Wow, Niner, thank you for keeping this case on your radar! I just came across it a couple of days ago and binge-read the whole thing. It is such a travesty that justice has been delayed for such a long time. :( Those poor beautiful kids deserved so much better. I hope each of the adults involved have experienced zero days of safety and comfort since their arrest.

5/19/25 Update: There are dozens of motions that have to be addressed before this case can move forward, which is why Monday was the first of three days worth of hearings this week. Many of the arguments in court Monday have to do with what types of evidence can be used at trial. Elwyn Crocker’s defense attorneys are attempting to stop the use of photos found on electronic devices at the Crocker home as evidence, saying that it’s unclear who the devices belonged to. The state has argued that they don’t necessarily have to prove ownership of a specific device to use it as evidence. There was also argument over which photos can be used at trial. The defense has argued that gruesome photos should not be used, and some should possibly be in black and white to prevent overwhelming the jury and potentially causing them to be impartial. The state has argued that admission of the photos into evidence is something that can be objected to at trial, rather than argued right now. Ultimately, prosecutors say they’ll discuss the autopsy photos with the medical examiner, to decide which ones are necessary to use at trial. The court also heard arguments Monday regarding removing the Effingham County District Attorney’s Office from the case. “A flagrant abuse of power and a flagrant disregard of law as it was, such that it rises to the level of prosecutorial misconduct,” said Jerilyn Bell [Elwyn's attorney]. The defense argues that the district attorney’s office didn’t properly obtain Crocker’s medical records through a search warrant, but a different judge’s order instead. They allege this is a pattern for the office. “This was not by mistake, this was not an accident, there was intent,” said Bell. Meanwhile, prosecutors acknowledge while they should’ve used a search warrant, this isn’t grounds for removing the DA’s office. Judge Matthew Hube also heard discussion over the usage of text messages between Elwyn Crocker, and two others who had been charged in the case, Candice Crocker and Kim Wright, as evidence. “The defendant made multiple statements to police that he buried his children in the backyard. That’s where they were. He talked about digging the hole and how hard it was. So, these messages all relate to that,” said Breedon. Judge Hube ruled to place a Department of Children and Family services report under seal. He has not signed any additional motions discussed at this time. Next Daubert hearing on 5/20/25 @ 9am.

EFFINGHAM COUNTY, Ga. (WSAV) — Three family members facing the death penalty are in court for a joint motion hearing regarding the 2018 murder of two children.

The Daubert Hearing began Tuesday morning, Judge Matthew Hube presiding. In this hearing, either party can challenge the admissibility of an expert witness.

The defense challenged the scientific methods used by Dr. Edmund Donoghue, former medical examiner with the Georgia Bureau of Investigation (GBI) Crime Lab, when determining the deaths of Mary and Elwyn Jr. The defense teams implied that Donoghue relied on hearsay.

According to Dr. Donoghue’s findings, Mary died from starvation and her death was ruled a homicide. The medical examiner determined Elwyn’s Jr.’s death was caused by homicidal violence, but he was unable to say exactly how it was done.

Mark Wright’s attorney, Allan Sincox, said Dr. Donoghue is offering opinion and should not be allowed to testify as an expert witness in the upcoming trial. Sincox claims the examiner relied on outside sources to reach his conclusions.

The defense also challenged whether the expert testimony of Dr. Alice Gooding, a GBI forensic anthropologist, is needed in the upcoming trial.

EFFINGHAM COUNTY, Ga. (WTOC) - The last of three days of hearings in the Crocker case this week wrapped up Wednesday morning in Effingham County.

The defense has some time between now and the next hearing to go through the crime scene and autopsy photos, to argue what they think shouldn’t be shown to the jury.
