I'm catching up on today's trial by watching the videos. This judge stresses me out. I want to reach through the monitor and smack him.
I'm at the part about the discussion over SM's truck. I think I understand where she's going and I don't understand why he wont let her take the questioning further! GAH!

So, in recap, Tammy was in the vehicle while he made the phone call to Heather from the pay phone and he parked a distance so she wouldn't see him doing that (YEAH RIGHT, as she handcuffs your a$$ to the bed every night. How would he possibly get away with calling her while Tams sat in the truck at 1:30 in the morning!)

And, yes, she was texting her boyfriend while he was at the payphone.

And after screwing his wife in the car and having such a.good time, he decided to sneak a payphone call that night.

Affirming to tell the truth..You have a right to just "affirm" that you will tell the truth, the whole truth, and nothing but the truth. No gods, Bibles, or anything else religious need to be involved.

Brianna's (BW) testimony today:

The judge said BW’s testimony would be hearsay, not permissible in court.

“The worst thing that can happen, I think, is to have this case have to be retried because we went too far in allowing evidence that really wasn’t critical to your case,” the judge said to the prosecutors.

BW, however, has testified before. She took the stand last year during Moorer’s kidnapping trial, which ended in a mistrial.

During the 2016 trial, BW said Elvis told her that Moorer called, claiming he was ready to leave his wife. BW wasn’t able to give that information to jurors Tuesday, and without that key testimony, Tuesday’s jurors only have Moorer’s side of the story.

Moorer claims he told Elvis to leave him alone. He was happy with his wife and wanted no relationship with Elvis.

BBM above. I do believe that SM told her he was leaving his wife. I think that the two of them used this ploy to lure HE somewhere so that they could kill her. JMO

Judge Dennis, is he the only judge in Horry County? He is just like a bad butt rash that will not go away.

how in the world can this judge not be disbarred ????? I remember this from the first trial and I can not listen to him again so won't watch this retrial...he is so rude to this attorney and is almost making it impossible for her to do her job.

I have been in a courtroom before and people had an option to take an oath on bible to tell the truth or take another oath without a bible to promise to tell the truth. There was a name for it but I can't quite remember. I saw someone choose to do the second one.
When I had jury duty down in Charleston (about 12 years ago), they did something like that for 2 jurors. They swore in all potential jurors before selection. A couple years ago when I had jury duty, in the same courtroom where this case is being tried, no alternative was mentioned. I wonder if anybody has ever said "no, I do not promise to tell the truth."

Actually, he ain't from 'round these parts. He's a circuit judge.

it is not often that a judge is so outrageous that I can't watch the trial...but this one is it. Too frustrating to watch him belittle that female state attorney...I caan't believe she is just taking his verbal abuse.

The obstruction of justice trial for Sidney Moorer, the man accused of kidnapping missing woman Heather Elvis and obstructing the investigation into her disappearance, is scheduled to begin on Monday.

Moorer is charged with obstruction of justice for allegedly lying to investigators about making a call to Elvis from a pay phone on the night of her disappearance in December 2013. This was revealed during his first trial last year, which was for a kidnapping charge.

The defendant previously appeared in court at the end of July for a hearing to discuss issues ahead of the start of the Aug. 28 trial, including a motion by the defense to suppress evidence.

His initial 2016 kidnapping trial ended in a mistrial. A new trial date has not yet been set on that charge.

Tammy Moorer is also charged with kidnapping in the case, but she has yet to go to trial on her charge. A date has not been scheduled.
