treat him in a state mental hospital — has been missing from the public record.

For the first time, new court files reveal that Jonchuck, 29, told a doctor “voices” urged him to kill Phoebe.

“I was hearing voices saying that if me and Phoebe didn’t die, everybody was going to go to hell,” Jonchuck said, according to the records.

Pinellas judge: Controversial psychiatrist can testify in Jonchuck case
A jury will have the job of deciding whether to give weight to the opinions of Dr. Emily Lazarou, Circuit Judge Christine Helinger says.

A forensic psychiatrist who has been criticized for being “biased and coercive” in her evaluations of criminal defendants will remain as an expert witness in the case of John Jonchuck, who is accused of dropping his 5-year-old daughter off a bridge.

Over vocal objections from defense attorneys, Pinellas-Pasco Circuit Judge Christine Helinger said Monday there was no need for a hearing on whether to boot Dr. Emily Lazarou from the case.

“What you’re suggesting is that she’s a horrible psychiatrist,” Helinger said. “That’s for a jury to determine.”

Helinger concluded the doctor is qualified to give opinion testimony, but suggested that the defense could challenge the admissibility of certain statements.

Jonchuck faces life in prison if found guilty of first-degree murder. His trial is set for March.
