The CBS version:

Did Brown cite what law?

"The defense immediately challenged the judge's decision, claiming it violates public health law.

"The judge will rule on that challenge on Sept. 23."

Daughter of #Gilgo victim #MaureenBrainardBarnes was in court to hear #DNA decision in case, along with cousin of Jessica Taylor and Maureen’s sister, Melissa Cann. Rex Heuermann’s hair was allegedly on surgical sheet placed under Jessica’s dismembered body.

@RayTierneyDA⁩ reacts to media question about the task of picking an impartial jury, if the #RexHeuermann #GilgoBeach serial killer case goes to trial. We should get a better idea of a trial date in late September.

Rex Heuermann’s attorney, Michael Brown, insisting the accused #GilgoBeach serial killer, #RexHeuermann, won’t plead guilty. Brown filing a motion claiming admission of nuclear #DNA evidence violates NYS Public Health Law, because lab not accredited in NY.

Decision on defense motion for separate trials in #GilgoBeach case could be made by September 23rd. #RexHeuermann’s attorney argued putting 7 victims together in one trial could have unfair “cumulative” effect, kind of like “where there’s smoke, there’s fire.”

Today most definitely a great win for the prosecution! :)

That answers our question - he is challenging the ruling right now (as opposed to having to wait until after conviction, which I thought).

Go ahead and challenge, RH, ..and get swatted away like a fly.

It really blows my mind that his wife can continue to claim his innocence given the hair situation. I tell you where me and my family's hair isn't: on homicide victims. Anywhere.

A judge in the Gilgo Beach murders case ruled Wednesday that cutting-edge advanced DNA testing can be used in Rex Heuermann's upcoming trial on Long Island. CBS News New York's Jennifer McLogan reports.

I found what I was looking for about Brown's motion saying this DNA evidence violates Public Health Law.

He claims it's because the lab that performed the DNA testing is not licensed in NY.

Does Brown & Co actually believe RH's denial?

"Heuermann has denied it all, and wants to go to trial.

"There's no plea deal. There's no plea. I stood in front of you folks from day one, we are preparing for trial," Brown said".

It's possible that if all the defense's tactics pre-trial are unsuccessful, he will do a last-minute plea like Kohberger.

But, my hunch is, Rex does want a trial with the hopes of tripping up the prosecution. Good luck.

I get that Brown is doing his job looking for everything legal wise to get evidence thrown out, charges dismissed etc but in the meantime he has to converse with and be a buddy to and encourage a guy who has to be one of the most evil forces on the planet.

How Brown can look at the magnitude of evidence and know what was done to these young women then stand before the media with a straight face saying that his client said he didn't do it is mind-blowing.

I agree. I think he is a true narcissist. The smartest person in the room who will get away with it because everyone other than him are incompetent. IMO.

He's a loophole guy...he can go around and around...he's a normal husband who eats his wife's cooking. he doesn't know any prostitutes...he will enjoy making titillating and provocative statements for attention or to get an audience after he runs out of appeals and prayers.

would love to see him locked up with some good ole boys in SC ! mOO

I would be surprised if they don't all want a trial.

For the attorneys, it's an opportunity to try the biggest case of their lives on a world stage. It will rocket their careers and lives into a whole new plane.

For Heuermann, knowing he is known and being discussed likely around the world? catnip for the ego. Plus, I suspect he is "assisting" the defense team extensively. It will be interesting, during the trial, to see if any of the "games" played by the defense have hints of some of RH's previous behavior.

Cynical as it sounds, a trial seems to offer so much to so many of the players.

BBM:
Not when RH is sentenced to 7 lifetimes w/o parole and people remember Brown & Co. fought, then fought some more to have RH set free to once again mingle with humanity and purchase some new burner phones.

Here we go!
Good News!
May the sword of St. Michael fall upon the serpents.

Rex, I have a feeling he'll never confess, he'll always look for a way out, and he doesn't strike me as someone who's giving up, given the stories that have come to light...

Can I say that your ex-wife has never convinced me at all?
better not say anything else...

I can't wait for them to officially link other cases!
For me one of the biggest cases with unprecedented dynamics of the modern era.
We thank the call of SG and the indomitable mother who revealed Pandora's box for all this. We hope they too can have justice one day, whatever it may be.

He got away with these murders for so long. He probably felt invincible and maybe still feels that way. Perhaps he’s more like Richard Allen, who is still protesting his innocence after a showy trial.

Reality will set in eventually. This latest news on the DNA ruling is very good.
