defense atempting to illustrate that while at home with the children alone as LS was off trying to secure more drugs on 10/4 he was in charge of the children while under the influence of several drugs (pot and coke)

  • #202
defense attempting to show in initial statements to LE DY saw LS and claimed to have seem Q at 3 am (after she got home from the trip she took to dump Q's body)

  • #203
now suggesting that DY is the one who often did the trash runs (which was usually placing their household garbage in the dumpster that Q was placed in)

  • #204
He's so genuine when he apologises to the judge and the court reporter when he and Hilliard talk over each other.

  • #205
Recess after the Defense asked about custody of his daughter now. DY didn't want to answer. He still does not have custody now.

  • #206
I can't stand looking at her angry scrunched face as she listens to DY testify. court is in recess.

Well, I think Hilliard tried his best to make DY look bad, but DY, through his frankness in both initial testimony and cross drew the sting. He was honest about his substance use, that the substance use didn't make him as good a parent as he should have been, and that his memory for certain events was not great. But he was firm under cross, especially, and didn't let Hilliard twist him in knots. His uncertainty of the answers to some questions didn't come across as deceptive, just as explicable given the time that's passed and his lack of sobriety at the time.

After all that has happened BH had the nerve to file for custody of the two remaining children. She shouldn't be allowed to care for a goldfish. JMO

Billie Howell, the mother of Leilani Simon, is now petitioning for custody of Simon’s two living children. Simon is the Chatham County woman accused of killing her20-month-old son Quinton and hiding his body in a dumpster.

Dean is doing redirect, now.

Clarifies that they stored the cocaine in a closed cabinet on a high shelf, out of Quinton's reach.

That makes me so mad that she did this  Probably why DY was becoming angry when being questioned about the (current) custody of his daughter :|

Dean and DY are having to be side by side. I think there's some confusion. DY complained during cross that this packet of printouts of text messages were out of order. Dean and DY are literally having to ensure they're on the same page.

They're going through DY and LS's texts the late evening of the 4th. She took off to go to 204, he told her okay, be safe, he was waiting up for her, but she didn't come back immediately like she said she would. He sleepily texted her for a while, and then fell asleep.

what the jury won't get to know but we do, is that is because she was off hooking up with her coke dealer that night, probably in trade for said drugs, which to me at least, explains why she was so lit the next afternoon still (JMO she got an 8 ball)

State's exhibit 10 (pillowcase with vomit smell) being shown by state. DY doesn't recall that vomit being there on the evening before.

Youngkin is excused after a brief recross.

Next witness: David Mullin(?)

He's the supervisor from the warehouse DY, LS and PS worked.

defense now returning to the fact hat DY was alone with children while LS was on her little drug run and scoffing at the idea that DY was a "responsible" coke addict and that he was on drugs while alone with the kids that night. the implication being made IMO is that DY should not be believed and that he could himself have done something to Q.

She does allot of that.. so far no tears even when viewing the bones from the LF.

I liked his response to that, very firm, that he never said he was a 'responsible addict'.
