"We have not confirmed the identity of the child J'Asiah Mitchell; however, there is high probability based on the circumstances surrounding this case," investigators said in a statement.

They added, "we are looking at the father as a possible suspect because he was the person last seen with the child."

Police said on Wednesday that the father's stories are not adding up and are looking to charge him in the toddler's disappearance.

"He has not been cooperative. He has been very elusive in his stories and very deceiving," said East Point Police Chief Shawn Buchanan.

East Point Police are still investigating J'Asiah's disappearance. Authorities said that "digital information" led them to search the transfer station where they found the body of a child.

Police added that the case has been difficult for all investigators involved.

"It's actually devastating. A lot of detectives are having a difficult time. When you are dealing with a case where you are hoping the child is alive, you are hoping for something positive to come out and it doesn't, it's just hard on everyone here," Chief Buchanan said.

I just saw that they possibly found his body. That poor little baby. I hope his father rots in prison for the rest of his miserable life.

Some people do not deserve the blessing that is a child.
There is nothing that a two year old could have possibly done, to warrant whatever happened to J'Asiah, that ended up with this babies' death.
Imo.

Rest in gentle peace and fly with the angels, J.Asiah !
My utmost condolences to all who loved him.

Following from Canada - is Georgia a death penalty state and could the judge decide this would be appropriate punishment?

Georgia does have the death penalty. Looking at capital offenses in the state, I think this is the only one that might apply, and would be difficult to prove, depending on the state of J’Asiah’s remains.

Murder with one of the following aggravating circumstances:
. . .
The capital offense was outrageously or wantonly vile, horrible, or inhuman in that it involved torture, depravity of mind, or an aggravated battery to the victim

There are some additional clauses that might qualify, depending on the criminal record of his father, were he to be convicted.

Artavious North’s Facebook, not publicly updated recently.

The question about Artavious (an earlier source has his first name misspelled as Artayvious) and his eligibility for the death penalty made me wonder about past offenses. He has several charges in Carroll County. Their online records are rather painful to sift through, but they do have scanned in warrants, etc., assuming you can get them to load. I managed to get exactly one to work successfully.

  • Jan 26 2017, charges of battery and disorderly conduct.
  • March 3, 2018, affray (fighting).
  • June 8, 2018. Possession of a pistol or revolver by a person under the age of 18, first offense.
  • August 30, 2018, possession of less than an ounce of marijuana, failure to maintain lane, driving without a license, and two counts of passing in a no passing zone.
  • Warrant served 5 Nov 2020 for a burglary that occurred on August 26, 2020. He allegedly removed a window AC unit and took electronics from an apt.
  • December 2, 2020. Battery.
  • May 25, 2022. These charges are still active—theft by taking, burglary. These are both felony charges.
Not a lot of specific info, but someone who comes across as hot-tempered and ready to turn physical.

Looking him up in Dekalb, it looks like he was granted bond for $10k on 9/1. A jail search still shows him in custody, though. As far as I could tell, searching Dekalb and Fulton court records, he’s not actually been charged with murder yet.

DEKALB COUNTY, Ga. — Family and friends gathered to celebrate the life of a 2-year-old found dead in a landfill in August Tuesday afternoon. The community and loved ones filled First Baptist Church in Carrollton as they said their last goodbyes.

J’Asiah Mitchell’s loved ones asked the community to bring teddy bears and basketballs to remember the lost child. With the toddler’s death capturing the hearts of many in the community, bouquets of the items filled the church in memory of the child gone too soon.

In an obituary shared with 11Alive, his family described the toddler as having a “big, beautiful smile” and “joyous energy.” He loved his scooter, playing basketball, dancing and loved to eat - especially chicken.

Pastor Cedric Duncan described pews full of the toddler’s friends at Tuesday’s funeral.
“So much of the community is broken. You can see tiny heads and feet throughout the pews. Those were little J’s friends and young relatives surrounded by older ones who cared for him,” said Pastor Cedric Duncan.

FULTON COUNTY, Ga. - A Fulton County grand jury has indicted an East Point man accused of murdering his 2-year-old son and lying to police about the boy's disappearance.

Artavious North is facing charges of murder, felony murder, first-degree cruelty to children, concealing the death of another, and abandonment of a dead body in connection with the death of his son, J'Asiah Mitchell.

*****
Asia Mitchell had a direct message for the father of her son: "I have no sympathy of what time [you're going to] have, what you have to deal with or the predicament that [you're going to] be in," Asia said.

Asia said while the indictment is a step toward justice for her baby boy, she won’t know closure until those charges result in a conviction.

"When I hear guilty, guilty, guilty, that’s when my smile and my relief is going to go," she said.

“We miss him. It's not the same. It won't ever be the same,” said Leriesa Mitchell, J’Asiah’s grandmother.

On Wednesday, Mitchell told 11Alive she wants to start a foundation in her grandson’s, or as she calls him, her "grandshine's" honor.

“Remember him as a sunshine, smiling, happy baby because he was,” Mitchell said. “And I know he's dancing in the skies.”

Mitchell said they still celebrated his birthday on April 23 this year. She hopes to include the annual Birthday Bash as part of the foundation she wants to start to help families who are dealing with tragedies, just like so many families helped them.
