The ruling, made in Canberra, will see the nation’s highest court examine the case at a hearing in front of five of seven judges within about three months. Special leave to appeal is granted only rarely...

The Queensland Law Society immediately released a statement headlined: “QLS supports decision of the High Court in Baden-Clay ruling.”

“Those judges are ably assisted by exceptional and highly ethical solicitors and barristers, and the community can be confident that this decision represents the best interpretation of the law, unaffected by bias or the relentless press of the 24/7 media cycle,” law society president Bill Potts said...

excellent news this morning. One of the nicest things this year, really, is that Gerard wasn't released on bail or recognisance while this matter ground it's way up to the High Court, locked away in his cell waiting, waiting, waiting... like everyone waited to find out where Allison was... and now it's very interesting indeed that the HC has decided to hear the appeal. Which means, to all intents and purposes , that there is something in the appeal that the High Court has found to be in the public interest to go over with ye olde fine tooth comb. That the downgrading has whiskers on it , somewhere, and the matter needs further application of legal scrutiny.


So far, so good. A hearing to shed light and heat on that previous decision is a very big deal and while the final decision cannot be taken for granted, a hearing in the HC is quite big bananas and for those to whom a torte is the stuff of dreams, this HC hearing will be the occasion to hear the arguments against the downgrading in detail, as well as the arguments for, which, no doubt will be interrupted regularly by cranky High Court Justices should anyone attempt high flying hyperbole and fictional projections.

And naturally, this decision to grant a hearing must be a bitter , heavy blow to the Gerard-adoration Society... ... Gerard was a cigarette paper 's width away from being released with his reputation somewhat improved, and this , to all sane thinking peoples , is awful to contemplate. Looking back over it all, it has all been a tortuous journey for Gerard.. the long wait for the inevitable arrest, the very very long wait in Remand, far longer than I expected, but I liked it, the trial itself, the verdict of his peers, and all the shame and disgust that followed, imprisonment, the teasing little bounce when this latest decision re the downgrading occurred, and now, the biggest hurdle of all for the exhausted and murderous Gerard to jump over.

God alone knows how much this is costing, and who is paying for it, and with what. That must be an interesting story in itself. Even if Bwana and the Mrs sold their home and put the funds in, that would have long ago been absorbed.. This takes Gerard and his legal team out of the homey atmosphere of Queensland and into the terribly indifferent corridors of Canberra where any favours or 'prestige' one might carry in Brisbane are swallowed up by the weight of the Nation's High Court Justice system, so ..... buckle up, Gerard.

Yep, bet he punched the wall when he heard. It pleases me to think of him stewing for another three months. Heaven only knows he got a light enough sentence in the first place; it was such an outrage to think of it being reduced, and, as you so rightly point out, with his reputation given a boost, as though what he did was somehow less dishonourable when it's given a different name. I just hope they get it right next time.

Statement from Attorney-General on High Court Baden-Clay decision

The High Court in Canberra has this morning granted the Queensland Director of Public Prosecutions special leave to appeal in the matter of The Queen v Baden-Clay.

As this matter will now progress to a full appeal hearing before that Court it is not appropriate to make any further comment at this time.

A spokesman for the High Court says it's likely the matter will be listed for hearing by Tuesday.

Allison's parents, Priscilla and Geoffrey Dickie, were not present but released a short statement to the media.

"The family will not be commenting on the matters before the High Court today. We appreciate your continued respect for our privacy," the statement read.

Allison's cousin Jodie Dann was in the High Court when the decision was announced.

Ms Dann, who has worked as an anti-domestic violence campaigner for more than a decade, told 9NEWS she was happy about the ruling.

"I'm pleased with the decision, I think it sends a clear message that domestic and family violence can't happen in Australia," she said.

"It's worth it if we get the right result in the end, and justice for Allison."
