Cross-exam by defense

JG wouldn't know when SD card was removed.

JG wouldn't know if operating system for truck could know when SD card removed

No redirect. Witness excused.

Cross examination:

JG states the headlights for that truck are specific to that truck model.
He also gets annoyed when the Defense asks him if he has any way of knowing who removed the SD card. He responded, "I just answered that. No."
Now he's answering questions with a series of, "I would not know," and the Defense gives up.

Here comes Joyce!!!

Joyce Åland is next pros witness (!)

JA is neighbor of Moorers. Lives down the road from them.

Lived there in Dec. 2013. First heard about HE case in Jan.2014.
Had surveillance cameras on her residence. Two pointed towards the road.
If someone was driving toward PTL "they'd drive by my house".
Testifying about her cameras and photos of them.
Cameras always record onto DVR. They're motion-activated. Motion on road trips light sensor at night.
Testimony about video from her cameras. Had Dec. 18 and 19 video, unplugged system so it wouldn't record over. Contacted Elvis family via FB, police were contacted, police came and got DVR

JA states she was sent an article about the case from a friend.
JA Googled the address of the Moorers, and knew Heather's car was found at PTL. She lives on the route to get from one to the other and has cameras at her house.
She figured her cameras may have captured them driving from their house to the landing.
She states the cameras are not visible, because they're about the "size of a Coke can."
And she's so cute!

JA contacted a member of the Elvis family through Facebook.
They turned her contact information over to the police, and she was contacted by a detective.
In the meantime, she turned off her security cameras, because they were about to record over the night in question.
She voluntarily gave the detective her DVR.

JA still testifying about video from her cameras.
Time on video not correct. Didn't automatically update for daylight savings time.

Vehicle seen going by at 3:45 am towards PTL

I <3 Joyce. I'm looking forward to her cross-examination so she can hand the defense attorney his a$$.
LOL

JA still testifying about video. PTL about 5 mins from her house.

A truck passed by about 10 mins after that. Light came on.

Her road is residential. ,no shopping centers, gas stations.

Not busy road, residential people, no tourists or sightseers.

Didn't watch video before given to LE.

Other camera showed same vehicle from different angle.

Doesn't know SM. Honestly thought turning video in would help clear SM.

About 10 mins. from vehicle on video first time to second time

"If I'm being honest, when I found out I had video evidence, I thought it was going to clear his [SM] name."
JA states she wasn't trying to get anybody in trouble.
Also, "I don't believe in coincidences."

Cross examination!

  • #874
JA tells the Defense the night she read the article was the first time she knew of SM's name, because he was a person of interest, according to the article.

  • #875
Regarding her security video, JA states, "based on cop shows, it seems less grainy." Ha! She's my spirit animal.

  • #876
Joyce is already a step ahead of the defense attorney’s questions.

  • #877
Now for cross-exam of JA:

When article was sent to her is when she found out SM's name

Her cameras were bought because theft was occurring

She can change time on cameras, but didn't after initial set up b/c she thought it would change automatically with DST.

Her road doesn't dead-end into PTL.

She can't tell vehicle destination from video.

Nothing more from the Defense. It honestly felt like they weren't even trying.

Chris Helms on re-direct is asking JA about different (read: shorter, more sensible) routes from her house out to Hwy 544.

  • #879
No re-cross. Well done, Rockstar Joyce!

Redirect from prosecutor:

Shows JA a map of her house, Moorer's house, and PTL.
Not much past her house except couple houses, construction sites, farms, and PTL. Nothing open at 3:00/4:00 am.
ETA : testifies about alternate routes to 544
No re-cross

Witness excused. Recess for 10-15
