Baez: "...all that she is charged with is child neglect and until we see some evidence otherwise I'm going to err on the side that this child is still alive."

'err' is probably not the word he really wanted to use here, but it was a good choice nonetheless.

Which is why I get myself in trouble...I talk 100 miles an hour..I could NEVER make it as an attorney..NEVER.

Me either, and I'm a horrible liar. I can't even keep a Christmas present a secret...ask my husband....:blushing::eek:

I just wish Greta had said, "How the frig can you people relax when Caylee is still missing!?"

I think he's just hanging out today, trying to set the ground rules and making sure they behave a little. and getting his face on TV to start the defense/PR rolling.

Does anyone know if it is legal for LE to put some bugs at the Anthony home and not tell them? IF it is do you think they have done that?
If they can get a judge to authorize it, they sure could.

And the last thing they'd do is reveal it to anyone who ever steps foot in that house. I'm sure Baez has warned them of the possibility that listening devices may be in play.

For the legal minds here, let's say the house is wired and that a bug picks up a conversation between two or more people that can be interpreted as them 'getting a story straight' about whatever the next Anthony Family Players performance is going to be.

Would that be enough to get the participants charged with offenses against RICO statutes if LE eventually charges Casey in connection with the death of her daughter?

Good one. I didn't catch that.

Jose Baez.............they just finished having dinner and will have a relaxing night at home. Tomorrow they start work, retracing steps.......working out the defense and looking for the child. Finding Caylee is her best defense. Now that she's released, they're comfortable talking. He thinks they were being taped in jail. He's convinced Caylee is alive.

Greta pointed out a lie Cindy told. Baez side-stepped that. He thinks the lab results are back and they're withholding. He's playing middle of the road.

They are not LEGALLY alowed to tape attorney/client meetings in prisons. NOt saying some don't. But you are supposed to have the right to legal defense per the constitution, and you are also allowed to not incrminate yourself. Taping would destroy the attny/client confidentiatlity.

wish I could read Greta's mind, there was something about the way she closed with Baez, somber-like.
That is how I feel after watching this. No one she interviewed mentioned Caylee. She had to ask. Their first thought was of Casey and her comfort and defense. I feel a real sadness for that little girl tonight.

I'm with you too, and the only thing that makes sense is she's on house arrest and she can't go to his office without permission so maybe that's why he's seeing her at home? I'm trying not to think there's anything else going on!! :)

It's not the amount of time he's spent with her that sends me red flags...this is a high profile case and I'm sure she is a high maintenance client, it's his language and terminology that seems suspect, almost purposeful...there is just no telling what these 2 have drummed up

I think Casey is going to walk too. Hate to say it but I do. I really really think if LE had ANYTHING AT ALL she wouldn't be home right now. I also think Baez is smart enough to do a deal on these neglect charges and get her a low jail amount. I think she will get a little jail time. Maybe 6 months and thats it. I tend to doubt it will go to trial.

I missed that - like what do you think it means? I think these 'heads' are coming into the conclusion that she may very well WALK. :furious:

Is it normal for the defense attorney to basically live with the client to ensure they never speak to LE or anyone else??

Seems odd to me? or is that pretty common?
What is he protecting so much aside from casey's guilt..... :blowkiss:

Is Baez a public defender? He must be getting paid a lot to spend all of his time on one client, including practially living with her. Though I'm sure it would be hard for him to get other clients right now.

IF police could listen in legally, and heard people planning false testimony, yes, they could charge them with a crime eventually. If you heard them making stuff up, then they came into court and said it, it would be perjury. That's a big if, though.

All they have to say is she has received too many death threats to be outside with strangers. Most likely the truth.

but as cindy said at one time she would do anything for her daughter and what she is doing will win her MOTHER OF THE YEAR AWARD. so that is just a risk a mother would take and after all she didnt do anything wrong and she wants to hold her head up high!!!!

yes, when he sees the replay he will definitely be sorry he used that term, probably already is kicking himself for it

Okay question..I was typing and not listening..so does LE by law HAVE to tell the defense when the DNA test results are back? He was saying something about them still being in the scope of "discovery" is there like a time limit or something? Utterly confused here.

No they do not have to tell him. If DNA was back that lead to further charges he wouldn't know at this point..and won't know until the GJ brings in charges to hold her on capitol murder. That's my feeling that the prosecution, meaning the DA will go for Capitol Murder once the results of all the forensics are in ..and other evidence ..such as friends, etc testimony. Then he still will not know any of the evidence until he files motions for discovery of the evidence.

The prosecution has until November, her next hearing on these current charges, to come forward with more concrete charges through the GJ if they want to follow through with that route. That means they have time to get everything right and in order. After she is charged with murder, not before , the defense can and will file motions to see what cards the prosecution is holding. To me, the defense talking about the DNA at this point leads me they believe further charges will be coming....otherwise they wouldn't even discuss the DNA.

I agree with that lady on Nancy Grace tonite that said that she feels that LE was hoping to get a deal with Casey after she sat in jail a long time to show them where the baby is and they wouldn't charge her with the death penalty. The lawyer said thats all off the table now. It will never happen. LE is holding back not having anything and thought she might crack but now she is home safe and sound. No reason to ever say a thing.

You are exactly right....slow talkers, time to think, spitting out "mistruths"

Have you noticed how LP mumbles answers to hot questions? Almost like what a 5 year old would do when they are lying.
