I can't wrap my head around this claim by the defense.

Once you toss something into a public garbage receptacle it's considered abandoned property so I don't get where the defense is coming from with this "privacy laws" violation.

Actually, I do kinda get where they are coming from in general, although not in this case in particular.

For example, as the tech gets cheaper, do we want the govt or a company to be allowed to just keep a data base of who throws out stuff anywhere without a warrant?

I would think there is room for setting parameters to check the DNA on discarded things. I don't think we want a world where ICE, for instance, could start testing spit from discarded beer cans that were in the hands of people they deemed suspicious.

On the other hand, Rex was being followed because he was a very viable suspect of murder. That strikes me as a good reason to do what was done.
