It happens.

To be honest, I don't know who they could put on besides BJH, and things could come up on the stand that might make her family court case harder, IMO, so I can see why she wouldn't want to be up there.

You don't, but I honestly don't think she could have had much better defense from her counsel. I mean, yes, Hilliard opened the door and let the affair stuff in, but that was almost inconsequential. The most damning stuff came out of the defendant's own mouth, in her multiple interviews. Where he could defuse or throw doubt on a witness testimony, he did, and did as well as he could. He just didn't have a lot to work with.

And if he's strewn enough doubt in the mind of at least one juror, he could yet win the day. I think that's unlikely, but jurors are people and people are unpredictable.

There were both he and she pronouns in the document, I think, and it was said that they would all be made regular, and I think she said she didn't care, but I could be wrong, it was done minutes ago now.

It's because a lot of the language is essentially cut and pasted and then tidied up later.
