Mom of Josie Lou Ratley sues Broward Schools for negligence

The mother of the girl who was viciously beaten at Deerfield Beach Middle School filed a negligence lawsuit on Thursday against the Broward School District, alleging the March 17 attack could have been prevented with adequate security.

Josie Lou Ratley, now 16, suffered permanent injuries and brain damage when she was assaulted at a campus bus stop, said her attorney, Sean Domnick. A school resource officer was at the school at the time of the attack, but did not witness it. The assault – during which Ratley's head was slammed to the ground and stomped on multiple times – was finally stopped by a teacher.

Wayne Treacy, now 16, has been charged as an adult with first-degree attempted murder and faces a maximum sentence of 50 years if convicted.

Seems that KM is being charged as an accomplice. From article:

Now what's really distrubing - read some of the comments. They are absolutely horrible. I can't wait to move away from here. Sorry to call this place home anymore.

I can't say I am surprised. This case hit a never with so many, in part because of the brutality of it, but also due to the fact that it happened on school grounds in front of multiple witnesses. I cannot blame Josie's mom, I would probably be suing as well in her shoes.

As to KM being named, I agree, this couldn't have happened without her pointing out Treacy's victim for him.

There will be no marking of Thursday’s anniversary in the home of Josie Lou Ratley. Last March 17 was a day those close to her would rather forget, if only they could.

“Today is certainly not a day to celebrate any anniversary,” said Ratley’s mother, Hilda Gotay. “It’s a sad day and a very emotional day.”

One year ago, as Deerfield Beach Middle School let out, Ratley, then 15, was thrown to the ground without warning by an enraged boy she barely knew. Wayne Treacy proceeded to kick her and stomp on her head over and over while wearing steel toe boots. All over an ugly text message exchange between relative strangers.

She underwent three brain surgeries, had a part of her damaged brain removed, and is still in the process of relearning nearly everything, from her ABC's and 123's to physical activities like brushing her teeth and taking a shower.

Gotay (her mother) said Sunday that Ratley continues to improve in her rehabilitation.

"Her memory is not very good, she tries to talk with sentences and stuff, she gets confused on words," Gotay said. "All in all, she's doing like second and third grade work."

Treacy, also 16 now, is behind bars, charged as an adult with first-degree attempted murder.

The lawyer for a Pompano Beach teenager accused of trying to kill a Deerfield Beach Middle School student in a fit of text rage wants the victim to recount what she remembers about the messages and threats that led up to the attack.

Josie Lou Ratley, now 16, suffered irreversible brain damage as a result of the March 17, 2010 assault at a school bus stop, according to the doctors who treated her.

I think what gets me the most is that his attorney is saying the prosecutors have "overcharged" him. Oh my Lord, FCA's ramifications are spreading far and wide.

This is a clear cut case of attempted murder. PERIOD. Just what does this attorney plan on asking Josie anyway? They have all the texts. Plus, will that 🤬🤬🤬 Treacy be allowed to be there too? Will poor Josie have to face this creep?

The justice system in this state stinks and its making me sick!

I don't think anything positive will come of questioning her - it's doubtful she would remember the details of that day.

There were some who were insinuating that it wasn't Josie who sent those messages, which is material to this case. (I don't know how actually, besides just a curiosity factor).

It might be interesting to put this to rest, once and for all, who sent the messages. So maybe questioning her friend under oath might turn this up - it does sound like Josie sent them, pretty much unprovoked.

This was a horrible thing to have happened, but what an incredibly cruel message to send to a grieving brother. Really. Girls I know wouldn't consider saying something so cruel.

It doesn't warrant death, for sure, or being beaten, but it does go to his state of mind. What a truly awful thing to say to somebody.

It's possible that the attorney wants Josie up on the stand so the jury can see that she walks normally and talks normally, although according to her mother (who probably knows her best) she's learning again at an elementary school level. The interview I saw with her would convince a jury that she's well on the way to being fully mended. And thank God for that.

And her Art? Will she recover her talent and ability to express it?

She has had a part of her brain removed, had 3 brain surgeries, is working on re-learning her abc's, and how to do math, to construct sentences, ah, and 1 year later she is well on the way to being FULLY mended? I don't believe that she will ever be the Josie she once was.

IIRC, this "boy" announced his intention to kill Josie, and someone had to point her out to him. Nice friend, the dust-up was about the girl who told him which girl was Josie. The reason for the texting was because the boy was trying to contact the girl, and Josie felt that he was too old for the girl. Now if this girl is under oath, certainly she would tell the truth if she (the girl) was the one who did the texting. We all learned about lying under oath during a recent trial in FL.

If someone says they are going to kill a person, and they put on steel-toed shoes, finds the person, and starts kicking the person in the head repeatedly, that sounds like a desire to kill, imo. And extremely poor-to-no impulse-control. Immature and dangerous.

Really, what he did to Josie angered me at the time, and still does. It seemed so deliberate. Boys I know wouldn't consider kicking someone in the head repeatedly with steel-toed shoes.

The attorney for the Deerfield Beach teen accused of beating classmate Josie Lou Ratley nearly to death will be using a temporary insanity defense after a judge granted his motion during a status hearing Wednesday.

Defense attorney Russell Williams said 16-year-old Wayne Treacy was not in control of what he was doing when he kicked and beat Ratley during the March 17, 2010 attack.

In the courthouse hallways after the hearing, Treacy's father let loose an expletive-filled tirade at reporters when asked for comment.

Williams added that the text message from Ratley made her the bully initially.

The situation regarding Josie Ratley specifically was she did send that text message," Williams said. "I don't think she knew who she was dealing with, she didn't really know Wayne, Wayne didn't really know her and based upon that, I think initially, yes, she would be considered the bully because she was the one that sent the text message."


Treacy is facing 50 years behind bars.

Now this is really making me sick. Our justice system is so broken.

First, this kid had "premeditated" thoughts and put them into action (actually changing his shoes into the steel toed boots; IIRC he sent at least 2 (maybe 3) text messages to friends telling them he was "gonna kill somebody"; got on a bicycle and rode 2 miles to the school and then actively sought out Josie (who he did not know nor knew what she looked like).

Disgusting that now he can say "I was crazy - ya honor". "I waz just so mad about what she said about my brother and I luved him man - ya know?"

GMAB!!!!!!!!!

Then we can move on to the defense attorneys. I honestly don't know how this man sleeps at night - he has outright called Josie the BULLY.

Josie was being a "friend". The other girl involved was very young and Josie was concerned about her "relationship" with this creep. She spoke up - tried to help (in her own way) and it almost cost her her life.

Next is the "other girl". She was afraid of this kid. He had to be raging so bad when he got to that school. I don't know about you guys - but I have witnessed someone "raging" and it is quite obvious the intensity and the intention to do harm to someone or something. She was afraid for herself and therefore ratted out Josie. Pointed her out - "look, there she is! Right over there! " I have always felt she needed to be charged as well. She could have very easily walked to a group of people - especially one with a few teachers standing there. It was a teacher that finally pulled him off of Josie.

As for the "text". All she said was "why don't you go see your dead brother" - or something to that affect. Was it hurtful? Yes. Did it warrant any type of retaliation? NO!

Wayne Treacy needs to be put away. Period. This "defense" is just making me sick to my stomach.

I'm so sorry Josie. I can't imagine how her mother (and her) must feel after learning of these new developments.

There is more news coming out of this court appearance today. It was referenced in the first article that I posted about Treacy's father. Word is that dear old daddy was flipping off not only the reporters but doing it inside the courtroom as well. Wonder why this judge wasn't like HHBP and didn't charge him for something. I'll see what comes up later about it and post it if I find anything.

Her parents' belligerence didn't seem to affect ICA's recent trial, unfortunately. :maddening:
