They specify § 16-5-1(a) in the indictment, which means they are charging him with malice murder.

Darn.. I couldn't find 16-5-1(a) anywhere so I assumed that meant felony murder. Well hopefully they will be able to get capital punishment based on what you said.

Wonder why they couldn't prove felony murder? I know there was some guess earlier on these boards that the felony was rape.

This doesn't mean they couldn't prove felony murder, just that they decided to go with malice murder instead. There are a few strategic reasons for why theyy might've decided to go after one or the other, but you can't get both charges for a single person's death.

So the Indictment repititiously stated they do not know how or with what but that they think McD did commit her murder...............is that all you need for an indictment????? Does that mean they know NOTHING............STILL???
