Floyd County investigators believe an 82-year-old woman was left in a freezer to die by her grandson. Floyd County Police charged Robert Tincher III with malice murder and felony murder in connection with the crime.

Authorities said on Friday, April 14, they received information that Doris Cumming was possibly missing. Her family believed she had moved out of state, but they had not communicated with her recently. Tincher had been living with her before her disappearance and police said he should have moved with her at the end of 2021.

After getting in contact with him, they learned she was injured in December at their home and Tincher allegedly didn't get his grandmother medical help. Police believe Cumming had other injuries before her death as well.

Documents regarding the charges claim Tincher allegedly "grabbed the fallen body of the victim" and "dragged her through the residence."

Investigators have reason to believe that, while injured but still alive, Mrs. Cumming was placed inside large plastic bags and then placed in a freezer and this was done for the purpose of concealing Mrs. Cumming’s death," police said in the news release.

Documents also state Tincher "expressed fear of discovery," so about four months later, he allegedly decided to move the freezer from the home to another location in Floyd County. Authorities said it was moved around March.

How do they know? Why are LE insistenting she accidentally fell? The autopsy hasn't even been completed. But they believe him because...he says he loved his Grandma but was too scared to call 911 when she fell since he was hiding from arrest for having threatened to kill his wife.

Sounds like maybe the good old boys all know when it comes to arrest, a fugitive's gotta do what he's gotta do. Maybe it's the III after his name.

Probably his statements aligned with the physical evidence as they have it so far. I presume there were no obvious significant injuries and the position her body was found in incubated she regained consciousness and tried to free herself from the freezer. Ghastly for sure but not murder or even voluntary manslaughter. If additional evidence materializes at autopsy or review of devices or any other avenue of investigation more charges can always be filed.

As for the III after his name I see no indication of the Robert Keith Tincher dynasty having any unusual influence in the area. Sadly it's not particularly uncommon for older women to be killed by their grandson whom they're trying to help with legal trouble. It happened in my city last year.

I would certainly expect serious MH issues to be involved here. MOO

There was no altercation or dispute that provoked the killing, and in fact, Tincher told police that he loved his grandmother. “He said she was the only family member that gave him the courtesy and love and attention he needed,” Werner told the television station.

So her family had not communicated with her since December which is when she fell and her grandson broke her back stuffing her alive into a freezer.

Why did the family think they were moving at the end of 2021? Is that something she told her family before December of last year? How sad she didn’t have any family members within driving distance that could have checked on her. :(

IMO he is probably a psychopath. That isn't a mental 'illness' because it can't be cured, it's an incurable personality disorder. JMO

So, police did charge him with 'malice murder' which is the highest murder charge in the state: "Malice is implied when 'no considerable provocation appears and where all the circumstances of the killing show an abandoned and malignant heart. The offense is similar to first-degree murder in other states." Malice murder - Wikipedia

They also charged him with felony murder.

If he thought she was already dead from an accident. His story is the least criminally culpable version of events that could have possibly happened so hopefully all the evidence is gathered and will be taken into consideration by the prosecutor's office.

Eta: I see that he's been charged with malice murder now so I guess his story didn't hold water.

But he didn't think she was dead, right? He said he still heard her breathing and thought he detected some movement, according to his own statement.

It seems he didn’t think she was already dead from the fall. Who’s to say that he wasn’t violent towards her causing her to fall, then covered up his actions by putting her in the freezer since he was wanted on an outstanding warrant involving violent threats? No empathy from me, what a horrible way for this monster to cause his grandmother to die.

What’s really sad IMO is the other family members didn’t protect this elderly woman from her grandson. Too often loneliness, physical limitations, and dementia create these tragic situations, giving an opportunity for rogue grandchildren to take advantage.

At the least, manslaughter, if you thought they were dead.
IMO, manslaughter means causing the death of someone accidentally, without intention. But the person died because of those actions. For example, the sidewalk death in NY, pushing an elderly lady who hit her head on the sidewalk and days later, died.

There is a charge along the lines of 'interference with remains'. This is where, eg, a person dies of a drug overdose at a party in a home, the homeowner hides the body. Some killers are lucky to receive this charge, because there is not enough proof to get a manslaughter or murder conviction.

However, what bothers me about that charge is, how did the person know for sure the victim was dead? Even paramedics don't declare someone dead, only a doctor can do that. People can be in a coma with a faint pulse, is the 'hider of remains' really so super skilled at detecting a pulse?

In this case, even in the killer's made-up story, he could have called 911, left the door open for paramedics, and gone on the run. Even stolen money and stuff would be better than this.

I hope Doris rests in peace and her horrid grandson doesn't have a peaceful moment for the whole of his remaining existence.

I suppose he would be the one to say if he thought she was alive or dead and now I see articles posted that he admitted to knowing she was alive but the law does make a big distinction.

I personally don't feel that a person so stupid and compassionless as to abandon a dying or dead person should be allowed to live free and unsupervised but as @Satchie said we see this again and again here in cases where missing people died of overdose.

The law should really punish those who fail to render aid much more severely than it punishes people for intoxication or drug possession but it doesn't. I guess that says something about our society.

Putting a living person in a freezer is 100% murder or manslaughter. Wut.
