#TammyMoorer - In Sidney Moorer's trial Bri testified that Heather told her Sidney called, said he was leaving his wife, wanted to see her, be with her. She was not asked that this time, only that Heather was hysterical/upset. I'm assuming the judge ruled the other statement out.

I get so confused sometimes with the heresay rule.

I thought she could testify to what she heard directly from Heather. So if Heather told her that SM said this or that, then I dont see why Bri could not testify that she heard Heather say those things.

The jury can choose to believe or not believe what she is saying Heather told her on the phone but she heard it herself so I am not sure why that would be considered heresay.

Oh well. Darn. Wish that her testimony was not limited about SMs call to Heather.

is it just me, or is this cross totally pointless???

This young defense attorney certainly doesn't seem effective to me. He asks so many irrelevant questions, and some other really stupid questions. Questions like bringing up the oreos and such are totally pointless.

I am so sick and tired of defense trying to disparage Heather's character. This feels so much like David vs. Goliath here. Tammy is Goliath, thinks, has always thought, she was bigger and badder. Above it all. She fails to remember though, David won in the end.

Poor dude. Kinda feel sorry for him. Oh well, it's his case to loose. On the other hand, he's learning the ropes.

Defense asked Bri if she's aware of any drug use by Heather. She said she's not. He then asked if Heather ever did a juice cleanse to pass a drug test. Bri said the only juice cleanse she knows Heather did was to lose weight. He asked if she ever saw a positive pregnancy test, and she said no. Only the error.

Defense tried to introduce Heather's social media post about wanting or needing to get out of that town (not sure exactly) but prosecution and judge shut it down quickly.

Sadly, mostly it's hearsay if Heather said it (there are some exceptions). However, if it is something that Tammy said, that would not be hearsay (cause Tammy is the defendant).

I feel a little bad for him, too. You know Tammy handed him all these questions to ask. It's the kind of stuff she was spewing in her rants.

Is it possible that SM met HE at LB and gave her the pregnancy test which she then went back to her apartment to open/use in the hall bathroom which would be closest to the door? Then took the results with her to meet at PTL...

Defense is bringing up some nonsense about Heather at a strip club in North Carolina. Not sure what that's about. Bri said she heard about it.

I wish witnesses would ask Casey Brown who he is referring to when he says "she" or "that woman". Make him say Heather's name!!

I love how Nancy seems to make a point of referring to him as Casey Brown.

Its already been stated in Sids trial. I posted the video of her testimony a day or so ago.

Yes, I know, but Nancy instructed her not to say what Heather said at this trial. And the only reason for those instructions are to avoid hearsay.

In the last hour I think the defense has only proven there were Cheez-Its in the couch and a few liquor bottles laying around.

Ok then. The Jurors have got to be getting irritated as I am with the defense.
