Just read that. The poor babies. They need a union! :maddening:

I am sorry but I laughed when I read that article.

Showers are locked because the guards don't have a visual in there. It's for everybody's safety including the inmates. Some maximum security pods will allow one inmate at a time to shower. That way the guards know who is where at all times.

Two meals a day...yeah maybe on the weekends when there is brunch and supper.

Meals have to follow the Canada food guide. They still suck but they do follow the guide as much as fat and starch can.

Oh, darn. I do believe that should have been one of the charges against him.

Thanks.

I don't think it works that way. When someone is arrested, police contact the prosecutor's office to determine what charges will be laid. That can be amended prior to trial, depending on the evidence that is identified, but once trial starts and the accused is facing all charges related to one specific event (abduction, rape and murder of a child), the prosecution can't continue piling it on after the trial is over.

On the upside, regarding the sexually deviant content on Rafferty's computer, investigators will have tracked down where he got it and pursued a separate investigation into other victims ... I'm pretty sure of that.

Of course they would have :) They can't ignore that. If that trail leads to more charges for somebody else down the road...even if it is in another country then perhaps other children will be saved from other deviants.

I guess the meals were a lot more generous where Rafferty was incarcerated during the trial.

From just seeing the sketches, I think TLM was even heavier when she testified. We all know how much food MR's been given..

This is in regards to the article someone posted here about whether the writter was talking about TLM and the two meals a day of minimal food

Can I ask a couple of OT questions here, since I don't know where else I can do it?

I was following the Randall Hopley case--that's the guy in Sparwood, BC, who abducted KH and then brought him back. I found one thread about it, but it was closed and the link to the new thread doesn't work. I am curious what happened with that. Was he convicted? Is he in jail?

Also, during this (Rafferty's) trial, there was a mention of a WS member whose daughter went missing. She was an adult, I think. I'm not sure of the WS member's name, or her daughter's. Was she found? Is she okay? Thanks.

Yes the daughter was found but I didnt check in to see why

Sometimes, I wish I was a lawyer so I could answer my own questions :)

Snipped for space:

Sometimes I wish I was a psychiatrist to try and figure out what the heck makes people like williams, bernardo, and now MR and all those other monsters tick. I guess part of their problem is physiological. Their brains just aren't built like ours and don't work like ours... some probably start early, whilst others probably go through life being model citizens until the trigger comes along.

I am just crossing fingers that people will come out of the wood works and charge him with rape. The one in January may have been afraid, maybe she will now?

I really hope to God that loser suffers in every possible way.

Really? The pictures of her in the car make her look the same or thinner. Man I wished they were allowed to take pictures in court.

I don't have the link, but the sketch of when she is testifying shows her sitting and she seems heavier. I think the short hair in the car pic appears like that because her face is round and its a side view. Mind you, the stress of having to testify in front of a nation about what you did should have made her lose 10 pounds

Except ... that an appeal can only be granted on the basis of legal errors or new evidence. Without either, there is no appeal. A lawyer would need to review the case to identify any potential legal errors and it seems to me that the right to counsel would include the possibility of having a lawyer review trial proceeding to identify any errors in judgment.

Yes. But if there weren't errors in judgement, then if MR wants an appeal (he certainly has a right to appeal), he would have to pay for it himself, or represent himself, or again, if a lawyer wants to do it pro bono, that would be up to a lawyer, this case is high profile enough that a lawyer wanting coverage and prestige I can see doing it pro bono.

And oh, are you sure that an appeal can ONLY be granted on those grounds?? I don't agree with that.

Here is a good site to get info on the Appeal process in Canada

As you can see there are many grounds for appeal, not just Error of Law and New Evidence.

Lack of a father could be a problem. Maybe psychopathy can be a developmental attachment problem for some that comes with some predisposition. I think Bernardo had a strange family dynamic and where is Rafferty's father?

I don't see any information indicating that a person convicted of a criminal offence would not be entitled to a lawyer in order to appeal the sentence or have a review of the case.
