Spokesman Testifies Judge Tipped McIver to Pending Arrest
Longtime political analyst and commentator Bill Crane testified Monday that Atlanta attorney Tex McIver told him Fulton County Superior Court Judge Craig Schwall had called to warn him his arrest was imminent.

"Superior Court Judge Craig Schwall, whose son is the godson of Atlanta attorney Claud “Tex” McIver, tipped the lawyer off that police were issuing warrants for his arrest, McIver’s friend and spokesman man, Bill Crane testified Monday.

Crane, who ran interference for McIver with the news media in the days immediately after McIver shot and killed his wife, Diane, said he and McIver were having lunch on Dec. 19, 2016, when the judge called McIver on his cellphone...."

Consultant: McIver suggested splitting bonus with DA if charges were reduced

"....During cross-examination, defense attorneys forced Dickerson to admit the alleged bribe was just his impression because McIver never used the words, "I will pay Paul Howard money."

"He didn't tell you if you get the charges dropped there will be money in it for Paul Howard?" Attorney Don Samuel asked.

"No," Dickeron replied.

Defense attorneys also criticized Dickerson for taking McIver's money for eight months before bringing this so-called bribery attempt to Paul Howard's attention a year later...."

I honestly don't quite get the prosecution's motive that he killed Diane for money...that she was worth more dead than alive. From what I have heard, I just don't see it. Although she had many assets, cash and insurance, it just doesn't seem like it is that much 'as compared to their outgo' during their lives. Too me, it seems that she was worth more alive than dead.


Also, do you think the defense will have Annie testify?

Shortly after 3:30 PM, the State rested in the case vs. #TexMcIver, who is charged with the murder of his wife, Diane. The defense will defer until at least tomorrow discussion with the Court about whether McIver will testify. @wsbradio

An old article from October 12, 2017 has some interesting things written, IMO:

Otherwise, his murder trial will begin October 30. A hearing today revealed new details about a 1990 shooting incident the prosecution argues is relevant to the case.

"....In court today, Rucker also argued that a 1990 incident in which McIver set loose his two German Shepherds on a red Mustang near his house on Cravey Trail in northeast Atlanta, then fired his gun at the car, would be relevant for a jury to hear. Kevin O’Neal, a passenger in the car at the time, took the stand to recount what happened that night 27 years ago. O’Neal, who’s 46 now, said he and two friends—all of whom lived in same DeKalb County neighborhood as McIver did back in 1990—were toasting his impending departure for Parris Island, where he was reporting for duty.

“We were having a couple of beers,” O’Neal testified. “At one point, we noticed a couple of dogs that were coming down the road toward us. Kevin [Blase, the Mustang’s driver] was being jovial and he barked at them. A few minutes later we heard what we thought were firecrackers going off. We noticed a man walking down the street. He was holding a gun. We decided we would get in the car and regroup around the corner, out of sight. We decided to leave. We weren’t going to ask any questions. We weren’t sure of his frame of mind. As we were leaving the area, he opened fire on us as we were passing directly by him.”

No one was injured in the incident. O’Neal testified that he knew it was McIver because O’Neal had attended school with McIver’s son Robbie from first grade through high school.

Although McIver was indicted on five counts stemming from the 1990 incident, the case was ultimately “dead-docketed”—dropped, essentially—after McIver paid $2,931.10 to Blase to pay for the damages incurred by the bullet holes in his car.

Bob Houman, who was a DeKalb assistant district attorney at the time, testified today that McIver submitted to a psychological test after the shooting. McBurney asked if the result of the test contributed to the decision to dead-docket the case. “Yes,” replied Houman, who is now the chief assistant district attorney in Rockdale County. McBurney has yet to rule on whether the incident will be allowed if McIver’s murder case goes to trial. Though no details about the psychological evaluation were discussed in court, last year the AJC reported that the test found McIver to be “extremely non-violent” and “would not be prone toward aggressing against others in any form.”

Rucker argued that the 1990 shooting, despite happening more than a quarter-century ago, is relevant in the shooting death of Diane McIver. “There’s a certain disregard that he has with respect to human safety when he is handling guns. This 1990 case is a classic example.” Rucker cited a police report from the incident in which McIver told police he never had a gun at all. Said Rucker: “He is dishonest about his handling of a firearm, much as what has occurred in [the current case].”.."

I don't think it's all about the money for Tex- I think he may have been fed-up with how Diane treated him and then there's the money. I think in Diane's mind, she ruled and treated Tex accordingly- almost like a business deal, with the loan she made to him. Come on...Tex is her husband, not some business associated/friend. So strange...


These are my thoughts, so far:

In my mind, I'm leaning on guilty:

- because Diane didn't want to see Tex for possible the last time in the hospital- something fishy about their marriage

- the masseuse "sleeping on the bedroom floor" thingy- fishy also

- because he tried to cover it all up by asking Dani Jo to leave the hospital- wonder what story he would have told if Dani Jo agreed to leave- she was shot in the bathroom?

- because Tex originally said that he was asleep and a "bump" woke him/the gun went off- when Dani Jo said that the car was stopped at a red light and then the gun went off

I wonder if the denfense is gonna put an MD on the stand to explain what kind of illness that Tex has that makes him sleepy???- he seems alert all thru the long trial day

But I think there will be a hung jury or Not Guilty

I think it's to the defense's benefit to put Annie on- with the innuendos that the State made about her and Tex- I would wonder what was really going on with them (and I do wonder...:facepalm:..). She could just be an innocent bystander who gives Tex some moral support? Of course she could just lie- who would know- unless the State has witnesses that actually saw Tex/Annie doing some hanky-panky.

This is a troublesome trial....:thinking:
