state is doing an excellent job outlining that the McMichaels' probable cause amounted to rumor, speculation, and assumptions.

  • #582
laura hogue got up here and gave you criminal defense 101. no crime took place, it's the victim's fault malign the victim. I know you won't buy into that.

1.8 miles away is AA's home.

  • #583
Yes, and yet LD didn't repeatedly interrupt the defense attorneys when they used words like burglary, lurk, sneak, probable cause, dirty toes, etc. The defense misstated the law in a way that benefited them throughout their closings.

The jury has been instructed multiple times that the judge will give them the law, and the attorneys are simply explaining their interpretation of it.

They wanted to slow her down, interrupt her flow. I was watching while getting ready or work and she was on a roll. they needed to stop it. MOO

I’m sure it won’t go unnoticed by the jurors that the state did not interrupt them once, and let them do their thing. The defense in the other hand, is now throwing the toys out of the pram during her rebuttal.

It stinks of pettiness and desperation

  • #584
I love the way she handled "blame the victim"-- she did not spend more than a minute by saying it was standard and she knows they know better and "it was offensive".

  • #585
I think it's possible the defense may have succeeded in having the jury dismiss LD's arguments about citizen's arrest as just her opinion about the law.

  • #586
She has put forth the best prosecution I have ever seen and that includes Juan Martinez. She hits every single point---

State: what's the emergency? Answer: There's a black person running down the street.

and this right here, this is the nuts and bolts of motive for the murder of Ahmaud Arbery. I hope that sticks with the jury during deliberation.

  • #588
Bryan made his independent own decision to join the McMichaels in going after AA.

State: It can't be Feb. 11 because a private citizen's arrest must take place immediately. Ofc. Rash goes inside with his gun. Neither Diego Perez or Greg McMichael said they'd already been inside the under-construction house with their firearms.

State: They don't know anything about November b/c they didn't know about that until Feb. 2020. About Dec. 17--*plays video* Video shows #AhmaudArbery walk casually through the site. They keep claiming it's pitch black in there--does he look like he can't see in there?

House.jpg

Note the video showed #AhmaudArbery walk casually through, and then run out and down the street. The defense had earlier contended Arbery never "ran" out of the house, but video shows differently.

walking.jpg

State: You don't really have to consider self-defense because if it's not a lawful citizen's arrest, they were the first unjustified aggressors, and were committing felonies against Mr. #AhmaudArbery, they don't get to claim self-defense.

State: No crimes were committed in defendants' presence.

State: Yesterday, Laura Hogue got up here and gave you Criminal Defense 101. Usually #1 is "No crime took place." Well, crime's on video. #2: "My client didn't commit the crime." Well, your client's on the video doing it. Step 3: "It's the victim's fault."

State: Standard stuff, maligning the victim. I know you're not going to buy into that. It's offensive. #AhmaudArbery lived 1.8 miles away. Feb. 23, 2020 he walks in at 1:08 PM. Doesn't take anything. Does what he always does--wanders around & leaves.

ADA.jpg

State: Albenze calls non-emergency number. I asked, Why didn't you call 911? "B/c this was not an emergency." Greg McMichael driveway decision #1: He's alone and sees #AhmaudArbery: "The whole thing started when I saw this guy running down the street." Doesn't know he was in 220.

State: Travis McMichael certainly didn't know anything; he was in the house. Greg McMichael assumes #AhmaudArbery has done something. I don't know what this guy's doing but he's running real fast. He must've done something. Let's chase him with guns.

State: Driveway decision: Arming themselves. Greg McMichael didn't take his cell phone. If he'd contacted 911 he could've been telling them play-by-play of #AhmaudArbery's movement. They had no intention of calling 911--just like they went to bridge, went to house, then called.

State shows video we see Albenze outside, #AhmaudArbery run down street, and the McMichaels get into their truck, the truck pull out. Albenze points as the truck is already out and going down the street.

yard.jpg

State: Should you trust the statements of Travis McMichael? "I'm not going to chase someone armed." Then, "all the 'maybe's he testified to.' Then, he assumptions. Then, what he'd heard that would authorize him to do citizen's arrest.

panel.jpg

State: Travis McMichael says he told #AhmaudArbery, "I want to talk to you...I'm ordering him to stop." What gives you the right to order Ahmaud Arbery to stop? Then, "My impression was he could be a threat." Self-defense, you have to be in fear of imminent danger!

As Dunikoski shows a crime scene photo of Ahmaud lying dead in the street Marcus Arbery leaves the courtroom in a hurry and Wanda Cooper Jones lets out a quiet, pained cry of "oh."

Good for LD for telling the jurors they need to be able to explain their reasons & beliefs to each other OUT LOUD.

  • #592
I see everyone standing, and I'm assuming the jury is leaving. Is LD done?

Yes.

Awesome LD…thank you for your dedication and delivery of facts!

Dunkoski says it's not if these are good or bad people. "It's about holding people accountable and responsible for their actions." Says returning a guilty verdict is telling them we know what you did and are holding you responsible.
https://twitter.com/newsworthy17

She closes and asks jurors to find defendants guilty on all charges. We're taking a 10-min. recess. Some folks in the gallery are stepping out for a bit.

State: Travis McMichael claimed he didn't know what his dad was saying to #AhmaudArbery. Do you believe that? Do you think this TM who took the stand is the same TM from Feb. 23, or is this trial preparation? Plays 911 call from 2.23

State: Use of force continuum. No badge, uniform, authority. Just strange guys in a white pickup. Verbal commands? They don't have authority. This a fellow citizen, human being. They pull up, demand he stop and talk? Then skip levels 3-5 go right to deadly force.

State: He says, "You pull out a shotgun to de-escalate." What are you talking about? Does this logic make any sense to anybody? Travis McMichael never said to police he was trying to arrest #AhmaudArbery. Wouldn't that be important?

State: Travis McMichael said he "wanted to question #AhmaudArbery abt what might've happened that day." Let's talk about Roddie Bryan: "Y'all got him?" He can tell they're trying to stop him from his porch. He chooses, "I'm going to go join 'em to try to stop this guy"

State: Bryan's driveway decision: To go help the McMichaels stop #AhmaudArbery. He could tell what they were trying to do. That's what party to a crime looks like. His comments: "I missed him." He was intending to hit him! If you "miss" him, what were you trying to do?

ADA.jpg

State: Bryan says #AhmaudArbery was trying to get in his truck. Was he, Mr. Bryan, or did you get so close to him that he had to push off from your vehicle and that's how his palm print and white T-shirt fibers got on it?

State details Aggravated Assaults...1, 2, 3. But for Bryan's actions keeping #AhmaudArbery from running out of Satilla Shores and redirecting him, Arbery would be alive. He played a substantial part in his death.

State shows crime scene photo of #AhmaudArbery lying dead in the street. Marcus Arbery leaves the courtroom in a hurry; Wanda Cooper-Jones lets out a quiet, pained cry of "Oh." Prosecutor notes neither truck was searched & Roddie Bryan driving truck away as tech is taking photos.

State: No one said #AhmaudArbery had a weapon, made a threatening comment or gesture, no one said I saw him commit a crime today, no one said I was making a citizen's arrest...on Feb. 23, 2020.

State: Greg McMichae's words show his guilt. Police asked, Did this guy break into a house today? GM: That's just it. I don't know. You might want to knock on doors. This guy just done something because he was fleeing from something.

Greg.jpg

State: You can't make a citizen's arrest b/c someone's running and you have no idea what crime they've committed that day. You can't hold somebody and tell police, "He must've done something. Go figure it out."

Greg2.jpg

Police asked Greg McMichael if the guy was picking up anything in there? GM said Not that I recall. I don't think the guy has actually stolen anything out of there. But if he did it was early in the process. Never any mention of stolen items off a boat

State: Bottom line, they committed 4 felonies against #AhmaudArbery in violation of his personal liberty before he tried to run around their truck after he'd been running from them for 5 minutes, yelling at him, threatening to kill him. Then they killed him.

State: Do you have any doubt that they committed all the charges in the indictment? Dunikoski mentions lesser-charge reckless conduct count for Bryan. You're the jury. Today you are Glynn County

State: This isn't about whether these 3 men are good people or bad people. It's about responsibility, holding people responsible for their actions...when they do something like this. Nobody gets a free pass.

What does everyone think on what the jury's decision will be? And how long do you think it'll take them to decide?

I'm assuming the judge hasn't charged the jury yet, so this is for after they get the case.

  • #598
state rebuttal was very good as she went as close to the line as she could, by saying we know why they did it, they know why they did it, and empahsising he was just a black man jogging,

reminding the jury he is dead because of the colour of his skin, and no other reason

Guilty on all top counts. Verdict tomorrow morning, only because they will agree to sleep on it before handing down the final verdict because of the seriousness.

State: They know what they did and they know exactly why they did it. When you come back with a guilty verdict you're telling them, We know what you did too and we're going to hold you responsible for it. Dunikoski shows #AhmaudArbery photos...

Dunikoski shows #AhmaudArbery photos; Wanda Cooper-Jones lets out a loud, pained, "Ohh!" Dunikoski says, "You turned this young man into that young man for absolutely no reason at all. I'm asking you to find all 3 defendants guilty of all the charges in the indictment."

The close-up photos showed #AhmaudArbery in life, next to one of Ahmaud Arbery in a crime scene photo. Those next to Wanda Cooper-Jones comfort her including lawyer Lee Merritt.
