"The hearing against Victorino and Hunter for the 2004 murders in which six people were killed was about to enter its third day on April 27 when the 5th District Court of Appeal granted a prosecution request to stop the proceedings.

Circuit Judge Randell Rowe III said Friday that he would have jurors return to the Volusia County Courthouse in DeLand at 10 a.m. Tuesday to determine whether they can continue to serve; then the resentencing hearing would proceed."

Florida judge declares mistrial in Deltona 'X-box murders' sentencing re-trial

A Florida judge declared a mistrial Tuesday in a case to determine whether two men convicted in the infamous Deltona “X-box murders" should be sentenced to life in prison or death.

A new timeline for the re-trial has not been announced. One scheduled, that trial will require a new jury.

"Online Volusia County court dockets did not indicate Monday when new proceedings would be held.

The appeals-court panel said the mistrial did not moot the need for issuing Friday’s opinion."
