I’ve wondered about that from when it was brought up in previous motions and I think it has to do with the defense of self-defense - what did JT do that evening that caused SB to fear for her life - goes back to imminent threat - but I thought the whole reason to bring in BSS was to demonstrate that a battered spouse often thinks of it as an ongoing imminent threat so I’m still struggling with the overt act part of it. But it seems for some reason the state thinks and also seems to be supported by the judge that if an overt act is not demonstrated then the defense cannot bring in the BSS experts. I’m behind too so I don’t know whether this has been addressed in her testimony yet or not.

Maybe someone who has been watching in real time could tell us if SB has said what that overt act was and whether or not the judge ruled on it

So you probably answered my question here: any known prior violent acts of SB towards JT will be inadmissible/unable to be raised on cross unless door accidentally opened by D on direct? That sucks big time given the casual and obvious lying capacity of SB and what that says about her credibility and integrity! Moo
Someone up thread posted that there had been times when SB was the aggressor but I don't know much else. What I do know is SB is drunk that refused to let go of JT, so there is that.

Did she want Brian to leave their son (age 7 at the time) home alone? He's a single dad and wouldn't have time to arrange for childcare in what sounds like an emergency situation. Not sure what else she expected him to do than to bring the child along. For how much Brian helped her (too much, IMO), she seems to always have a complaint about him.
Brian should have and definitely could have told her "no" and to call 911.

The jury will definitely notice her eye contact is off when she is to speaking to them, BUT, her eye contact (and smiles) is on par w/whoever she is making eye contact with in the courtroom.

Her eyes wander when speaking to the jury, no direct look.

CPS was called at one point prior to this incident with Jorge, when Sarah zipped her son in a suitcase and posted a photo online. They investigated Sarah's house and found nothing wrong.
Sorry I am so late….. but prior overt acts…… ok…… the prior incident of SB zipping her son in a suitcase and posting photos of that online - is that allowed in as evidence? Prior bad acts; a pattern of behavior and conduct? IANAL. MOO

Well that settles that.

AB is telling the truth today and only lied to detectives because she was afraid of getting arrested.

Since Jorge was a good guy when sober and only violent when drinking then why did AB drink with him and also supply him with wine?
