FORGETFUL GRANDMOTHER TRIAL Tracey Nix didn’t testify and she likely wouldn’t have been able to talk about her mental health…but do you think this info would have made a difference? Former employer fired Nix as a teacher for forgetfulness 3 yrs earlier (bond hearing

I just found this case yesterday and now it is done. Strange does not begin to describe it. Why were two witnesses on the stand after the jury had the case. Now she will get a slap on wrist and go on her way?

@arielilane Thx for you post w links. :)
From first link above.
" A jury found her not guilty of that charge but convicted her of leaving a child in a motor vehicle in excess of 15 minutes. She faces a potential sentence of up to 8 years in prison when she is sentenced at a hearing on April 3."

FL. statute (per my quick search).

"316.6135 Leaving children unattended or unsupervised in motor vehicles; penalty; authority of law enforcement officer.—
"(1) A parent, legal guardian, or other person responsible for a child younger than 6 years of age may not leave such child unattended or unsupervised in a motor vehicle:
"(a) For a period in excess of 15 minutes;
"(b) For any period of time if the motor of the vehicle is running or the health of the child is in danger....."
"(4) Any person who violates subsection (1) and in so doing causes great bodily harm, permanent disability, or permanent disfigurement to a child commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084."

Much better sound on this video, releases Jury, no sentencing discussion on this video.

"I don't want to face anybody. I can't face my daughter. I cannot do that," Nix said to investigators in the video.

The jury deliberated for a little over two and a half hours before reaching the verdict.

Tracey's sentencing is scheduled for April 3.

She is facing up to eight years in prison. She was remanded into custody as she awaits sentencing.

thank you to the judge for remanding her into custody...he could have released her on bond. I think there are some doctors that may need to answer some questions if she is on record as taking these drugs at the same time and has active scrips for all of them. The daughter (mother of baby) sounds like now she wants to go after her for the previous death. Probably taking the drugs then too. This is a really ugly case.

Any sleuths know why the drug interaction testimony could not be used in the trial?

  • #252
Sure seems like lots get left out of this trial.

  • #253
So still no one is really talking about her diagnoses? Why she is the way she is?

It seems so critical to know, why this tragedy happened twice on her watch, and why her affect afterwards was so "off."

Was the entire family in denial for years? Does she just refuse a full evaluation and diagnosis and everyone accepts that?

Please correct me if my thought process is off-base.

Came late to this case. Now, I'm hearing that
Tracey Nix, from what I'm hearing on Court TV,
is facing a 5-8 yr. sentence.

two deceased children and her husband speak

I bet it’s something HIPPA related. IMO This is just unbelievable.

If they charge her for the first death, can her conviction of the second be discussed at that trial?

  • #257
CourtTV said she's only facing 60 days as this is a misdemeanor charge like something you would get at traffic court. WTH??

they will have a lot of mitigating factors but one big aggravating is the death of the first child. As I understand it they can and will bring that in.

I have to imagine if it's only a max of 60 days the judge wouldn't have remanded her because by the time the sentencing hearing comes around in April she will have done the max sentence for what's she's been convicted of.

IMHO the jury will find out about the first death now, after being released, and will all realize they made the wrong decision. MOO.
