Girl charged as accomplice may not have seen beating
The teen charged with being involved in the attempted murder of a Deerfield Beach Middle School student did not actually witness the attack, prosecutors now say.

The 13-year-old girl accused of being an accomplice in the brutal beating of Josie Lou Ratley probably did not see the attack as it took place, prosecutors said Monday.

Lead prosecutor Maria Schneider said there was no conclusive testimony indicating Kayla Manson watched as her friend Wayne Treacy, 15, unleashed the beating March 17 on Ratley at Deerfield Beach Middle School.

Like it matters to me whether she stood around and watched the results of her handywork or not!

I don't think it matters one whit if she was present or simply facilitated before the fact. Same result, Josie beat near to death.

I am a little curious. The article states that the text that set Treacy off could not be found on the phone.

snip~The released texts also didn't include the specific text in which Ratley, 15, commented on Treacy's brother. That text, which investigators said set Treacy off, was sent from an e-mail account to Treacy's phone, Williams said.

Investigators did not find that text on Treacy's phone.

"It's like reading a book with missing pages," Williams said.

It's possible that Treacy exceeded the text message storage capacity on his phone that day, automatically erasing older texts, detectives said as they reviewed the messages. The review, authorized by a search warrant, was videotaped for use in court.~ end

I have wondered since first hearing about this case if it was even Josie who sent the text message to Treacy to begin with, and now my curiosity is peaked even more because the text wasn't there. Hmm

The texts jump from 2:07 to 2:37.....30 minutes.

then at 2:49 he says I just killed someone I am going to prison. This cr**p knew what he was doing was wrong and there would be consequences for his actions. premeditated attempted murder.

Wow. That was really intense. At least one intelligent person told him not to do it. He certainly gave lots of warning and took the time to tell people goodbye. So, he knew exactly what he was doing and what the consequence for himself, if not Josie, would be. What a complete waste. I hope Josie is doing well. I wish we would hear an update on her.

Hey elle - great minds think alike! I didn't notice your new message had popped, right while I was typing the same thing. This was definitely way, way premeditated. I don't understand how he didn't cool down after all that time, unless he was really just looking for someone to beat up and she just happened to be a convenient target.

Wow, his friends seemed pretty flippin' nonchalant about the fact that he told them he was about to MURDER someone in cold blood, as well as where and when. One simply said "Don't do it." Yeah, that's effective. Not one thought to alert the school, police, anyone.

Incredible.

I will definitely be praying for Josie. I have alot of faith in her.

It takes a long time to come back from severe injuries. Our Kaelie was hurt in an accident. I remember going thru the steps of recovery. For years even though her body functioned normally her brain just didn't have the response it should have had. It took years, I want to say about 6 until I saw the old Kaelie back. Finally about a year ago I started seeing the same devilish imp that she was before the car accident. She stumbled through high school almost in a daze, but thank the lord she's finally back.

They should give Josie's father 15 minutes with this little punk. Leave Treacy handcuffed and just walk out of the room. Whatever happens, happens.

It boggles the mind. Desensitized youth? Too many video games/offensive music/violent movies for one to take such threats seriously? Or do kids these days actually just not care?

Maybe they thought he was just running his mouth. Supposedly Josie herself got a message from him and didn't warn anyone or ask for help either.

I don't think any of those kids really thought he would do it. Kids always run their mouths and act tough, so I suspect they thought he was just blowing hot air. When he is describing what he is going to do, it just doesn't have the ring of reality to it.

I find that extremely bizarre, now I am left wondering if there was ever a text sent to him about his brother at all.

Yep, the other teens possibly did not take him seriously, but it certainly looks to me like he meant every word.

No doubt he meant every word as that is exactly what he proceeded to do. I just don't think the kids he was texting thought he was for real. I don't see kids of that age having that sort of acuity. I think it also accounts for the seemingly indifferent responses. They just didn't think for a minute that he was serious. I could be way off kilter here, but that is the way it strikes me.

FORT LAUDERDALE, Fla. — The 15-year-old Florida girl brutally attacked by another teen at a middle school is getting ready to go home.

Lawyer Sean Domnick says Josie Lou Ratley is undergoing physical, speech and occupational therapy at an undisclosed rehabilitation center. But Domnick says Ratley still faces a lengthy recovery.

Domnick has not said when Ratley will go home. Her mother will discuss Ratley's progress Wednesday at a news conference.

On Wednesday, Domnick and Ratley's mother Hilda Gotay, will hold a news conference to give an update on Josie's progress.

Over the last three weeks Josie has been re-learning to talk, to eat, to use her arms, etc. In a written statement, Domnick said her long-term prognosis is still unknown and could take years to determine her prognosis for a full recovery.
