Best I can figure is that Hilliard is trying to establish that Leilani never admitted to harming Quinton even during the wire tap, that Danny is an unreliable witness because of his own drug use and that Leilani may have been too high that night to remember things accurately and/or may not remember if she harmed Quinton or if someone else did.

Sound right? I really don’t have a good bead on defense strategy yet.

IMO, the defense is targeting DY in any way they can. They attempted to impeach DY's statements through this last FBI agent on the stand. They are doing all they can to get the focus off of LS. And, they are failing. Especially since the judge has allowed the two 'new' witnesses to come forward. Their case is sinking.

They've been suggesting DY as an alternative suspect from the beginning, but the problems with it are pretty numerous. LS just has too much stacked against her, both actions and words. And it doesn't help the defense that DY came across very well on the stand. He presented as honest, open, and with no rationalisation of his own damaging behaviour. As I've said, I think he's been working on himself. I think he's been making the effort at recovery, and it shows.

We're back, I'm up to the correct time, now.

There is an exhibit being discussed, now.

It's clearer pictures of Quinton's remains, in a binder, for the jurors. The prosecution don't want to publish them on the screen.

  • #705
Hilliard is objecting to individual binders. Saying it is going to inflame the jury, that that is the aim of the prosecution.

  • #706
Saying that it's cumulative, duplication.

Prosecution points out that these photos are different, that they were taken in Savannah, unlike the pictures shown earlier, which were taken at Quantico. So they're not duplicates.

And Leilani sits there, expressionless. Grr.

  • #708
We seem to be dithering about the number of binders. I think Hilliard's objection is woolly, but IANAL.

  • #709
I don't see how this couldn't be solved by instructing the jurors to open and turn pages on cue.

Judge Stokes referees in a genteel southern way. Can Leilani see herself on a courtroom monitor?

I don't think so. I think the monitors only show exhibits.

10 min recess while Judge Stokes considers the proper ruling on the binders.

No, the equipment is behind her and the monitor is covered. I think. She sees exhibits only.

I still love how the judge says 'bless you'.

Not to the OP, but to websudoku.com Hillard is saying:

I think the jurors might be inflamed by the senseless murder of a child and how he was discarded.

Thank you!

I'm trying to listen along and comment, while also following the Delphi thread which is flying right now, and then my indoor cat got outside and I had to try and catch her, so, chaos and confusion for a good five minutes here.
I'm also following both trials at once. Confusing doesn't even cover it. LOL

Yeah I don’t think trying to point at DY is going to help. Mind you we saw him after two years and what appears to be a big effort to clean up.

At the time of the murder he was messed up from drugs and alcohol. Still, he was clearly the main caregiver of the kids, as testified by several witnesses. And we saw the video of him rushing out of work when Leilani called him.

So I don’t really see the jury being swayed by the possibility of anyone except Leilani harming Quinton that night. And I also don’t think they’ll see her drug fuddled condition as any sort of mitigation.

If it walks like a duck and quacks and gestures like a duck then it’s Leilani…

We're back.

She's asking them to remove any non human bones or duplicate photos from the binder.

She's also asking them to be removed from the binder.

  • #719
Prosecution is pointing out that it would be impossible to remove all the images containing nonhuman bones because origin was not determined until they were taken to Quantico.

  • #720
They're going to admit all the photos as an exhibit, but only three or four will be shown, and not to the cameras.

I think this is a good compromise.

Victim/remains photos are always contested.

As I said to my partner, it's always a negotiation, and they never admit all of them but they never admit none of them, either.
