***GUILTY*** Mark Sievers - APPEALS HIS DEATH SENTENCE Oct 13 2025

Sievers's hearing is expected to last all week.

During the hearing, a judge will consider six points that the defense team has brought up from the trial in court documents including:

  • Claim 1: Newly discovered evidence not previously presented at trial undermines the confidence in the verdict
  • Claim 2: Failure of a qualified attorney in the case
  • Claim 3: Sievers was denied his right to a fair trial and due process because of ineffective assistance of counsel during guilt phase
  • Claim 4: Trial counsel provided ineffective assistance of counsel during jury selection
  • Claim 5: Sievers was denied his right to a fair trial, due process and reliable adversarial testing due to ineffective assistance of counsel during guilt phase
  • Claim 6: Counsel was ineffective by failing to conduct a thorough penalty phase investigation during the trial

I'm curious to learn what this "new evidence not presented at trial" is.

I know that appeals are an important part of our justice system but this is so tedious.

It all smacks of "he doesn't like the verdict/sentence so..."

Different attorneys voicing opinions about how they might have handled a trial/sentencing is Monday morning quarterbacking IMO. It's not a basis for ineffective counsel. There are alternate ways to present every case/defendant. Again, it's not ineffective counsel to have done it differently.

Plus if they had a hundred years, what possible mitigating factor would have spared the DP?

I'll be shocked if this is granted.

it all seems to be based on ineffective council. Didn't he hand pick his attorneys? I mean, he and Mummert looked like best buddies. and his mom was VERY involved if i remember correctly.

EXACTLY Megnut. He doesn't have any real evidence to show his sentence was unfair, but that won't stop him from lying and manipulating the truth. He makes me sick.

No, MS was housed at Union Correctional Institution (also known as Florida State Prison).

However, on 10/13/2025, he's currently being housed at the Lee County Sheriff's Office jail in Fort Myers, FL for appeal hearing challenging his conviction and death sentence.



JR is housed at South Bay Correctional and Rehabilitation Facility in South Bay, Palm Beach County.

JRR's status is the same as MS's on the FL inmate search website:

He's not going to be a witness here is he?

I truly don’t know what to make of Mark’s current appeal but this 2020 letter apparently sent by Jimmy Rodgers - from prison - to Bonnie Sievers is quite something. I’m trying to attach all 6 pages below

This letter is part of their “newly discovered evidence” and they argue it is crucial for the court to examine this and understand what the letter lays out (that this crime was not one where two hitmen were hired by Sievers).

Tuesday, October 14th:
*Motions [Evidentiary] Hearing (Day 2) (@ 9am ET) – FL – Dr. Teresa Ann Grace Sievers (46) (June 29, 2015, Bonita Springs) – *Mark D. Sievers (48/now 57) arrested & charged (2/26/16) & indicted (5/4/16) with 1st degree premeditated murder & conspiracy to commit 1st degree premeditated murder. Plead not guilty. No bond. DA will seek DP. Lee County #15-CF-000673-B / Appeal Case #SC20-225
Trial began on 11/12/19 with jury selection, opening statements started on 11/20. Trial expected to last 5 weeks. Jury: 9 women & 3 men, with 2 alternates (1 is a man). Trial ended on 12/4/19 with closing arguments & jury started deliberations. Deliberations took about 4 hours 10 minutes – GUILTY of 1st degree premeditated murder & conspiracy to commit 1st degree premeditated murder.
12/10/19: Jury took less than 3 hours to reach a verdict in the penalty phase – recommended & given death penalty sentence.
Appeal: 11/17/22: Appeal for new trial was denied. 2/10/25: Appeal for reconsideration was granted.
Judge Bruce Kyle presiding. DA Hamid Hunter & Christina Pacheco & defense attorney Megan Montagno.

8/4/25 Update: A brief status hearing was held today as part of the ongoing appeal process. The primary purpose of the session was to confirm the date of the upcoming evidentiary hearing & to address procedural matters related to expert witnesses. The evidentiary hearing in Sievers’ appeal is scheduled for 10/13/25 @ 8:30am. The court is expected to review expert testimony & other materials that could impact the original conviction & sentencing.
10/13/25 Update: Sievers' defense is claiming a few things in this hearing. *New Evidence: Defense says convicted co-defendant Jimmy Rodgers wrote a letter saying Sievers had nothing to do with his wife's murder. *Ineffective Counsel: Failure of a qualified attorney. Ineffective counsel during jury selection. Ineffective counsel during the guilt phase. Ineffective counsel during the penalty phase investigation. The defense's first witness was Jimmy Rodgers' trial attorney Kathleen Fitzgerald. The defense's second witness was attorney Michael Mummert. He was on the defense team for Sievers. The third witness is attorney Gregory Messore, who represented Sievers at trial.
