Tallahassee police issued a timeline Wednesday intended to defend the department’s professionalism in its investigation of sexual-battery charges involving Florida State star Jameis Winston.

But the release prompted swift condemnation by Winston’s attorney and appeared in conflict with statements previously made by others in the case.......

“We are deeply troubled,” Jansen said, “that the Tallahassee Police Department is putting on their webpage a timeline of the events in this case, which is an ongoing investigation, which contains some information which violates my clients rights to a fair resolution of his case, including the tainting of a potential jury pool. There is no reason whatsoever for that timeline to be on a public web page at this time.”.......

......DNA from Winston wasn’t collected until Nov. 14, some 10 months after the woman’s family said she identified him as her attacker and only after TPD turned the case over to Meggs’ office following media inquires for the initial police report. TPD’s timeline does not mention DNA.

It’s unclear which witnesses TPD interviewed in the early days of its investigation. But Jansen has said two key eyewitnesses who were present during the incident were not interviewed.........

Cappleman said a decision on whether to charge Winston is not expected until the week of Dec. 9. If a decision is postponed beyond next week, it would come after the ACC conference championship on Dec. 7 and the end of balloting for the Heisman Trophy two days later.......

“In my experience it is highly unusual for law enforcement to share sensitive information with the defense without sharing the same with the State Attorney’s Office,” said Tallahassee defense attorney Chuck Hobbs, who has represented FSU football players in the past......

“There is no excuse for a police investigator who keeps the state attorney in the dark while at the same time sharing information from an ongoing investigation,” Block said. “That is highly disturbing.”

Only a few "insiders" know what really happened. The alleged rape apparently took place in a campus residence while the alleged victim was intoxicated and the alleged victim and alleged perpetrator had some sort of relationship prior to the "event". Furthermore, the only known "witness" can be expected to be in Winston's "camp".

In light of the fact that the burden of proof in a criminal case is "beyond a reasonable doubt", prosecution is unlikely to result in a conviction. Most of the time, a D.A. will not file charges if he feels the case is a "loser". Sometimes the victim "goes public" and the D.A. is in a tight spot. When the accusation is "rape" and it involves a star athlete, the situation is explosive for the police, the D.A. and the school Administration. I guess thats why they make the big bucks.

I just wanted to correct some misinformation in this post. The event hapoened off campus. That is why Tally police were called in by the university police. The accuser had toxicology tests performed at the hospital. They were negative for being intoxicated and no drugs found.

The police investigation documents have been released. The accuser changed her story a couple if times. First she claimed to bee intoxicated, and even possibly drugged. Once it was shown that there were no drugs in her system and that she was not intoxicated she then claimed that she had been hit on the head and blacked out. I am still reading the reports.

First, I would not have charged Winston. However, it would have been nice if the Duke Lacrosse players had been given the same presumption of innocence. Even though there was NO DNA evidence (and two of the accused could prove they were elsewhere because of swiped credit cards), three were arrested and indicted, their coach was fired, the season canceled, they were attacked by members of the Duke faculty and the entire national media.

By the way, the woman who falsely accused the Duke Lacrosse players was recently convicted of murder.

I have heard that JW and the alleged victim had an ongoing relationship, but jealousy over another girl played a role in what's going on now.
I certainly hope that this young woman was not raped. It's such a traumatic event for anyone to experience. But I'd hate for this to be a fabrication also. The statement made by LE could possibly be taken out of context, but people are so crazy about football that I can also believe that it was meant in the way it's being portrayed as well.
I hope the truth comes out, whatever it may be. If JW is guilty....then he absolutely should be punished.
It may be a "he said-she said" kind of case if the story I've been hearing is true. I'm not sure the DNA evidence will be as big a factor if they actually were involved with each other.
I don't know what to think about the whole story...or who to believe.

After reading this entire thread I'm pretty sure it was consensual. Thanks to everyone who helped me figure this out.

There is no evidence that the girl knew him or they had any sort of ongoing relationship.
Also, contrary to what has been posted on the thread, there was alcohol in her system.

"Although Meggs refused to speculate why, he did point to an analysis of a blood-alcohol test taken several hours after the alleged attack that showed that her blood-alcohol content at the time of the incident could have been 0.10 percent, even though when it was taken the test registered a 0.04 reading.
The 0.10 reading would have been higher than the 0.08 legal limit for driving."

There was more evidence against Winston than against the Duke Lacrosse players by a factor of one hundred. Practically the entire national media pronounced the Duke players guilty even though there was ZERO DNA evidence against them.

Winston's accuser is anything but blameless. She willingly went in a car to an unknown destination with three males she didn't know.

This is what Natalie Holloway did in Aruba.

A woman once told me that a female should never go anywhere alone with a male she doesn't know. She also said a female shouldn't go off alone with two or more males even if she knows them.

If the accuser and her family are unhappy that charges were not filed, they should take comfort in her still being alive.

We don't know how this woman left the bar because police waited too long to get the video from the bar. By the time they finally went to get the video, it was deleted because footage overrides itself after a month. So police had a whole month to get the video from the bar but didn't. There was also a video taken of some of the sexual encounter by the freind of the Winston. Then that friend deleted the video and discarded the cell phone.

"There are many, many things that should have been done," Kirkham said. "A lot of investigative failures … not a well-handled police investigation, I think."

Natalee Holloway was more than likely given a date rape drug at Carlos 'n Charlie's. There is evidence that it was a common occurrence for the bartenders to slip something in a tourist's drink. Joran bought Natalee a drink shortly before closing time....

A friend of mine was a victim of a beach rape in Aruba, and she believes she was drugged while having a drink with dinner. She would never have willingly gone to a strange beach in a foreign country at night with a man she did not know. She never told anyone what actually happened until Natalee's case, although she packed up and left abruptly and in a panic the very next morning with her friends, insisting that she couldn't stay in Aruba another day and that they needed to leave too. She has fractured memories of what happened, but she does know that she was raped by locals. It's all the little details that are not exactly clear.

I am not saying this particular young woman in Winston's case was drugged, but those date rape drugs disappear from a woman's system rapidly so it's almost impossible to prove or disprove.

You shouldn't blame a victim who has been drugged for anything she does while under the influence of a date rape drug.

The attorney for Jameis Winston's alleged rape victim said she "absolutely" plans to file a civil lawsuit against the Florida State University star quarterback and the Tallahassee Police Department.

"I want heads to roll," Pat Carroll, the attorney for the woman who claims Winston raped her in December 2012, told ABC News in an exclusive interview.

Carroll said the Tallahassee Police Department was negligent in handling her client's case against the 20-year-old Heisman Trophy winner. (S)He claims the way police handled the allegations led to a prosecutor's decision to drop the case.

"Absolutely you're going to see a civil suit," Carroll said. "You can not have law enforcement that is not held accountable."

Carroll said, “The family is proceeding, with civil action against the TPD and Jameis Winston. And possibly the university.” ........more......
