Judge Nap says authorities may be hoping for 'compromise verdict' in Rayshard Brooks death case

A taser provides 50,000 volts so is it deadly force? That is the key according to Judge Nap.

"Brooks was shot Friday night after resisting arrest following his failure to pass a field sobriety test. Shortly before he was shot, Brooks grabbed one of the officers' Tasers and pointed at them as he tried to flee the scene.

Napolitano told host Neil Cavuto that a jury would have to consider whether Rolfe thought his life was at risk when Brooks fired the Taser.


"A trial judge will tell the jury that if a police officer thinks that deadly force is aimed at him, and if his thoughts are reasonable -- even if it's a rubber band and a paper clip, but he thinks it's a deadly force -- then he is justified in using deadly force ...," he said. "All officers know that Tasers produce 50,000 volts of electricity. That's enough to stop an elephant. It's certainly enough to kill a human being.

JUDGE NAPOLITANO SAYS IT WILL BE HARD TO PROVE 'MURDER' OF RAYSHARD BROOKS BY POLICE

"Whether they're characterized as deadly weapons or not, the judge will tell the jury, if the officer reasonably believed it was a deadly weapon and reasonably believed it was aimed at him, he was justified in using force," he went on.


"The second thing the court will tell the jury is, when cops at a scene are faced with choices between life and death, the life of somebody who they think poses a threat and the death of themselves, they are allowed to make that decision in favor of defending themselves. So again, the test here is not what a reasonable person would think, but what a reasonable police officer would think."

Is the video from Wendy's the one clearly showing Brooks pointing the taser before being shot?

If it is, I wonder if that is the reason Wendy's was torched, to try and destroy video evidence. MOO

I think Wendy’s was torched because they called the police.
Im not sure those rioters that destroyed and burned Wendy’s were smart enough to think about the video. MOO

Revealed: officer who killed Rayshard Brooks accused of covering up 2015 shooting

The Guardian really has it in for the Atlanta police. Anyone know if this is true? He won't get a fair trial with reporting like this.

I believe that a bench trial, with a judge is the best option for the officer here. Any other option would just be a lynching mob.

This officer's life has changed, no job, probably not eligible for unemployment. Not sure if he has a family. Sending him a blast of positive energy.

The two white women suspected of starting and accelerating the fire might have simply seen it as an opportunity to destroy something. IMO, I really don't think they cared one way or another about what actually happened between RB and the LE.

And now apparently the rebranding is his video interview where he admits his crimes but blames the parole system for not having a mentor for him (CBS)

Isn’t the parole officer somewhat of a mentor? Checking on them etc? I don’t know anything about the parole system so perhaps there could be a mentor program set up and the DA could be one as part of his public service?

People on parole or even probation are supposed to check in with parole/probation officer usually in person at an appointed date and time. RB failed to notify his parole officer that he moved out of state to Ohio so an arrest warrand was issued. The GA police were sent to pick RB in Ohio on January 6, 2020. It's discussed on an earlier thread. It's my understanding that violation of parole charges were dropped. They cut him a break. Maybe they were happy he moved to Ohio and they wouldnt have to deal with him IMO. Then he showed up in GA last week at drive through line of fast food restaurant showing officer his Ohio drivers license and saying he lived in N.C. Yep, it's everyone's fault but his.

Let's just say I'm not thrilled to be living just north of Atlanta. Police officers walking off the job and a recent threat of burning my hometown to the ground leaves me wanting a firearm for the first time in my life. :/ I'm really worried about the results of handling this case. I sent my father a note to tell him not to go work in Atlanta today since most police officers aren't working.

It doesn’t fit with the story line. It sure wouldn’t appease those they are trying to appease.

Sigh. We are once again experiencing a false narrative purposefully putout by a very shady DA. Like always he knows the MSM will be his supporting national platform like they have done in every case of this nature where only one side is allowed to be told over,and over again.

He knows if he says it often, and long enough his mistruths will be thought to be true, and factual. He knows the MSM will run with what he said. Its a sickening game that has long been played by others, and fully supported by MSM.

Other very important facts were purposefully omitted to fan the flames by Howard.

Its appalling really that such a shady DA with his own serious baggage gets to decide to ruin someone else's life wanting to take their freedom from them, and even possibly their own life.

That's why he threw so many other charges in. It's those aggravating factors that makes it felony murder. Felony murder is when someone is killed while the defendant is committing another felony at the time.

So Howard wasnt satisfied with just some type of homicide charge. He wanted this officer to lose his life.

Howard, found the officers guilty before a trial is even held. Have we ever heard another DA gleefully try their case in public? Why did he decide to do such an unethical act? Imoo to taint the jury pool before all of the factual evidence is revealed. That's why Howard had to get ahead of the evidence he knows will be revealed by the defense attorneys.

He knows what people hear now will stick thinking all of its true. Unfortunately, there are so many gullible people who will do just that too ..without ever wanting to find the actual facts for themselves.

Imo, millions who are anti-cop will believe it right now without PH having to prove any of it BARD.

We've seen this play out for years leaving many cities in ruin because of the anti-police mentality. No one waited for the facts in evidence to become known.

Sometimes it makes me wonder if this is why they act prematurely, and immediately because they DO KNOW ALL of the evidence, and truth will become known. No matter how many try to suppress all of the facts at any given time the truth always comes to light. So in the meantime, cities lay in ruins with the horrific damage already done because no one was willing to wait for the facts. It's like the violent rioters, and felony criminals know they have to react immediately before the truth of the matter DOES comes out.

How in any way is that a search for equal justice?

If it is then why dont we ever see other races ..who's family members have been killed by LE ever act this way? How is acting out so violently seeking justice?

Imo, it's just a ways to act out violently against innocent people who are completely blameless having nothing to do with anything.

It doesn’t appear there was a cover up. This article was dated in 2015 and explains why the officers fired.

“Atlanta police say 40-year-old Jackie Harris used a Ford F-150 to try to back over several officers near Jonesboro Road and Moury Avenue around 5 a.m. They say he rammed into a yellow pole and gas line, then backed up twice, aiming at several police officers who were commanding him to get out of the vehicle.”

Officers open fire on driver who tried to run them down

At 4:26 in this vid you can clearly see the other officer limping as the attorney claimed. First time I saw him limping.

This is what I heard, through all the sham speech and circus of the DA's presentation yesterday:

"Hear ye hear ye! All people of Atlanta! Carry on with the reckless and lawless behaviors! Continue to disobey orders and instructions! I have your back! Your voice will be heard!"

Here is another article about the 2015 incident. It seemed multiple officers fired and the shooting was reported, even though it wasn’t added to the initial report. One article noted the name of the officer who wrote up the report. It was not Officer Rolfe.

“At that time, there were a number of officers in the street,” O’Connor said. “He could have struck several of those officers. They then fired their weapons to stop what they viewed as the threat of the truck that was coming at them.”

If that dude didn't know why he was being arrested.... :rolleyes: He had already begged officers to let him call someone for a ride. Plus, he had just done a field sobriety test and had blown into a breathalyzer. Quite confident he knew why he was being arrested.

They are REALLY grasping here. :eek:

I was surprised when I watched the NY Times sequenced video Rocco, that the officers spent that much time talking before attempting to cuff RB. Where I live, RB would have been at the station being booked within 15 minutes or less. RB's demeanor before the attempted hand cuff and his violent behavior after shows how quickly his demeanor can change. No one's talking about that. Why not ?

having seen the moment of impact from the start of Axon cop camera POV, they are with RB patiently talking to him for 29-odd minutes before he lashes out.

for those fellow ‘Cops’ viewers, their superior officer comes before the handcuffing/arrest even takes place, which I find a bit unusual, but more in Brooks’ favor than it is not.

I agree that is quite patient on the part of the police.

Nearly $200K raised for officer charged with murder in Rayshard Brooks’ death
Update 6:47 a.m. EDT June 18: Thousands of people are stepping up to provide support for the former officer charged with murder in the death of Rayshard Brooks.

According to WSB-TV, more than $180,000 has been raised for former Atlanta police Officer Garrett Rolfe’s legal fees, according to the Georgia Law Enforcement Organization.

The nonprofit organization said the “fundraiser is designed to help Officer Rolfe and his family to pay for legal services and general necessities.”

The organization told WSB-TV that more than 2,000 people have donated to the fundraiser.

On Wednesday, Fulton County District Attorney Paul Howard announced 11 charges against Rolfe and his former partner, Officer Devin Brosnan.

The Georgia Law Enforcement Organization believes the charges against Rolfe are political.

“Officer Rolfe was involved in the justified shooting of Rayshard Brooks on June 12th, 2020, and he is being used as a political pawn by the district attorney and has been charged with murder,” the organization wrote on its website.
