Palm Beach bartender sues DeSantis over reopening measure that excludes South Florida

Restaurants and retailers across the state received the governor’s blessing to reopen Monday, as long as they operate at 25% capacity and keep tables six feet apart.

That is, restaurants and retailers outside of South Florida, according to Gov. Ron DeSantis’ executive order, released last Wednesday.

DeSantis’ mandate does not apply to Palm Beach, Broward or Miami-Dade counties, all of which the governor says “have seen the lion’s share of the epidemic.” The three counties make up 60% of the state’s more than 36,000 cases of COVID-19, the highly infectious disease caused by the novel coronavirus.

Debra Henry, a 40-year South Florida restaurant industry veteran, is suing DeSantis over the order, which she calls an unfair attempt to reopen some businesses in the state but not others.

The complaint, filed in federal district court the day the order was released, says the order violates Henry’s constitutional rights, as it “arbitrarily” allows some businesses to remain open. It says the order is “unconstitutional on its face” and will disparately affect some businesses but not others.

Henry’s attorney Cory Strolla said the decision is arbitrary because the county has a high mortality rate but not as high of an infection rate. The county cases make up 9% of cases statewide, while Broward and Miami-Dade make up more than half. However, Palm Beach has 14% of Florida’s COVID-19 deaths.
Strolla said the higher mortality rate exists because the county has a population that skews elderly.

“To pick an imaginary line based on a number of infections is arbitrary. People aren’t dying at a catastrophic rate,” he said. “Yes this is a pandemic, but it’s not the bubonic plague.”

I agree. I went to Publix and, not realizing there were directional arrows on the floor, I know I walked too close to a few people. I backed off when I realized it. A grocery store aisle can only have 4-5 people in it at a time with 6’ between them. There was too many people in some aisles to do that. No one was policing that plus there were stock people filling the shelves.


Yeah I noticed that too, even signs on the floor saying "Wrong way" or something to that effect. Guffaw.

Hm, I imagine being a bartender in Palm Beach can make very good tips?

Just guessing at this point, I remember when my family went to West Palm Beach for vacation time, Dad drove us through Palm Beach, all I remember are seeing mansions - a lot of them. Yep there's a lot of money in Palm Beach.

I was watching a video of upstate NY last night - and just as a comparison, Clinton County (by Lake Champlain) has a total of 71 lab-confirmed positive COVID-19 cases with 53 recovered and 3 deaths:

The radio has broadcast his pressers at 5pm and I’ve listened to them driving home - nothing today though
I had it on for about 2 minutes. IMO it looked like a CYA power point presentation from the little I saw, but after reading that article it looks like it’s turning into a blame game...although I thought I heard these rumblings prior.

In asking Chief Inspector General Melinda Miguel to review the management of CONNECT, Fried said in a letter that several audits over the years have detailed more 600 issues with the system, “about which the governor was briefed in 2019.”

“Despite these known failures, the governor has not acted with the urgency or transparency that the situation necessitates,” Fried wrote in the letter to Miguel.

“As head of the state’s consumer protection agency, I make this request on behalf of the thousands of Floridians who have been unduly frustrated by their state government’s inability to timely process requests for unemployment assistance, for whom economic recovery depends on the competent government response they deserve,” said Fried, who heads the Department of Agriculture and Consumer Services.

“Families who needed a bridge across this economic crisis are being cut off when they need it most,” Rodriguez said in a statement.

This article is even more insane!

"We "deserve" a graduation ceremony.". And they want to "hug their favorite teachers". WTH?!

Many states are actually banning any type of high school graduation. Other districts are planning graduation ceremonies in the Summer, or Fall.

I wish that I could feel more optimistic about that.

Tuesday's Coronavirus Updates: 42 new cases, 8 new deaths in SWFL

As of 11 a.m. Tuesday, there have been 37,439 positive cases of the coronavirus (COVID-19) in Florida. The case count includes 36,492 Florida residents and 947non-Florida residents. There are 1,471 deaths reported and 6,330 hospitalizations, according to the Florida Department of Health.

There have been 467,553 tests administered in Florida. A total of 37,439 tests have come back positive, and 428,252 tests have come back negative. The remainder are still pending, according to the FDOH website.
The state has also released a list of long-term care facilities where cases have been reported.

*Numbers are released by the DOH daily at approximately 11 a.m.

Same game being played in Nevada. Shift blame to prior administration. The governor in Nevada also replaced the Chief of UI.

Sure, line dancing from 6 feet apart. It will be like some sort of Amish dancing on steroids. At least the prom monitor won't have to tap anyone on the shoulder with a ruler. Not that I would know anything about that...heard it from a friend. Of course.

It looks like most non-essential stores are open where I live, like Stein Mart. No gyms/health centers that I could see. Of course I could only notice what I did while running to the drive-through at the bank at lunch today. Meh, I think I'll wait a bit for any shopping excursions...
