I hope Judge Mazzei lets the Geno/Nuclear DNA evidence in as evidence knowing that if RH is found guilty in one or more trials that his defense will appeal and whether the Geno DNA is let in or not the state's Mitochondria DNA will probably be #1 in the appeal.

Once a couple divorces, a former spouse can no longer invoke the privilege to avoid testifying in a criminal case, and the other spouse cannot assert the privilege to prevent that testimony from being admitted into evidence on the basis of the privilege

The marital communications privilege applies in both criminal and civil cases. It only covers communications made during the marriage. Unlike the spousal testimonial privilege, this privilege does not end when the marriage does. Either spouse can assert the privilege long after a divorce and prevent the admission of testimony pertaining to confidential statements made while the parties were married.

During divorce proceedings, a spouse cannot invoke the marital communications privilege if it relates to allegations of child abuse or neglect. New York Family Court Act 1046(a)(vii). Similarly, allegations of domestic violence will prevent the privilege from being invoked by the spouse accused of such conduct.

I have no idea which came first and I've had similar questions to the relationship.
MM organized the fundraiser for AE and when it was news that AE signed with Peacock MM closed it down.
Or did MM figure AE had enough $$$ now so no need to ask for more ?
I was curious, and hoped that MM found AE's move unconscionable and/or it could reflect bad on her?
MM also could have found AE's publicly defending RH an over-reach for her.
We don't know what MM may think about RH because the state has some mighty damning evidence against him.
I also wondered if MM will be appearing in AE's documentary?

Isn't that quote useless without dates of when Wells said that? Knowledge in the DNA field has grown remarkably since the bodies were found. It is still in perhaps not infancy, but at least not past the toddler stage with continuing advances.

If the article accurately shows the testimony and IF the prosecution doesn't have much better witnesses, I'm thinking this will be a win for the defense. Too early to call really, but the opening witness felt weak from the way I read the article.

Curious if the state had documentation from other cases where DNA testing was successfully used on hairs in the same condition as those found on Heuerman's victims?
We don't get a lot of information when reporters are the only source and we're used to televised court hearing and trials.

He also appealed on the basis of ineffective assistance of counsel in 2005, which was denied.

EDIT: If you search his name, Timothy McDaniel, on this website, you will see that he was paroled in 2022. Tina's case is definitely solved.

I find it extremely odd that part of "Peaches" was found in Hempstead Lake State Park, 20 or so miles away from Gilgo Beach.

Other parts found at Gilgo of "Peaches" were found the farthest away from her baby, farther than Amber Costello (the most recently killed found at Gilgo).

Baby Doe was found very close to Jane Doe #6, now ID-ed as Valerie Mack. Maybe "Peaches" and Valerie Mack knew each other?

The settlement was reached on Thursday, March 27 but it still needs to be finalized by a Suffolk County judge, ABC News reported.


"This has been in the works for the last couple years," Ellerup's attorney Bob Macedonio tells PEOPLE. "She needs to move on with her life for her and her children. She realizes that."


Macedonio says Ellerup is "withholding any judgment on the guilt or innocence of Rex until the conclusion of the trial. She still maintains the position that the man that she was married to for 29 years was not capable of committing these horrific crimes."

IMO:
Pondering the 3 belts found on the body of Maureen Brainard-Barnes.

We've been told by Ray Tierney that only a small percentage of the evidence they have against RH has been made public.

There's the "WH" and "HW" initial belt and we know that RH's G'father had the initials "WH".
A hair of AE's was said to be found on the buckle and DNA confirmed, according to the prosecution.
I would think that LE has spoken to RH's relatives about this belt and was it handed down to RH through his father and/or G'father?
I don't expect RH's brother to have been forthcoming with any info about recognizing the belt.

Two other belts were found and even assuming that RH wore protective gloves his old fingerprints or part of them and his DNA and AEs could also be on these 3 belts.
There is the element issue that would effect this evidence.

The initial belt/belts have taken a Media back seat compared to the other evidence we know about but I think the initial belt especially, if allowed to be entered as evidence could play a big role in the state's case and with the jury.

There are cousins who were close with RH and called him "our Dear Rex" he organized family reunions etc.
