December 2013: KC worked patrol. There was a call for service at PTL for a suspicious vehicle. The State is showing KC his report from that incident to refresh his memory.

KC observed a vehicle parked on the right side, "as soon as you come in, facing the waterway." Car did not appear to be inoperable. No people around. No sign of struggle.

Ran tags, car was not stolen, was registered to Terry Elvis.

KC went to the address on the registration.

KC spoke with TE. Asked if he owned the vehicle. Asked if he knew why it was at PTL and if he knew who drove the car.

TE stated his daughter, Heather, drove the car, and he didn't know why it was there. He last spoke to his daughter the night of the 17th.

TE had an extra key, so the two of them went to the landing, and TE unlocked the vehicle.

Both KC and TE wore gloves when they touched the car, in an "abundance of caution."

The interior of the car was a "mess." You could sit in the driver's seat, but you would have to empty any other seat to sit in one of them.

When KC and TE returned to TE's home, TE provided KC with phone records, which he did not inspect at that time.

KC reached out to BW, Heather's roommate, on her cell phone.

KC also reached out to SS, Heather's date from that evening.

He was able to speak to both.

After speaking with BW and SS, KC was instructed by his Corporal (DF) to go to the Moorer house.

SM met KC outside. SM was not suspected of a crime at that point and was not arrested. The interview was recorded by dash-cam. The DVD was just submitted into evidence (meaning the jury is about to hear it).

I sure hope the jury can make out the audio better than me. I don't remember it being THIS tough to understand.

Deleted for formatting hiccups.

During the course of the interview, SM did not mention having reached out to Heather via payphone.

Had KC known about the payphone, it would've changed the course of the investigation and the tone of that interview.

Which Sidney knew, which is why he did NOT mention the payphone....hence GUILTY

Cross:

KC states he knew TE relatively well at the time but did not have his phone number.
KC knew Heather grew up in Horry County, but he didn't know of any connection she may have had to PTL.
When KC and TE went to PTL, he was only investigating a missing person, but he did not suspect a crime; he was just looking for clues as to where Heather may be.

"Let me ask you this" is the Defense's "if you don't mind."

KC states that one of the other officers said to SM if he knows where Heather is, he needs to tell them and not hinder the investigation.

KC states TE had already contacted SM at that time, and SM took that phone call to be confrontational. SM called 911 after the call from TE, which is why SM states he was outside waiting for the officers when they arrived.

Re-direct (Helms):

Helms asks about the "hindering the investigation" comment, and KC states it was due to inconsistencies in SM's statements.
Re: TE giving KC the phone records - it was voluntarily to help locate his daughter.

Recess for about 10-15 minutes
