The State Attorney's Office for Hillsborough County, whose county seat is Tampa, had left open the possibility that it would pursue the death penalty against Kessler following his indictment on Dec. 9. In announcing the indictment, the office said it had "not yet determined whether it will seek the death penalty in Kessler’s case."

The prosecution has since decided not to pursue the death penalty, said Grayson Kamm, spokesman for Hillsborough County State Attorney Andrew Warren.

Police arrested the man they believe is responsible. Robert Lee Kessler was charged with second-degree murder and abuse of a dead body. He was booked following an arrest on an unrelated drug charge.

Police believe that Crone-Overholts met Kessler at a fast-food restaurant. It's unclear how long they knew each other before the murder, but her loved ones knew something was wrong. The last text that Crone-Overholts' mother received from her daughter was asking for help.

Kessler let authorities know he had met Crone-Overholts at a McDonalds. He said she was in need of a place to stay, and he allowed her to stay with him for several weeks in his daughter’s bedroom.

Authorities interviewed Kessler’s 8-year-old daughter, and she told them the evening of Nov. 5, Crone-Overholts and her father got into an argument, the affidavit said. She recalled Crone-Overholts asking her father for $200 and she would leave if he paid her. Her father told her to go to sleep and then her father and Crone-Overholts went outside.
