Owens: it was a game. JT consented to get in the suitcase.

They were shown in court yesterday.
I saw them but has the state yet tried to connect the dots to how he was killed?

Now they're 2 drunks according to Owens when SB swore to detectives she wasn't drunk.

Owens is out of turn IMO. What he is pitporting could be considered mitigating factors FOR SENTENCING. It says nothing about her culpability in this matter.

Make it stop.

It sounds like he's struggling to defend her at this point.

“Were you planning to show him the video the next day?”

The next day?? Is she implying she planned to leave him overnight??

She's emotionless.
There is a diagnosis for people who lack emotions and kill .

Judge is taking a break to review case law, will return with a ruling momentarily.

Help.

If the overt act was his fingers coming out, and she successfully beat them back in, where was her new overt act?

She went upstairs because she was terrified? Terrified with what?

Jury deserves PopTarts after this.

JMO

This was SB's feeble attempt to set up how she was in "constant fear/danger" to allow an expert witness to support her claim a reasonable battered spouse felt her danger was perpetually imminent. Nope. Did not buy it in August, and not buying it in October. MOO

She's really shot her own defence in the foot eh?

Respectfully, if I could adjust that --

...people who lack normal emotions...

She has plenty of canned (practiced) emotions that she seems to dial up on demand.

I don't think there's a CORE self under all that feigning.

Lying under oath to set up the expert witness, wow, just wow.

LE gave her every opportunity at questioning to say she was in fear for her life.

She was not.

JT, however, was.

Owens is spewing how SB was in fear for her life when she went upstairs yet SB has said numerous times that she thought Jorge would follow her to the bedroom and kissy kissy or whatever.

So now according to Owens she leaves Jorge who she feared would hurt her in a suitcase that she said she believed he could get out of so he could come upstairs and harm her and not kissy kissy.

Owens is as way out of one's league here.

So... if the judge rules 'no overt act', can Owens keep trying?

Can't believe they're trying to pull this.

JT was the one who was falsely imprisoned, was trying to get out of the suitcase. Zero evidence he said or did anything to imply violence.

If she was so afraid, and also so sure he could get out, going to bed wasn't a smart move.

Alas, she's already explained she thought he could get out, she expected he would get out, never articulated any fear about that....

I don't envy the judge.

Wow, she’s asked “did you leave him enough room with the zipper?” (Paraphrase) and she says “Yes, until his hand…” then promptly shuts up. Did she zip him up all the way then?

I know when I’m afraid of someone, I antagonize the hell out on them and then leave him fully able to pursue me, and I’m relaxed enough to fall asleep.

Hope he tears her up in cross !
We need a Juan Martinez on her.

I think if he rules against the overt act, their case is pretty much done.

  • #818
Back on the record.

Court finds overt act is established.

I didn't expect that.

Judge rules "overt act" is present. So now Owens can continue with reputation evidence, previous conduct, and BSS. Sigh.

Overt Act has been established and approved according to judge
