DeMarino says he saw a picture of Heather Elvis on a phone at Tammy and Sidney Moorer's house. The prosecution asks if when he saw that picture if it looks like Heather could talk or walk. He says no.

Solicitor Nancy Livesay asks DeMarino if he expects anyone to hear from Heather Elvis again after seeing that picture. He says no.

Defense attorney Greg McCollum questioning DeMarino about his past drug use, how long he's worked, and the fact that he's lied to the police before.

During cross examination, the defense is bringing up Denamiro's drug use and that he has lied to people before and that he's lied to the police before when police have questioned him about something he's done @WBTWNews13

Damning evidence. Why wasn't he called during SM's trial????
Maybe this witness was too afraid to testify in SM's trial because Tammy was still free.

Missing Items List:

TM Computer-testimony from friend of M kids

This defense attorney is being a jerk. Questions that have nothing to truly do with the trial at hand, other than trying to paint him as a bad kid/hoodlum. This is absurd.

  • #545
I get that they are trying to paint this witness as unreliable, a criminal, liar, etc ... (basically same as TM and SM) .. what does he have to gain to make that up???

OMG. I might puke.
Me too! I'm in a detective's car, on my way to the airport, watching on my phone. I have tears streaming down my face. Luckily he's deep in convo with the other passenger. I'm devastated.

They did the same thing to him at SM trial but Truslow was more concerned with his criminal record. It's their job, it's fine, if I were on the jury, that would be irrelevant.

ETA: I think that is why Nancy got it out of the way when she questioned him, about his record and if he got anything in exchange for this information.
IMO

Dang WAT !,

Thanks for reminding me he did testify in SM's trial :).

Boost mobile is a prepaid phone. They weren't dumb enough to take a photo of a dead Heather on one of their traceable phones.

I guess since there was an objection last time, he wasn't allowed to be asked who showed him the photo?

What phone was this on, and why not recovered?

I need answer and not given.

Did I miss why not recovered by le?

I remember one of the police officers testified that they took a flip phone into evidence. I will have to go back during lunch and look.

Did Heather's family know this? So, so sorry.

Defense attorney Greg McCollum asking about DeMarino's burglary charge and two counts of B&E Auto. DeMarino says he wasn't hoping to get treated differently by coming forward. Says he told someone while he was in jail.

#TammyMoorer - On cross exam the defense questions center around Demarino drug use and dishonesty

#TammyMoorer - Defense: Have you been lying since you learned to talk?

Cathy Russon‏ @cathyrusson 1m1 minute ago
#TammyMoorer - DeMarino is looking very nervous, jumping, can't sit still, shaking.

It's what defense attorneys do. Question the credibility of the witness, and i must say, this witness is definitely not an upstanding citizen.

The defense does not want the jury to believe this witness.

I can barely understand Donald on my feed. I believe him. I saw him on during Sids and I think he had a wake up moment for life.

  • #555
So defense can get witness to testify to "hear-say" because it "goes towards motive". I feel Judge has been given the defense more leeway the past couple of days.

  • #556
I bet hes trying to get a reaction out of this witness. Then he can say "oh maybe he did something to HE. Look at his temper."

  • #557
I know this guy has a criminal past and drug use but I feel for him . It takes a lot of courage to get on the stand and testify knowing he was going to be attacked like that .

  • #558
What is the reason for the next break?

  • #559
I think the jury will believe this fella.

  • #560
Audio and video has been horrendous but I think they're setting up so defense can play back a recording of the cousin (maybe a police interview or something). See TTF14's post below.

  • #560
So now they're setting up audio of a conversation between him and his mom when he was in jail where he supposedly tells her he lied about the photo and was just trying to get "some help."
