FL - Tracey Nix, two of her grandchildren died in her care in separate incidents (7mo in hot car Nov '22 & 16mo drowned Dec '21)

A search of the Hardee County clerk shows she’s still scheduled for trial 11/4/24. The latest documents are now viewable by the public.

“1. CRIMES, WRONGS, OR ACTS SOUGHT TO BE ADMITTED
On December 22, 2021, the Defendant had sole care and custody of her 16 month old grandchild, E.S. The parents of E.S. left him with the Defendant and her husband, Nun Nix at their home ni Wachula, FL. Mr. Nix left E.S. ni the sole custody of the Defendant ot run some errands. While M.r Nxi was out, the Defendant ingested two Cymbalta and Ambien and fel asleep while E.S. was left unattended sleeping ni a chair.
After she awoke approximately 10 hours later, she could not find E . and noticed that the garage door was open. The Defendant got into her vehicle to look for the child ni the surrounding area. While returning home, she saw E.S. facedown ni a pond on her property. The child was rushed to the hospital with a faint pulse but unfortunately was pronounced deceased on December 23, 2021”

Notably, the night before, the Defendant ingested time released Cymbalta and Ambien.”

Just catching up on this case. Here is a pic of the Nix's property in Wachula, Florida, that shows a huge pond right in the middle of the property. Google Earth images show that there is a fence around the house now. This fence was erected after the first baby drowned? There is no way that a toddler could get to the pond now without the gate being left open. 1736779009198.png
 
What’s bothering me is the story from the grandfather regarding the drowning death. To recap:
Grandpa says he was very aware that Ezra could open doors. So not only did he shut the door, he placed a weighted object behind it to hold it closed. In addition, he says Ezra hated water- I guess meaning that Ezra would never willingly go to the pond and get into the water.

So what is grandpa implying here?? If what he is saying is true, wouldn’t the grandmother need to actively do something like open the door and lead the toddler to the water?
If it’s not true, making up a story like that about his wife (to alleviate his own guilt?) also speaks volumes regarding his feelings towards his wife.
And now given that a second grandchild has died under grandmas care, it really does make me wonder. Is this really a case of grandma taking too many meds? Or did she do these things intentionally??

…Nix’s defense suffered several major setbacks last week.
Judge Rafool denied a last minute request from defense attorney William B. Fletcher to postpone the case or allow his office to withdraw from the case.
Fletcher filed the request Jan. 2.
The request cited the court’s decision to exclude the defense’s expert witnesses that were prepared to present evidence that Nix suffered from “diminished capacity” to “senility” and “overmedication” by her physician.
The decision to exclude the testimony was issued in a ruling by Judge Rafool Dec. 23.
“The Court sees nothing in the record to establish that Defendant actually suffers from senility,” Rafool wrote in his ruling. “The experts would therefore serve to stack inferences that she is, in fact, senile and that the condition was exacerbated by inappropriate medication and/or “habit memory.”
Rafool further noted that defense, when arguing for the inclusion of the expert witnesses, was asked to explain the methodology of one of the witnesses “and was unable to do so.”
“Based on the above, the Court cannot find that the experts’ testimony is admissible,” the judge ruled.
In his request for delaying the case, Fletcher wrote that the decision impacted the heart of the defense’s case.
“Defense counsel has spent over a year preparing its defense based on the testimony of these experts,” Fletcher wrote. “These experts made up the heart of the defense’s case. Defense counsel cannot adequately prepare a new defense and be ready for trial by January 13, 2025.”
Fletcher also requested to withdraw as counsel if the matter was not postponed.

In his denial of the defense’s request to postpone or withdraw, Judge Rafool was succinct.
“This case has been investigated and litigated by the State and the Defense for over two years,” he wrote. “This case is ready to be tried by a jury. It would be a disservice to relegate Defendant back to “Square One” with completely new counsel simply because her current counsel anticipated prevailing against the State’s motion. Defense counsel miscalculated, however, the Court does not accept counsel’s assumption that I can no longer effectively represent Defendant.”

If you've been watching a child and the child goes missing, the very first place you check outside the house is any body of water nearby. Pond, swimming pool, baby pool, mop bucket, anything with standing water in it. Once you make sure they have not drowned, then you call 911 and get them en route before you go driving around.

Her "ingestion" of two cymbalta and an ambien the night before shouldn't have anything to do with anything, assuming she has taken them before.
 
I am struggling with how a person gets two opportunities at this. I am struggling with the fact it could happen a second time, period... You would think you would be on your toes and wanting to prove yourself..

It somehow happens a second time... well you would not go to court, you would accept whatever comes your way.. Let's face it.. would your life not be over at that point? It would for most people but Tracey Nix would appear to be anything but most people.

The fact that she's fighting it and continues to live her life as normal means she doesn't give a damn..I don't see how the husband could even look at her . How anyone could really.

Her failure to go straight to the pond is such poor judgement…or deliberate (which I hate to think). But that should be the first place you think of going.

Maybe the baby was crying in the car, so she just left her in there, so she wouldn't have to hear it. November in Florida can be cooler weather, but they say it was 90 degrees that day.

It definitely makes you wonder.

Also, I don’t want to sound harsh, but I struggle to understand why when TN was supposed to be watching little Uriel at her home after being out with friends, why the grandfather wasn’t also watching out for the baby as an extra set of eyes and ears especially after the previous tragedy? It almost seems like he didn’t know Uriel was supposed to be there?

None of it makes sense to me.

Yes, I ignored the victim shaming ones, not worth anybody time to read them, but the ones about the lunching with friends, etc, certainly seem to fit the impression we get of TN here, and her blasé attitude.

Ezra drowned in a pond at his grandmother Tracey's house three days before Christmas in 2021, less than a year before Uriel died in the hot car. Under the judge's instructions, Ezra's death will not be mentioned in this trial.
