#TexMcIver lawyers and judge now discussing logistics of the jury view of the SUV in which McIver shot his wife. State wants jurors to be able to walk around it freely and for it all to be videotaped. Suggests if jurors want to open doors, look inside, that be okayed @wsbradio

#TexMcIver - After a short break the judge and attorneys are going to go over jury instructions. This is where we'll hear what, if any, lesser included charges there will be.

Defense rests in Tex McIver murder trial | Defendant speaks for the first time (with clip)

"ATLANTA – Closing arguments could begin as soon as Monday in the high-profile murder trial of Tex McIver, the Buckhead attorney who is accused of intentionally killing his wife, Diane, almost a year and a half ago.

The defense rested its case Friday afternoon, which was day 19 in the trial.

Friday also marked the first time McIver spoke on the record in court, when he told Fulton County Superior Court Judge Robert McBurney he was not going to testify...."

I can't stand this grandstanding, fake, lying prosecutor. IMO, he's a disgrace and should be fired.

I'm not fond of him either. When he 'tries' to put on a sweeter voice, I find him very condescending.

This whole team is less than stellar...but this judge sure gives them a lot of leeway.

MOO

So she wore shoes which were too big for her?

so is the state keeping that info for the "perry mason moment" in closing? Part of rebuttal. I felt Annie was lying about alot...she needs to stay on good terms with the McIver clan. With shoe sizes like that clearly Annie could have worn boots that belonged to Diane...one normally wears a bigger size boot than shoe and especially that kind of boot.

I wear a 10 and there is no way I could fit in anything below a 9.5 and that is rare. No way her 10.5's would fit.
Well, that's presuming she wasn't fudging a bit on her size.

She obviously wasn't all that accurate with Diane's shoe size.

I'd love it if the prosecution called her back and measured her feet!

honestly rucker prancing around making monkey shine faces at the jury during his cross of the crime scene guy is unbelievable. He is foolish and if he thinks the jury find him amusing or that he is doing a good job I think he will be very disappointed.

Boy as Rucker continues cross the defense attorneys all sit there and you can almost feel the vibe...they know Rucker is simply putting forth NOTHING and their expert is doing a good job.

i have to wonder if Rucker has completely lost it today....he is so hyped up about nothing and laughing at nothing but himself.

  • #1,035
OMG the whole court room is laughing at Rucker not with him...he is making a total fool out of himself. I have never seen an attorney in a murder case act like this...completely lost it.

Defense rests in Tex McIver murder trial; McIver won’t testify

"...3:51 p.m.

Jury Charge

Lawyers and the judge are working their way through the jury charge — or the directions the judge will give jurors before they deliberate.

They are deep in the legal weeds but these instructions are important in guiding the jury through their work.

Among the highlights, even if the jury doesn’t find McIver guilty of intentional murder they may find him guilty of lesser charges such as involuntary manslaughter.

3:10 p.m...."

Listening to the end of court Ytube again- looks like the judge is going to allow lesser included offenses of felony aggravated assault, felony involuntary manslaughter, and misdemeanor involuntary manslaughter....hope so.

Doubtful defense would take the chance of it not being true since they brought it up to make the state look horrible and it worked.

Really surprised by the comments about Clint Rucker. He does not come across negatively to me at all. It will be fascinating to hear the verdict and find out what the jury has made of this trial. It reminds me of sitting through a homicide trial in that same building. Judge is an acquaintance. He was sure the defendants were going to be found guilty. The lead defense attorney chatted me up at break and asked me which way I thought the jury was leaning. I told him acquittal on all counts. He was like, really? And I said I was sure. And yes, the defendants were acquitted on all counts. My point is this: because I cannot see the jury, I’m just relying on what I can see. And I’m not at all disturbed or concerned by Rucker’s demeanor. I always follow the money. Samuels and Harvey are making insane $$ defending Tex. Clint Rucker does not get a penny more win or lose. I will be there all day Tuesday. Will report what I see as I am able to. Very hard to get cell reception in the tower, which is a bummer.

What I can't stand is seeing Tex's pathetic face with his poor-me, woe-is-me, oops, did-I-do-that, meek ole me attitude. What did she see in him? Also want a pair of scissors to snip that other one's rat tail! Gross!!!
