Cross. Hilliard asking about the 5th.

Asking about how long Lemmons was on scene (an hour), and how long LS, PS, and DY were at the police station. They were there for thirteen hours.

They talked to LS almost every day on the phone.

LS was interviewed on the 8th and the 12th at the FBI building for about two hours each time.

8th to 9th was the hotel tap.

From about the 8th for about 60 days, they tapped DY's phone.

October 31st interview, FBI building, two hour interview.

November 21st, arrest interview, FBI building, three hours.

On cross with detective Lemmons Mr. Hilliard once again is trying elicit from her agreement to his statement that everyone reacts differently. Sigh. I think it’s because Leilani was so over the top in her reactions that he needs to negate the obvious, that she’s acting like a guilty person.

Hilliard asked the detective to name the type of interrogation she used during interviews. Lemmons answered that she didn’t have a specific name/type of method, just that she would keep asking questions until she got answers.

He’s also once again pointing out that Leilani has never admitted to harming Quinton.

The state rests.

Omg I cannot believe she is taking the stand. Or is she? Jury is still out.

Edit: She is not testifying.

Asking for the name of her interview technique.

She says she doesn't have a name for it, she just wants to get the whole story and just asks questions until she gets it.

Hilliard is harping again on 'appropriate' emotions and judging. That they focussed on LS because she didn't conform to her expectations.

He's basically implying they didn't thoroughly looking beyond LS. She's calm and refuting that.

He's pushing that LS never confessed or admitted to killing Quinton. And that his manner and cause of death are not known.

He's saying that her having an opinion about how Quinton died is not evidence.

The state rests, subject to confirming all the evidence/exhibits have been entered properly.

The jury has left.

Motion for directed verdict for acquittal. I think this is form, everyone does this.

  • #889
Dean argues that they have presented a solid case, basically.

Both prosecution and defense have argued that their medical examiner testimony supports their position.

  • #890
Judge finds that there is sufficient evidence and the motion for directed verdict is denied.

Hilliard’s associate asks the court for dismissal. He went through each charge and argued that the entire case is circumstantial, based on speculation and hasn’t successfully excluded all other possibilities.

Mr. Dean countered that the state has presented sufficient evidence based on both circumstantial and direct evidence that the defendant is guilty. He challenged the defense’s arguments. He said there are only so many ways to die and state excluded all except an intentional act of violence that resulted in Quinton’s death.

Judge goes through her rights to testify or not, makes sure she understands and that it is solely her decision. That her decision not to testify cannot be held against her. That if she chooses to that she can be questioned by both sides.

LS declines to testify .

Defense makes doubly sure it's her decision and not coerced at all.

She steps down.

Never mind. Bah. I got excited for a moment, lol.

The defense and LS are having a ten minute break to confer.

So she said she wanted to after she said she didn't and now they are telling her why she shouldn't? LOL

I don't think so, she firmly said no on the stand.

I think it's more about witnesses to be called and approaches with them now that's the state's case has rested.

I wonder if defense will call grandma Billie Jo.

It’s going to be interesting to watch the defense's strategy IMO. So far her attorney has really pushed the notion that Leilani’s intense reactions during interviews aren’t an indication of guilt but rather her unique way of dealing with grief and stress.

Edited to reflect that the defense just rested. Shocker. No witnesses no nothing except closing arguments. Wow!
